Resolution No. 92-195 ABSTRACT AB 939 mandates that each city in California prepare and adopt an Integrated Waste Plan. It has been required by the state California Integrated Waste Management Board that each city also submit their Source Reduction and Recycling and Non-Disposal Facility Elements by August 31, 1994. Submission of the Household Hazardous Waste Element is to be done at the discretion of the city. - ENVIRONMENTAL REVIEW On July 12, 1994, a Negative Declaration was issued based upon findings that the project(s) will have no significant effect upon the environment. FISCAL IMPACT Funding for the plan's implementation is to be provided from regional and/or local solid waste collection fees. ADDmONAL PUBLIC NOTIFICATION AND CORRESPONDENCE A copy of this report has been sent to Reed Bennett, County of San Diego Pubic Works Solid Waste Division, and was published in the Poway News Chieftain August 4, 1994. RECOMMENDATION' It is recommended that the city Council adopt by resolution (Attachment 1) the City'S Final Draft SRRE, HHWE, and NDFE as required by AB 939 which shall be adopted, by reference into the City of poway's General Plan, Waste Manaqement Plan. rescindinq Resolution No. 92-195. Nelson, Management Aide~ DATE: August 16, 1994 SUBJECT: Resolution Adoptinq the City of Poway's Final Draft of the Source Reduction and ReCyclinq Element, Household Hazardous Waste Element, and Non-Disposal Facility Element, Rescindinq ReSOlution No. 92-195 BACKGROUND On July 12, 1994, The poway City Council allowed public testimony regarding the City'S Source Reduction and Recycling Element (SRRE), Household Hazardous Waste Element (HHWE) , and the Non- Disposal Facility Element (NDFE), and issued a Negative Declaration prior to setting date for the adoption of said documents. Although no public comments were received, Councilmembers requested additional material be submitted with the documents regarding the City'S recycling and green waste programs and the use of a single-franchise hauler beginning January 1, 1995. As required by the amendments of AB 939, the City is required to update the programs through other methods than periodically revising the documents. One such report [required by AB 440 - Diversion Counts], is to be submitted to, and received by, the California Integrated Waste Management Board no later than August 31, 1994. Staff will submit this report to the Council agenda for information. FINDINGS No public comments were taken during the public meeting held by City Council on July 12, 1994. Once the final drafts are adopted by Council, they will be forwarded to the state with the necessary documentation between August 17 and 25, 1994. JLB:JDF:JRW:DWC:PSN -- Attachments: 1- Resolution Adopting the SRRE, HHWE, and NDFE 3 of 5 AUG 1 6 1994 ITEM 8 fit RESOLUTION NO. 94- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA ADOPTING THE SOURCE REDUCTION AND RECYCLING ELEMENT, THE HOUSEHOLD HAZARDOUS WASTE ELEMENT, AND THE NON-DISPOSAL FACILITY ELEMENT, AND RESCINDING RESOLUTION NO. 92-195 WHEREAS, on September 29, 1989, the California Integrated Waste Management Act of 1989 (AB 939) was signed into law; and WHEREAS, AB 939 requires that each city in California prepare and adopt an Integrated Waste Management Plan that outlines how the City will reduce the amount of waste entering landfills by at least 25% by 1995 and 50% by 2000; and WHEREAS, the Integrated Waste Management Plan consists of a Source Reduction and Recycling Element (SRRE) , a Household Hazardous Waste Element (HHWE) , and a Non-Disposal Facility Element, and WHEREAS, both the SRRE, HHWE, and NDFE have been reviewed by City of poway council, adjacent jurisdictions, the County, and the State; and WHEREAS, the 'Preliminary' Draft SRRE and HHWE were prepared in accordance with the requirements of the Integrated Waste Management Act and adopted by Council Resolution No. 92-195 on November 17, 1992; and WHEREAS, a local public hearing was held on July 12, 1994 as required for the adoption of the SRRE, HHWE, and NDFE, and WHEREAS, all comments received on the SRRE, HHWE, and NDFE are to be addressed and incorporated into the adopted 'Final' Draft Waste Management Plan; and WHEREAS, Resolution No. 92-195 is hereby rescinded. NOW, THEREFORE, BE IT RESOLVED that the city Council of the City of poway does hereby adopt the documents placed on official file in the offices of the City Clerk and the Director of Public Services, and 'which are referred to as the Source Reduction and Recycling Element (SRRE), Household Hazardous Waste Element (HHWE), and Non-Disposal Facility Element, dated November 1991, addenda and comments inclusive. 4 of 5 AUG 1 6 1994 ITEM 8 J!!I - - Resolution No. 94- - Page 2 APPROVED and ADOPTED by the City Council of the city of Poway, state of California, this 16th day of August, 1994.
