ABSTRACT
As allowed by the Landscape and Lighting Act of 1972 (ACT) , assessments
can be levied and collected from parcels annexed into a district for
the purpose of maintaining public landscape improvements within the
district. The Engineer's report presented to Council on April 12, 1994
reflected no change in the assessment rate for parcels within Landscape
Maintenance District (LMD) 87-1 (South Poway). It has been determined
that by using interest earned and excess funds from the cash carryover
instead of placing them into the reserves, assessments can be reduced
- to $750.839 from $798.76 per net acre per year.
ENVIRONMENTAL REVIEW - This item is not subject to CEQA review.
FISCAL IMPACT
Sufficient revenues will be generated by assessments. The City's
General Fund will offset the cost allocated to McMillin's Development
for maintenance of new landscape improvements for Scripps Poway Parkway
west of Pomerado Road.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE - A copy of this
report has been mailed to Cadillac Fairview.
RECOMMENDATION
It is recommended that the City Council: 1 ) adopt the attached
resolution declaring the intention to levy and collect assessments

1994/95 rescinding Resolution No. 94-037; 2) approve the Amended
Engineer's Report outlining the assessments for fiscal year 1994/95,

BACKGROUND
On April 12, 1994, staff brought to Council the Engineer's report
for LMD 87-1 (South Poway) for approval with a resolution declaring
the intention to levy and collect district assessments. After the
required noticing in the poway News Chieftain, a newspaper of
general circulation, representatives of the South Poway Business
Park property owners requested to meet with staff to discuss the
district's intent to levy assessments at the same rate as FY
1993/94.
FINDINGS
On May 3, 1994, staff met with the South Poway Business Park
representatives. It was determined that by using funds targeted to
go into the "appropriated reserve fund, " the required revenue
assessments could be reduced.
An amended Engineer's report and new assessment recommendations for
the district are attached for reference (Attachment 2) . It has
been found technically correct as presented.

OF THE CITY OF POWAY, CALIFORNIA
DECLARING THE INTENTION TO LEVY AND COLLECT
ASSESSMENTS WITHIN POWAY LANDSCAPE MAINTENANCE
DISTRICT 87-1 FOR FISCAL YEAR 1994/95
RESCINDING RESOLUTION NO. 94-037
WHEREAS, the City Council of the City of Poway desires to
levy and collect assessments within Poway Landscape Maintenance
District 87-1 for the purpose of maintaining, servicing, and
operating public landscape facilities located within the
territory comprised of said district as shown in Exhibit "A" of
the amended Engineer's Report that is on file in the City Clerk's
Office, pursuant to the Landscape and Lighting Act of 1972; and
WHEREAS, the public interest and convenience require the
maintenance, service, and operation of pUblic landscaping and
soundwalls within said territory; and
WHEREAS, Resolution No. 94-037 is hereby rescinded.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Poway as follows:
1. The foregoing recitals are true and correct and the
City Council so finds and determines.
2. Proposed assessments are as detailed in the Engineer's
Report for poway Landscape Maintenance District No. 87-
1 for fiscal year 1994/95.
3. Pursuant to the Streets and Highways Code, a public
hearing will be held on June 14, 1994 in the City
Council Chambers at City Hall to consider the levy and
collection of the proposed assessments.
PASSED, ADOPTED, and APPROVED by the City Council of the
City of poway, California, at a regular meeting this 10th day of
May, 1994.

