A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
RESCINDING RESOLUTION 08 -083 AND
ADOPTING A 2010 -11 MASTER SCHEDULE OF FEES
WHEREAS, the City Council of the City of Poway has the authority to establish
fees for City services; and
WHEREAS, the City Council finds it necessary to recover the costs for City
services; and
WHEREAS, an updated fee schedule has been developed which is consistent
with the City Council's direction regarding cost recovery, which is set forth in the
attached Master Schedule of Fees; and
WHEREAS, the proposed fees do not exceed the reasonable costs of providing
the services for which the fees are imposed; and
WHEREAS, the proposed fees will supersede any previously established fee for
the specified City services; and
WHEREAS, a duly noticed public hearing has been held, allowing for public
comment on the establishment of said fees.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Poway as follows:
Section 1. The foregoing recitals are true and correct, and the City Council so
finds and determines that the fees shown in the attached Master Fee Schedule (Exhibit
1) are hereby adopted and supersede any previously established fee for the identified
City service.
Section 2 . Resolution 08 -083 adopting a Master Fee Schedule is hereby
rescinded effective July 6, 2010.
Section 3. The fees shown in Exhibit 1 of the attached Master Fee Schedule
shall become effective July 6, 2010.
Section 4 . The provisions of Resolution No. 09 -063, establishing certain
permit fee waivers and reductions for property owners affected by the Witch Creek Fire,
shall continue in full force and effect.

Section 5 . Any revised development fees contained in the Master Fee
Schedule set forth in Exhibit 1 shall not apply to any project for which a substantially
completed application, as determined by the Director of Development Services, for
Building Permit, Development Review, Conditional Use Permit, Minor Conditional Use
Permit, Variance or Minor Development Review application has been submitted prior to
the effective date of this Resolution. However, if the applicant does not obtain approval
of the application within one year of submittal, or if the approval of the application
expires and no Building Permit is obtained prior to its expiration, then any re- submittal of
the application or submittal of a new application would be subject to the Building Permit
fees in effect at the time of Building Permit application.
