BAQCGROUND
The City Council initiated Specific Plan Amendment 84-01T on
November 26 , 1991 to amend the South Poway Specific Plan to allow
bulk oil storage tanks by condltional use permit. Pennzoil
Products Company asserts that they can operate more safely by
reducing the storage and handling of 55 gallon drums . The purpose
of installing four bulk storage tanks, each with a capacity of 6700
gallons, is to reduce deliveries to customers by ( 1 ) pumping from
55 gallon drums which are stored in the warehouse and ( 2 ) 6 , 000
gallon tank trucks making multiple stops to deliver relatively
small quantities (see Attachment 5 ) . Nothing smaller than a 55
gallon drum would be filled and these would be kept to a minimum in
favor of 335 gallon tanks .

The original specific plan amendment (SPA 64-01F) and conditional
use permit (CUP 89-09 ) were approved by the City Council on
November 28, 1989 . The amendment allowed warehousing or
distribution of hazardous materials/chemicals/fuels, warehoused and
distributed as packaged when received.
DISCUSSION
Staff has reviewed the specific plan amendment and the conditional
use permit modificatlon from three perspectives, namely traffic
reduction, safety of operations and whether other businesses would
desire to add fuel dispensing based on the amendment to allow bulk
storage of fuels. The reduction of traffic to and from the
existing facility would be on the order of 30 to 40 truck trips per
day (out of 50 truck trips (maximum) per day) . The Safety Services
staff have closely reviewed the proposal in conjunction with their
fire safety consultant and are satisfied that the design;
safeguards and method of operation of the bulk storage tanks� is
satisfactory.
There may be some businesses who would seek permission to add bulk
fuel storage as a result of the amendment. (Staff was approached
about a large propane dispensing facility two to three years ago
which did not prbceed to the application stage) . The safety and
appropriateness of any such applications would be judged on a case-
by-case basis .
ENVIRONMENTAL REVIEW
Staff has reviewed the prior environmental initial study and
Negative Declaration with mitigation measures adopted on November
28, 1989 with the approval of the specific plan amendment and
conditional use permit. It is recommended that the City Council
find that previously adopted Negative Declaration with mitigation
measures is still applicable based on the previous environmental
initial study with addendum.

Public notice was published in the Poway News Chieftain and mailed
to 9 property owners in the project area.

The specific plan amendment and modification of the conditional use
permit are appropriate actions based on findings in the attached
the resolutions.
REC.`OMI+lENDATION
It is recommended that the C1ty Council find that the previously
adopted Negative Declaration with mitigation measures for this use
at the same location is adequate and approve South Poway Specific
Plan (SPA 84-01T) and Conditional Use Permit 89-09M subject to the
conditions contained in the attached proposed resolution.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING AN AMENDMENT TO THE SOUTH
POWAY SPECIFIC PLAN (SPA 84-01T)
WHEREAS, the City Council periodically finds it necessary to
amend the South Poway Specific Plan; and
WHEREAS, on July 30, 1985 the City Council adopted a
resolution approving the South Poway Planned Community (SPPC)
Development Plan, and said plan has been prepared and adopted as
a Specific Plan, and provides for the systematic implementation
of the Poway General Plan; and
WHEREAS, Ordinance No. 239 established Specific Plan
regulations including implementation procedures; and
WHEREAS, on July 26 , 1988, the City Council adopted a
resolution revising the amendment process for the South Poway
Planned Community Development Plan to utilize the Specific Plan
Amendment �procedures for the City of Poway (Chapter 17 . 47 Zoning
Development Code) ; and
WFiEREAS, in accordance with Section 17 .47 .020 .B, the
proposed amendment to the Specific Plan was requested and
initiated by Resolution No. 91-134 adopted November 26 , 1991 by
the City Council; and
WHEREAS, the City proposes to allow bulk oil/fuel storage �
tanks by conditional use permit.
WHEREAS, the City of Poway held a properly noticed public
hearing in accordance with the California Government Code and the
California Environmental Quality Act to consider the amendment;
and
wHEREAS, the City Council finds that the previously adopted
Negative Declaration with mitigation measures based on the
Environmental Initial Study, with addendum, adequately addresses
the environmental issues associated with the amendment.
NOW, THEREFORE, be it resolved that the City Council does
hereby amend the South Poway Specific Plan as follows :

amended to read as follows with underlining to indicate
additions and strikeout to indicate deletions to the text:

