A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, AMENDING THE MASTER FEE
SCHEDULE FOR ACCESSORY DWELLING UNITS AND
ADMINISTRATIVE USE PERMITS
WHEREAS, California Government Code Section 66016, et. seq., establishes procedures
for the adoption of fees for services provided by local government;
WHEREAS, the City Council finds it necessary to recover the full costs for City services;
WHEREAS, the City Council may find it necessary or desirable to amend the City's Master
Fee Schedule from time to time, as authorized by the California Government Code;
WHEREAS, the State legislature adopted SB 1069 and AB 2299 to address regulations
applicable to accessory dwelling units including the collection of development impact fees;
WHEREAS, on October 2, 2018, the City Council adopted Ordinance No. 820 amending
the Poway Municipal Code to incorporate revised regulations for accessory dwelling units which
includes a 50 percent reduction in development impact fees applicable to accessory dwelling
units;
WHEREAS, on December 19, 2017, the City Council adopted Ordinance No. 813
approving a comprehensive amendment to the Poway Road Specific Plan which included the
creation of a new permit called Administrative Use Permit;
WHEREAS, the proposed fee for the Administrative Use Permit does not exceed the
reasonable costs of processing the permit; and
WHEREAS, on November 7, 2018, the City Council held a duly advertised public hearing
to solicit comments from the public, both for and against, relative to amending the Master Fee
Schedule.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1: The foregoing recitals are true and correct, and the City Council so finds
and determines.
Section 2: This item is not subject to review under the California Environmental
Quality Act (CEQA), pursuant to the provisions of Section 15273(a) of the State CEQA Guidelines.
Section 3: The revised sections of the Master Fee Schedule, Development Services,
as shown in Exhibit A are hereby adopted, and hereby supersede any previously established fee
for the identified City services.
Section 4: The fees and valuation rates shown in Exhibit A shall become effective 60
days after the adoption date.
