BACIC6ROUM0:
The boundaries of the City of Poway' s Sewer Improvement District are not coter-
minous with the boundaries of the City of Poway. All properties receiving sewer
service must be included in said District.

i. The Green Valley Estates Unit II property is not within the boundartes
of the Sewer Improvement District (Attachment 1).
2. The property is located off of Old Station Road and Fiddletown Road.
The legal description oP the proposed sewer annexation is as described
in Attachment 2.
3. The pro,ject is exempt under C.E.Q.A. (Attachment 3).
4. The property owners have consented to the annexation (Attachment 4) and
have paid the requlred fees.

None.
ENVIROINIENTIU. INPACT:
No C.E.Q.A. review is required far this report.

RECONIENDATION
It is recortmended that the City Council adopt the resolution (Attachment 5)
ordering the Green Valley Estates Unit II annexation to the Sewer Improvement
District and authorize the City Clerk to make the necessary filings required by
law.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ANNEXING TERRITORY TO THE
SEWER IMPROVEMENT DISTRICT OF THE CITY OF POWAY
GREEN VALLEY ESTATES UNIT II ANNEXATION
WHEREAS, the property described in Exhibit A requires sewer service; and
WHEREAS, property must be within the Sewer Improvement District to recelve
sewer service; and
WHEREAS, the City Council of the City of Poway has reviewed and considered
the annexation of the property to the Sewer Improvement District of the City of
Poway.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
1. The territory to be annexed is as described in Exhibit A.
2. The conditions of annexation are:
a. The payment of the sum of �18,695 to the City of Poway for the right
and use of alt existing property, real and personal of the Sewer
Improvement District.
b. The payment of ail costs oP said annexation, including but not
limited to advertising, engineering, and attorney' s fees.
3. 7he inclusion of the territory in the Sewer Improvement District is in
the best interest of the land owners and the City of Poway.
4. The annexation has been revtewed pursuant to the provtsions of the
California Environmental Quality Act, and has been bound to be exempt
under Class 19 of Categorical Exemptions.
5. No City tax split shall occur due to this annexation. The property is
within the corporate boundary of the City of Poway and the annexation is
to an improvement district within the City.
6. 7he annexation of the territory described in Exhibit A shail become
effective immediately upon passage of the Resoiution.
7. The City Clerk shail make the necessary fitings required by law.
PASSED, ADOPTED, AND APPROVED, by the City Council af the City of Poway,
California, at a regular meeting this 28th day of January, 1992.
