CONSENT CALENDAR Motioned by Councilmember Mullin, seconded by Councilmember Leonard to approve Consent Calendar Items 1.1 through 1.9. Motion carried by the following roll -call vote: Ayes: Mullin, Leonard, Frank, Grosch, Vaus Noes: None Absent: None 1.1 Approval of Reading by Title only and Waiver of Reading in full of Ordinances on Agenda 1.2 Ratification of Warrant Registers for the Periods of June 24, 2019 through June 28, 2019; and July 1, 2019 through July 5, 2019 1.3 Approval of the June 18, 2019 Regular City Council Meeting Minutes 1.4 Second Reading and Adoption of Ordinance No. 829 entitled, "An Ordinance of the City Council of the City of Poway, California, Adding Chapter 17.56 to the Poway Municipal Code Regulating Wireless Communication Facilities." Mr. John Osborne with AT&T requested a revision to the Ordinance due to a conflict with Federal and State Law. In response to Mr. Osborne's comment, Rutan and Tucker Partner Joseph Larsen recommended proceeding with the adoption of the Ordinance as the primary concerns of various wireless carriers had been addressed, and confirmed the language is compliant with State and Federal Law. 1.5 Adoption of Resolution No. 19-045 entitled, "A Resolution of the City Council of the City of Poway, California, Authorizing the Submittal of an Application to the San Diego County Office of Emergency Services for Funds through the 2019 State Homeland Security Grant Program." 1.6 Adoption of Resolution No. 19-046 entitled, "A Resolution of the City Council of the City of Poway, California, Approving the Five -Year Update to the Sewer System Management Plan." 1.7 Approval of Agreement with the County of San Diego for Library Services 1.8 Approval of Agreement with DBI Services for the 2019 Vegetation Management Services 1.9 Award of Contract to Hunter General Engineering, Inc. for the City Hall Hydronic Piping Replacement Project; Bid No. 19-024 2. ORDINANCE 2.1 First Reading of an Ordinance entitled, "An Ordinance of the City of Poway, California, Rescinding Chapter 2.30 of the Poway Municipal Code (Municipal Election Petition Circulation)." Rutan and Tucker Partner Joseph Larsen presented the report. Mr. Larsen stated that in the review of the Poway Municipal Code by the City Attorney, it was discovered that chapter 2.30 is unenforceable by law and currently not being enforced. 0686 City of Poway — Minutes — August 6, 2019 No speakers. Motioned by Mayor Vaus, seconded by Deputy Mayor Grosch to introduce Ordinance No. 830 entitled "An Ordinance of the City of Poway, California, Rescinding Chapter 2.30 of the Poway Municipal Code (Municipal Election Petition Circulation)," and schedule adoption of the Ordinance for August 20, 2019. Motion carried unanimously by the following roll -call vote: Ayes: Mullin, Leonard, Frank, Grosch, Vaus Noes: None Absent: None 3. PUBLIC HEARINGS 3.1 Resolution Adopting the Report on the City's Water Quality Relative to Public Health Goals Mayor opened the public hearing at 7:12 p.m. Assistant Director of Public Works Rudy Guzman presented the report along with a presentation to discuss the detection of any contaminants above the state Public Health Goals and the federal Maximum Contaminant Level Goals. Speaker neutral to staff's recommendation: Shawn Hodgetts In response to the speaker's inquiry, Mr. Guzman stated that there are required measures that need to be taken for any Maximum Contaminant Levels that are exceeded. Motioned by Deputy Mayor Grosch, seconded by Councilmember Frank to close the public hearing at 7:23 p.m. Motion carried unanimously. Council discussion ensued in support of the adoption of the Resolution. Motioned by Councilmember Leonard, seconded by Deputy Mayor Grosch to adopt Resolution No. 19-047 entitled "A Resolution of the City Council of the City of Poway, California, Adopting the Report on the City's Water Quality Relative to Public Health Goals." Motion carried unanimously. 3.2 Resolution Renewing the Fire Protection Special Tax to be Collected on the Property Tax Rolls for Fiscal Year 2019-20 Mayor opened the public hearing at 7:27 p.m. Director of Finance Aaron Beanan presented the report and stated that the resolution is to renew the City's Fire Protection Special Tax for fiscal year 2019-2020. The citywide special tax is to help support fire protection services. No speakers. Motioned by Deputy Mayor Grosch, seconded by Councilmember Leonard to close the public hearing at 7:28 p.m. Motion carried unanimously. 0687 City of Poway — Minutes — August 6, 2019 Motioned by Mayor Vaus, seconded by Councilmember Mullin to adopt Resolution No. 19-048 entitled "A Resolution of the City Council of the City of Poway, California, Renewing the Fire Protection Special Tax to be Collected on the Property Tax Rolls for Fiscal Year 2019-20." Motion carried unanimously. 