WHEREAS, Conditional Use Permit 89-09M, Pennzoil Products
Company, applicant, was submitted for consideration of installing
bulk oil storage tanks in a 10,400 square foot portion of Building
4 on Lot 35, 12215 Kirkham Road, Suite 100, northeast corner of
Kirkham Road and South Poway Parkway in the LI (Light Industrial)
land use designation; and
WHEREAS, on May 5 , 1992, the City Council held a hearing on
the above-referenced item.
NOW, THEREFORE, the City Council does hereby resolve as
follows :
Section i. Environmental Findinqs :
The City Council finds that the previously adopted Negative
Declaration with mitigation measures based on the
Environmental Initial Study, with addendum, is adequate for
this modification of the prior conditional use permit.
Section I2 . Findinqs
1 . That the location, size, design, and operating
characteristics of the use will be compatible with and
will not adversely affect or be materially detrimental to
adjacent uses, buildings, structures, or natural
resources . The facility has operated at this location
since March 1989 in a manner compatible with surrounding
businesses.
2 . That the scale, bulk, coverage, and intensity is
consistent with adjacent uses, and that all development
standards of the South Poway Planned Community will be
met. The project will meet the applicable development
standards for an existing building within the business
park for street parking and mode of operation.
3 . That there are available public facilities , services and
utilities to serve the proposed use as all facilities and
services can be provided for through conditions of
approval.
4 . That there will not be harmful effects upon desirable
neighborhood characteristics , in that required conditions
of approval for handling hazardous materials in the event
of a spill will protect adjacent businesses from adverse
impacts.

5. That the generation of traffic will not adversely impact
the surrounding streets and/or the City' s Transportation
Element in that tratfic generated from the use will be
reduced from the present estimate of 50 trips per day
maximum by delivery trucks plus employees through the
change to bulk oil storage tanks and delivery of oil
products. to customers by tank trucks .
6 . That the site is suitable for the type and intensity of
use and development proposed in that the use is within a
portion of an existing building that meets the
development standards for the South Poway Specific Plan.
7 . That there will not be significant harmful effects upon
the environmental quality and, natural resources .
8 . That there are no other relevant negative impacts of the
proposed use that cannot be mitigated.
9 . That the impacts, as described above, in the location of
the proposed use will not adversely affect the City of
- Poway General Plan for future as well as present
development.
III . City Council Decision:
The City Council hereby approves Conditional Use Permit 89-09
M subject to the following conditions:
i . within 30 days of approval: ( 1 ) The applicant shall
submit in writing that all conditions of approval have
been read and understood; and (2 ) the property owner
shall execute a Covenant on Real Property.
2. Applicant shall comply with all conditions of Resolution
No. P-89-142 .

and distribution of petroleum products poses potentiai hazards to workers and
others in the vicinity; however, since the containers are not filled on the
premises and the Spill Containment Plan is required as a condition, the
likelihood of a major release of hazardous substances is minimized.
Mitigation Measures:
1. A Spill Containment Plan is to be approved by the Safety Services Department
for the use.
2. Floor drains or area drains and materiat starage area are to be sepa�ate
from storm drain or sewer systems.
3. Transportation of hazardous materials to be limited to certain roads in �the
business park as determined by the Department of Public Services.
4. Comply with provisions of Assembly Biil 3205 relative to the handiing of
hazardous materials and implement the Spilt Prevention Control and
Caunter Measure Plan as submitted.
III. DETERMINATION
On the basis of this initiai evaluation:

9. Transportation , a, c. The revised mode of operation utilizing
bulk oil storage tanks to replace most of the 55 gallon drums
will reduce the estimated 50 vehicular trips per day by four
delivery trucks and ten employees by up to 30 to 40 trips per
day. The 8 ,000 gallon tank trucks will deliver larger
quantities of oil products to the customers eliminating more
frequent deliveries by smaller delivery vehicles.
11 . Health , Safety, Nuisance Factors, a, b, c. The installation
of four bulk oil tanks, each with a capacity of 6700 gallons,
will improve tha safety of the oparation through elimination
of handling numerous 55 yal.lon drums. The prior mitigation

