SUBJECT: M 6 M Development Annexation to Sewer Improvement District
BACK6ROUN0:
The boundaries of the City of Poway' s Sewer Improvement Dtstrict are not coter-
minous with the boundaries of the City oP Poway. All properties receiving sewer
service must be included in said District.
FINOINGS: �
1. The M 5 M Development property is not within the boundaries of the
Sewer Improvement Distrtct (Attachment 1).
2. The property is located on Orchard Bend Road and the legal description
af the proposed sewer annexation is as described in Attachment 2.
3. The pro�ect is exempt under C.E.Q.A. (Attachment 3).
4. The property owners have consented to the annexation (Attachment 4) and
have paid the required fees.

Parcel 6 of Record of Survey Map No. 5554, £iled in the office of the County Recorder
of San Diego County, July 27, 1960, being a portion of Section 25, T13S, R2W, San
Bernardino Meridian, in the City of Poway, County of San Diego, State of California, and
an adjacent portion of the easement designated as "Easement reserved for road" on said
record of survey map No. 5554, being more fully described as follows:
Commencing at the Point of Intersection of the Cul-de-Sac of said easement designated
as "Easement reserved for road", on said record of survey map No. 5554, said point also
being the TRUE POINT OF BEGINNING; thence South 37°14'06" West for 20.00 feet;
thence South 64°37'S0" West for 50.00 feet; thence South 62°32'40" West for 251.14 feet;

Resolution No. 92-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ANNEXING TERRITORY TO THE
SEWER IMPROVEMENT DISTRICT OF THE CITY OF POWAY
M 8 M DEVELOPMENT ANNEXATION
WHEREAS, the property described in Exhibit A requires sewer service; and
WHEREAS, property must be within the Sewer Impravement District to receive
sewer service; and
WHEREAS, the City Council of the City of Poway has reviewed and considered
the annexation of the praperty to the Sewer Improvement District of the City of
Powdy.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
1. The territory to be annexed is as described tn Exhibit A.
2. The conditions of annexation are:
a. The payment of the sum of �935 to the City of Poway for the right
and use of all existing property, real and personal of the Sewer
Improvement District.
b. The payment oP all costs of said annexation, including but not
limited to advertising, engineering, and attorney' s fees.
3. The inclusion oP the territory in the Sewer Improvement District is in
the best interest af the land owners and the City of Poway.
4. The annexation has been reviewed pursuant to the provisions of the
CaliPornia Environmental Quality Act, and has been bound to be exempt
under Class 19 of Categorical Exemptions.
5. No City tax sptit shall occur due to this annexation. The property is
within the corporate boundary of the City of Poway and the annexation is
to an improvement distrlct within the City.
6. The annexation of the territory described in Exhibit A shall become
effective irtmediately upon passage af the Resolution.
7. The City Clerk shall make the necessary filings required by law.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 18th day of February, 1992.
