ABSTRACf
As a follow-up to the March 24, 1994 City Council Workshop on implementing an exclusive
franchise for solid waste and recycling, staff has completed the request for bid
specifications and franchise agreement. The bid package is now ready to be provided to
each of the five haulers.
It is recommended that this report be received and filed.

Mashburn Waste & Recycling Services; and Rick Berlin, Laidlaw Waste Systems.

Franchise
BACKGROUND
At the March 24, 1994 Workshop, staff provided Council with a detailed report
summarizing key events and decisions leading to the City's decision to enter into
an exclusive franchise agreement, a timeline for implementing the franchise, and
proposed services to be included.
FINDINGS
Since the Council Workshop, staff has completed the Request for Bid and Franchise
Agreement documents, including a revised timeline schedule (Attachment 1). Based
upon input from the City Attorney and key personnel, staff has incorporated the
minor changes to the Request for Bid and Solid Waste and Recycling Franchise
Agreement. The bid specifications are now ready to be provided to each of the
five haulers.
The services to be included in the franchise agreement are as follows:
. Once weekly curbside collection and disposal of household refuse,
recyclables,green waste and other compostables from
single-family residences. Weekly service wi 11 include collection of
one bulky item per customer per month at no additional cost. Single-
family, one can service, including the collection of one bulky item
per customer, per month, at no additional cost.
. Annua 1 Cl eanup Campaign. Duri ng one part i cul ar week of each calendar
year, residents may dispose of all unwanted bulky items (up to five
cubic yards) at curbside, on the regular pick-up day for each area,
at no additional cost.

residences and businesses.
0 Servicing of all trash receptacles at public bus stops and City-
operated collection bins.
0 On-call collect i on of whi te goods at pre-set collect i on/di sposa 1
rates.
0 Commerci al and industrial services based upon the number of
dumpsters serviced at a frequency of collection determined by the
business establishment and normal health and sanitation practices.
0 Periodic newsletters with billings for public awareness and
education.
0 Single Solid Waste Permit. In the event the solid waste contractor
would be unable to provide a collection service to a customer,
customer may contract with an outside firm to provide the collection
service, provided the outside firm applies for a one-time City
permi t.
0 Complete customer administration, records keeping, and complaints
servicing.
0 Assistance to business/industry in setting up recycling programs.
0 Options to add other recyclables and services upon successful
negotiations.
Other elements of the proposed franchise agreement would include:
0 Warranty bonds to indemnify the City from landfill contamination.
0 Restrictions on the number and type of collection machinery that may
be used on City roads.
0 Franchise fee paid to the City based upon a percentage of total
receipts.
0 City's right to direct flow of refuse and recyclables as a member of
the San Diego Solid Waste Management Authority.
0 Initial seven-year franchise with one-year renewal options beginning
after the end of the first three years.
0 Annual rate increases determined by formula that includes landfill
tipping fee increases, and a percentage of the Consumer Price Index.

All fee increases must be verified by staff for appropriateness and
submitted to the City Council for adoption. Approved rates will be
printed in the periodic newsletter to ensure all citizens are aware
of options to reduce their respective costs by source reduction
efforts.
Full implementation of the Solid Waste Franchise is planned for January 1, 1995.
