Tentative Tract Map 86-02R(2) American Newland Associates,
Applicant: A request for a 98 lot division of land to be known as
Poway Corporate Center on 165 acres located south of Kirkham Road
and South poway Parkway, west of "B" Street in the Pomerado
Business Park.
APN: 320-031-01, 320-021-03, and 317-280-07
It is recommended that the following changes be made to the Resolution of
Approva 1.
Page 7, Section Kirkham Road should be changed to read as follows:
Kirkham Road
Kirkham Road shall be fully improved to a width of 65 feet from the easterly
property boundary at Lot 49 to the existing eastern terminus of TM 85-04.
Between Lots 50 and 75, the south half of the roadway shall be built to
match that portion constructed with Phase II of TTM 85-04. The developer
shall provide reimbursement to CF poway for its pro rata share of the actual
costs, including interest at ten percent per annum computed from the time of
expenditure to time of reimbursement, of the surface improvements installed
by CF poway to the southerly one-half of Kirkham Road abutting developer'S

property and of such other supplemental improvements, if any, which benefit
the development. "Supplemental" for purposes of this paragraph means over-
sized beyond that which was required of CF Poway by the original Agency
Acquisition Agreement and exhibits thereto, street sheets, and TM 85-04 con-
ditions and exhibits. Payment of reimbursement shall be made immediately
after the later of (1) the improvement for which such reimbursement is made
is completed; or (2) the date that the City council approves the Final Map
for the first phase of TM 86-02R(2); "completed" for the purposes of this
paragraph means capable of being used for the purpose intended. In the
alternative, the requirement for reimbursement herein shall be deemed
satisfied upon written notice to the City by the developer and CF Poway that

2. The developer shall be entitled to water service from the Gregg Street
Reservoir. The developer shall provide reimbursement to CF Poway for its
pro-rata share of the actual costs including interest at ten percent per
annum computed from time of expenditure to time of reimbursement, of the
Gregg Street pump station and of the improvements to Gregg Street reservoir
installed by CF poway which are of supplemental size, capacity, number, or
length for the benefit of the developer's subdivision. "Supplemental" for
purposes of this paragraph means oversized beyond that which was required of
CF Poway by the original Agency Acquisition Agreement and exhibits thereto,
street Sheets, and TM 85-04 conditions and exhibits. Payment of reimburse-
ment shall be made immediately after the improvement for which such reim-
bursement is made is completed; "completed" for purposes of this paragraph
means capable of being used for the purpose intended. In the alternative,
the requirement for reimbursement herein shall be deemed satisfied upon
written notice to the City by the developer and CF poway that the developer
and CF Poway have entered into a written agreement providing for reimburse-
ment by the developer to CF Poway for the above-mentioned improvements,
subject to approval of the Agreement by the City and the poway Redevelopment
Agency.