2. That the scale, bulk, coverage, and intensity is consistent with adja-
cent uses, and that all development standards of the South Paway
Planned Cortmunity are or will be met. Project will meet the applicable
development standards for an existing building within the business park
for street parking and mode of operation.
3. That there are available pubiic facilities, services and utilities to
serve the proposed use as all facilities and services can be provided for
through conditions of approvai . In addition, the fenced storage area
will be removed which currently 9nterferes with maintenance of the
public sewer and storm drain easement.
4. That there will not be a harmful effect upon desirabie neighborhood
' characteristics, in that the required conditions of approvai for
handling hazardous materials in the event of a spill will protect the

5. That the generation af traffic will not adversely 9mpact the
surrounding streets and/or the C1ty's Circutation Element in that traf-
fic generated from the use is less than 50 trips per day by delivery
trucks plus employees and traffic mitigation fees were paid with the
construction of the building.
6. That the site is suitable for the type and intensity of use and devel-
opment proposed in that the use is within a portion of an existing
building that meets the development standards for the South Poway
Specific Plan.
7. That there will not be significant harmful efPects upon the environ-
mental quality and natural resources.
8. That there are no other relevant negative impacts of the proposed use
that cannat be mitigated.
9. That the impacts, as described above, in the tocation of the proposed
use will not adversely affect the City of Poway General Plan for future
as well as present development.
� III. City Council Decision:
The City Council hereby approves Conditionai Use Permit 89-09 subject to the
fotlowing conditions:
Within 30 days of approval : (1) The applicant shall submit in writing that
all conditions of approval have been read and understood; and (2) the pro-
perty owner shall execute a Covenant on Real Property.
APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE
WITH THE FOLLOWING CONOITIONS.
1. Applicant to comply with provisions of Assembly Bill 3205 relative to the
handling of hazardous materials. If necessary, applications are to be
completed and submitted to the Department of Health Services and Air
Pollution Control District.
2. The permit is subject to annual review beginning in March 1990 per Section
17.48.140 of the Zoning Development Cade.

Dear Chuck:
Following is a brief description of the intended utilization of
the bLlk plant that we plan to install at our facility in Poway,
CA. A sheet describing facility function is attached.
For the grades stored in bulk, the purpose of the bulk tankage
is to reduce deliveries to customers via ( 1) pumping' from 55
gallon drums which are stored in the warehouse and ( 2) 6,000
gallon tanktrucks making multiple stops to deliver relatively
small quantities.
The primary delivery vehicle will be a tankwagon designed to
make numerous deliveries supplemented by delivery vans carrying
portable tanks where the oil will be pumped directly into
customer tanks much as is currently being done from drums. Large
customers will continue to be delivered by 6 ,000 gallon
tanktrucks making a delivery on the way to replenish the bulk
tankage.
The tankwagon has triple the payload of the delivery vans which
will result in fewer bulk vehicles making deliveries. The
tankwagon is smaller than 6 ,000 gallon tanktrucks and will
reduce traffic congestion.
The tankwagon and portable tanks would be filled from the bulk
tanks . Nothing smaller than a 55 gallon drum would be filled and
these would be kept to a minimum in favor of the larger ( 335
gal. ) tanks which are designed to be refilled, transported and
pumped from.
The bulk tanks and the loading/unloading areas ( inside and
outside) will be protected by containment dikes with surface
coatings to prevent oil penetration of the concrete . All hose
connections use dry break ( leak proof ) fittings with drip pans
underneath. Storage, transporting, handling and disposal of 55
gallon drums will be greatly reduced.

FACILITY FUNCTION '
o Complete separation of motor oils.
- Common delivery system (meter and reel) okay for each family.
Delivery system will be cleared by displacing the product in
the system with the next product to be loaded. '
' o Segregated system for ATF.
o Complete evacuation or clearing of pump lines when changing from
one product line to another. �
o Metered bottom loading of tankwagon. Approximate bottom loading
rate of 80 GPM. .
o Metered bottom loading or top loading of delivery truck tanks or
any bulk portable container fitted with a 2" dry break adapter or
fill cover. Approximate bottom loading or top loading at 50 to
80 GPM. �
o Metered filling for 55 gallon drums from any given storage tank
or bulk lube container.
o Bulk transport unloading from contract carrier, common carrier or
Penn2oil tankwagon to storage 80 to 110 GPM. Unloading via
"house" pump or "truck" pump. Tanks will be filled from the
bottom.
o Bulk unloading of delivery trucks back into storage.
o Metered filling of bulk portable containers directly off
transport for a particular lube oil having no tank for storage.