4. STAFF REPORT 4.1 Adoption of a Resolution Approving Time Restricted No Parking on the East Side of La Manda Drive Between 15221 and 15259 La Manda Drive and Extending the No Parking Zone on the West Side of La Manda Drive from 150 feet South of Hilltop Circle North to Hilltop Circle South City Engineer Tom Frank presented the report along with a slideshow presentation. Mr. Frank explained that a petition was received in April, requesting a change in parking on the east side of La Manda Drive to "No Parking on school days from 7 a.m. to 4 p.m." Speakers in support of staff's recommendation: Steve Stachwick Speakers in opposition of staff's recommendation: Shawn Hodgetts, Fred Hess, Sophie A. Bartlett, Maurice Papier 11 and Gail Papier In response to Council inquiry, Development Services Director Bob Manis explained that the application received to make the parking change in 2017 was rejected since the subdivision was still under construction. In response to Council inquiry, Captain Duckworth stated that there is more traffic enforcement at the beginning of the school year, in addition, if residents call to report incidents, Sheriff's Deputies will also respond. In response to Council inquiry, Mr. Manis stated that Poway does not have resident only or a permit parking program at this time. Mr. Manis explained, that the most similar regulation to permit parking that the City has, are restricted time parking and staff isn't aware of any parking enforcement issues at this time. Deputy Mayor Grosch expressed concern due to the number of residents that signed the petition against the change in parking. He believes that a good compromise would be permit parking, for residents only. Motioned by Mayor Vaus, seconded by Councilmember Frank to adopt Resolution No. 19-049 entitled "A Resolution of the City Council of the City of Poway, California, Approving Time Restricted No Parking on the East Side of La Manda Drive between 15221 and 15259 La Manda Drive and extending the No Parking Zone on the West Side of La Manda Drive from 150 Feet South of Hilltop Circle North to Hilltop Circle South," and staff to return in six months with a report regarding the new parking. Motion carried 4/1, with Deputy Mayor Grosch voting no. 5. WORKSHOP 5.1 Landscape Maintenance District Workshop Assistant Director of Public Works Eric Heidemann presented the report along with a slideshow presentation. He stated that the Landscape Maintenance District Advisory Group 0688 City of Poway — Minutes — August 6, 2019 determined that the Landscape Maintenance Districts are only financially sustainable with a successful re -ballot. Mr. Heidemann explained that in order to obtain a successful re -ballot, funding for a conceptual landscape plan as a communication tool with the neighborhoods within the district is recommended. If funding is provided, he anticipates a re -ballot effort in 2020. Speaker neutral to staff's recommendation: Pete Babich Speakers in support of staffs recommendation: Timothy Jara and Toni Bates In response to Council inquiry, Mr. Heidemann confirmed that funds in the amount of $500,000 will come from the City's management reserves in order to receive a $2 million Hazard Mitigation Grant from the California Office of Emergency Service and Federal Emergency Management Agency for Fuel Load Modification. Council discussion ensued in support of the preferred option. Motioned by Mayor Vaus, seconded by Deputy Mayor Grosch to adopt Resolution No. 19-050 entitled "A Resolution of the City Council of the City of Poway, California, Approving a Task Order to the As -Needed Landscape Architectural Design Services Agreement with KTUA for Landscape Master Plan Services in the Not -To -Exceed Amount of $86,525, and authorizing the City Manager, or Designee to Execute the Necessary Documents." Motion carried unanimously. 6. MAYOR AND CITY COUNCIL -INITIATED ITEMS The Mayor and Council made announcements and reported on various events taking place in the City. No action was taken. All of the Councilmembers thanked outgoing Director of Public Works Michael Obermiller for his service. Councilmember Frank mentioned that she attended the Poway Fire Fighters Foundation Pancake breakfast. Deputy Mayor Grosch announced that on August 31st there will be volunteers cleaning up the landscape located off of Twin Peaks Road and invited the public to attend. On October 5th the Third Annual Fishing and Bar-B-Que Event for Young Adults with Special Needs will be held. Mayor Vaus stated that SANDAG will soon be resolving the Regional Housing Needs Assessment. He also stated that on September 13th there will potentially be a vote to re -allocate TransNet dollars for some of the new proposed projects.