FOR
POWAY LANDSCAPE MAINTENANCE ASSESSMENT
DISTRICT 87-1 FOR FISCAL YEAR 1994/95
(AMENDED)
PURPOSE
District 87-1 was formed on January 27, 1987 for the purpose of financing the
maintenance of landscape improvements installed in conjunction with new subdivisions
within the boundaries of the district (Exhibit A). This report sets forth the findings and
engineering analysis for poway Landscape Maintenance District 87-1 for fiscal year
1994/95.
FINDINGS
The Landscape and Lighting Act of 1972 (Act) allows assessments to be levied for the
maintenance of certain public improvements within a subject district according to benefit
rather than estimated value (Section 22573).
The necessary revenue required to maintain the landscaping improvements within
poway Landscape Maintenance District 87-1 has been calculated according to benefit
for fiscal year 1994/95 as provided for by the Act. All assessments collected within this
District will be expended on maintenance, utilities, and administration of District 87-1
landscaping improvements.
New District 87-1 improvements, which are to be maintained by the District, include the
landscaping for the South poway Sports Complex and the extension of Scripps poway
Parkway, west of Pomerado Road to the City boundary.
During fiscal year 1993-94, the extension of Scripps poway Parkway, west of Pomerado
Road, was completed by McMillin Development (TM 88,04R) as a condition of map
approval. These improvements have been completed, accepted by the City, and are
now being maintained by landscape maintenance district contract. Since the McMillin
map has neither been finaled nor annexed into the district as of the writing of this report,
the City of Poway proposes to continue to fund TM 88-04R assessments until the
development annexes into the District.
To date, the Parkway Business Centre, Phase II map has not been recorded by the
County of San Diego. Notice has been received by the City of Poway that the
developers filed Chapter 11. Therefore, assessments for these parcels shall be zero
until such time as the map has been deemed complete and has been recorded with the
County.

ENGINEERING and BENEFIT ANALYSES
The name of this district is poway Landscape Maintenance Assessment District 87-1.
The boundary of the district is shown on Exhibit A. Property lines and dimensions of
each lot or parcel of land within the landscaping maintenance district are shown in detail
on the County of San Diego Assessor's maps. These maps are on file in the County
Assessor's Office, 1600 Pacific Highway, Room 103, San Diego, California 92101.
Assessments for the district will be calculated on a per net acre basis by dividing the
required revenue by the total net acres within each district.

Although the following property is annexed into the district, the final map still has not
been recorded by the County of San Diego. Therefore, these parcels will continue to
show a zero assessment for FY 1994/95, and will not be shown in the revenue
calculation of assessments.

Assessments will be collected from properties annexed into the District and that have
recorded maps with the County of San Diego. Assessments will not be collected during
FY 1994/95 for McMillin's Rolling Hills Estates (TIM 88-04R) and Parkway

Business Centre, Phase II (TTM 87-13) because the maps are not anticipated to be
recorded prior to July 1, 1994. Assessments cannot be collected from public-owned
parcels (ie., all public streets, public avenues, public lanes, public roads, public drives,
public courts, public alleys, all easements and rights-of,way, all public parks, greenbelts
and parkways, and all public school property being used for public school purposes).
Upon review of the assessments proposed to be collected, representatives of the
developers of the South poway Business Park requested that interest and excess funds
from FY 1993/94 assessments be used to lower FY 1994/95 assessments. Staff
concurred with this request, and has amended the "Proposed Budget" as noted on
page 4 of this report.
FACILITIES AND MAINTENANCE
The facilities to be maintained by the district are defined as the landscape and hardscape
improvements within the rights-of,way including roadway medians along portions of
Pomerado Road, Scripps Poway Parkway, and Community Road; detention and
retention basins; staging area; and a portion of the proposed park.
The estimated value of the existing improvements to be maintained under this
Landscaping Maintenance District (LMD 87-1) is $21,250,000 - $3,000,000 in
landscaping and $18,250,000 in hardscape and detention basins.
Performance standards and specifications have been developed for the landscape
maintenance improvements to assure a level of quality of landscape assessment district
properties. A recent assessment of the present level of quality has been conducted, and
the current maintenance levels meet the City's landscape maintenance standards.

ASSESSMENT
The assessment for each net acre within District 87-1 is:
Required Revenue = $336,505 = $750.839/yr (or $62.60/mo) per
# of Net Acres 448.172 commercial net acre
Lower contract costs, a larger cash carry over from FY 1993/94, and use of interest
earned allow for a lesser amount of revenue required during FY 1994/95. Therefore,
assessments are proposed to be lowered from $798.76 to $750.839 per net acre per
year.
Those parcels which have been annexed into the district and have a final recorded map,
consist of 412.172 net acres for a total assessment of approximately $309,474.80. The
City's portion of the costs during FY 1994/95, for the equivalent of 36 net acres, totals
$27,030.20.
A complete parcel listing and their respective assessments are shown on Exhibit "C"
which is on file in the office of the City Clerk, City of Poway, California.
