Res 18-058RESOLUTION NO. 18-058 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, AMENDING THE SWIM CENTER FEES WITHIN THE COMMUNITY SERVICES SECTION OF THE MASTER FEE SCHEDULE WHEREAS, California Government Code section 66016 et seq. establishes procedures for the adoption of fees for services by local government; WHEREAS, on May 4, 2010, the City Council adopted Resolution No. 10-017, adopting a Master Schedule of Fees, which includes fees for the Community Services Department; and WHEREAS, on April 15, 2014, the City Council adopted Resolution No. 14-019, amending the Community Services Section of the Master Fee Schedule effective April 15, 2014; WHEREAS, on February 16, 2016, the City Council adopted Resolution No. 16-002, amending the Poway Center for the Performing Arts fees within the Community Services Section of the Master Fee Schedule with fee changes taking effect on July 1, 2017, and subsequent fiscal years; WHEREAS, on October 18, 2016, the City Council adopted Resolution No. 16-050, amending the lake operations fees within the Community Services Section of the Master Fee Schedule; WHEREAS, on November 21, 2017, the City Council adopted Resolution No. 17-071, amending the facility rental fees within the Community Services Section of the Master Fee Schedule; WHEREAS, on December 5, 2017, the City Council adopted Resolution No. 17-077, amending the program fees within the Community Services Section of the Master Fee Schedule; WHEREAS, certain Community Services fees are no longer applicable; WHEREAS, it is recommended that certain Community Services program fees be amended to reflect changes in operation and facility use; and WHEREAS, it is necessary to amend the Community Services Section of the Master Fee Schedule to improve cost recovery of certain programs. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: The City Council finds that this amendment to the Master Fee Schedule is exempt from the requirements of CEQA pursuant to CEQA Guidelines Section 15273 (a) (1). Section 2: Those Community Services swim center fees presented at this meeting, and set forth in Exhibit 1 to this Resolution, are hereby approved and adopted, and shall be effective immediately, with the exception of those fees denoted by the double asterisk, which shall become effective January 1, 2019. Resolution No. 18-058 Page 2 Section 3: Effective immediately, certain fees in the Community Services section of the City's Master Fee Schedule are deleted and replaced with those presented at this meeting and set forth in Exhibit 1 to this Resolution, without including the language deleted by strikeout and without including underscoring where it is solely used to reflect new text added by this Resolution, as if set forth in the Master Fee Schedule in full, therein. Section 4: As indicated in the Master Fee Schedule, Community Services swim center fees shall be reviewed every 3 years, beginning in 2021, and updated in accordance with the Consumer Price Index — All Urban Consumers, San Diego, as published by the United States Bureau of Labor Statistics, subject to rounding to the nearest whole dollar, effective July 1, 2021, as indicated, and each third year thereafter.
