ABSTRACT
The applicant is requesting that the City Council grant a waiver of the requirement to underground
existing overhead utility lines and poles along the north property line for the property located north
of Lake Poway Road and north of Lakeview Road, within the RR-C zone.
ENVIRONMENTAL REVIEW
The project is found to be categorically exempt under Class 1 as it is an existing facility.
FISCAL IMPACT
None.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
A Public Notice was given to both the applicant and property owner.
RECOMMENDATION
It is recommended that the City Council approve Underground Waiver 99-01.

to waive the requirement for undergrounding of existing overhead
lines located along the north 662-foot length of the property located
on the north side of Lake Poway Road and north of Lakeview Road,
in the RR-C zone.

BACKGROUND
The property in question was the subject of Tentative Tract Map 99-03, which was
approved by the City Council on October 26, 1999. The developer and the owner of the
property have requested that the City Council waive the undergrounding of the existing
overhead lines which extend the length of the property along the northem boundary.
FINDINGS
The City Council policy for the waiver of undergrounding requirements is set forth in
Resolution 91-003. The criteria for approving the waiver includes one circumstance which
is applicable in this case:
The City Council may grent a waiver of the requirement to underground existing utility service
...where overhead service would substantially reduce environmental impacts associated with
new utility service.
The overhead line is located along the north property line where the adjoining properties
are heavily landscaped. Mature trees and shrubs help to add privacy for the existing
homes to the north. The height of the trees is comparable to that of the utility poles. The
area beneath the overhead lines is laden with large rock outcroppings. In order to
complete an undergrounding process, some rock blasting would be required, as well as the

removal of mature plants and trees, in order to make way for the required SDG&E access
and maintenance road. The overhead lines continue on to the west through an older
established Green Valley neighborhood. There is little or no likelihood of a future
undergrounding district being formed in this area; however,the applicant wiil record a deed
covenant agreeing not to oppose an undergrounding district and fo pay a pro rata share
of future undergrounding costs.
ENVIRONMENTAL REVIEW
This application is exempt under the provisions of the Califomia Environmentai Quality Act,
Class 1, Existing Facilities.
FISCAL IMPACT
None.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
Notice of this item being placed on the City Council Consent Calendar was given to both
the applicant and the property owner.
RECOMMENDATION
It is recommended that the City Council grant a waiver of the requirement to underground

OF THE CITY OF POWAY, CALIFORNIA
WAIVING THE REQUIREMENT TO UNDERGROUND UTILITIES UW 99-01
ASSESSOR'S PARCEL NUMBER 278-170-16
WHEREAS, Underground Waiver UW 99-01, submitted=_by Raymond Sims,
Applicant, requests Council to waive the requirement to underground 662 linear feet of
overhead utility lines and poles along the north length of the property located on the north
side of Lake Poway Road and north of Lakeview Road, the RR-C zone; and
WHEREAS, the undergrounding operation would lead to the destruction of mature
vegetation which helps to shield and provide privacy to adjoining properties to the north;
and
WHEREAS, the likelihood that an undergrounding district will be formed which will
affect these overhead lines in the future; and a deed covenant is required which preciudes
opposition to a future undergrounding district should one be formed and agrees to pay a
pro rata share toward the undergounding costs; and
WHEREAS, on December 14, 1999, the City Council held a hearing to solicit
comments from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Environmental Findinas:
The project is found to be Categorically Exempt, Class 1, under the provisions of the
Califomia Environmental Quality Act in that it is an existing facility.
Section 2: Findinas:
1. City Council Resolution No. 91-003 sets forth the criteria by which an underground
waiver may be granted. The criteria includes a provision for a waiver where
overhead service would substantially reduce environmental impacts associated with
new utility service. The removal and undergrounding of the existing lines would
cause substantial environmental damage in the form of rock blasting and removal
of large mature trees and shrubs.
Section 3: City Council Decision:
The City Council hereby approves Underground Waiver 99-01.
