An Ordinance Adopting the 2019 Engineering and Traffic Survey Mayor opened the public hearing at 7:10 p.m. City Engineer Melody Rocco presented the report. Ms. Rocco explained that new speed data was collected December 2019 to update the engineering and traffic survey to comply with California Vehicle Code requirements for enforcement. St. Bartholomew Environmental Assessment, Conditional Use Permit 18-019, Development Review 18-008, and Variance 19-001, a request to expand St. Bartholomew' s Episcopal Church Parish Community Center and Preschool at 16275 Pomerado Road Mayor opened the public hearing at 7:15 p.m. City Planner Dave De Vries presented the report along with a slideshow presentation. Mr. De Vries discussed the proposed phased expansion that includes demolishing the existing parish hall, establishing a new parking lot area, expanding the existing preschool playground area, constructing a new parish center community center and increasing the maximum number of preschool students from 82 to 154. Mark Davis, Project Manager and Chair of St. Bartholomew's Architectural Committee, via teleconference, gave a brief overview of the project. In response to Council inquiry, Mr. Davis explained that the project will be phased to avoid disruption in services. No speakers. La Manda Drive Parking Status 5 of 8 May 5, 2020, Item #1 City of Poway -Minutes -April 7, 2020 City Engineer Melody Rocco presented the parking update, as requested by City Council, regarding the time restricted No Parking zones established on La Manda Drive at the August 6, 2019 City Council meeting. Ms. Rocco explained that the Sheriff's Department has not had any enforcement issues in the neighborhood and that staff has not been contacted regarding the parking changes since they were completed. She added that staff recommends keeping the parking as established. She further added that staff received correspondence from three area residents indicating support of the time restricted No Parking zone. No speakers. City Council received and filed the report. No action was taken. 8. A Resolution Approving Midblock Crosswalks on Kirkham Way west of General Atomics Way and on Stowe Drive Between Scripps Poway Parkway and Kirkham Way City Engineer Melody Rocco presented the report along with a slideshow presentation. Ms. Rocco explained that the crosswalks will facilitate pedestrian connectivity between the existing General Atomics facilities located on both sides of Kirkham Way and Stowe Drive. Ms. Rocco further explained that the requested crosswalks are appropriate with the recommended improvements. She added that the Traffic Safety Committee unanimously voted to support staff's recommendation. No speakers. Resolution Authorizing the Purchase of Real Property on Twin Peaks Mountain for Open Space (APN #s 314-031-02-00 and 314-032-03-00) Director of Development Services Bob Manis presented the report along with a slideshow presentation. Mr. Manis explained that the City was offered two undeveloped parcels located on the southwestern slope of Twin Peaks Mountain to preserve as open space. Mr. Manis further explained that the acquisition was discussed by the City Council in closed session on August 20, 2019 and direction was given to staff to negotiate the terms of the acquisition. He concluded that the purchase price is $460,560 for the 80 acres and that sufficient funds are available in the City's Habitat In-Lieu Fee Fund. No speakers. Council discussion ensued in support of acquiring additional open space and acknowledged City's recent open space preservation efforts. Moratorium on Commercial Evictions Mayor Vaus presented the item for Council consideration to suspend commercial evictions until May 31, 2020 to offer some protection and assistance to local businesses who suffer a loss of income or increase in expenses related to COVID-19. Mayor Vaus concluded that if Council is in concurrence, he recommends adopting an urgency ordinance that will go into effect immediately. No speakers. Council discussion ensued in support of protecting local businesses and adopting a moratorium on commercial evictions. Motioned by Mayor Vaus, seconded by Councilmember Grosch to adopt Ordinance No. 840 entitled "An Ordinance of the City Council of the City of Poway, California, enacted pursuant to California Government Code Sections 8634, 36934, and 36937, temporarily prohibiting the eviction of any commercial tenant who suffers a substantial loss of income or substantial increase in expense related to COVID-19." Motion carried 4/0/1, with Deputy Mayor Frank absent. 11. Small Business Bridge Loan Program Mayor Vaus presented the item for Council consideration. Mayor Vaus discussed creating a loan program titled Poway Emergency Assistance Recovery Loans (PEARL) to provide a financial bridge for small businesses to survive the current Coronavirus pandemic. Mayor Vaus requested Council's input to provide direction to staff regarding the program. Ed Franklin, representing the Poway Chamber of Commerce, via teleconference, expressed supporting small businesses affected by COV/0-19. Council discussion ensued regarding program criteria and program considerations for small business loans that included business size, business history, repayment options, eligibility requirements, interest rate, maximum amount of funding for the program, and protection and guarantees for the City. Council directed staff to bring back to Council a proposed Poway Emergency Assistance Recovery Loan Program for small businesses that 1) are independently owned and have under 50 employees; 2) have a current business certificate with the City for at least one year; 3) are not behind on rent or mortgage payments as of March 7 of 8 May 5, 2020, Item #1 City of Poway-Minutes -April 7, 2020 1, 2020; and 4) have no outstanding code violations. Council directed staff to allow a maximum of $50,000 loan per business with a total funding cap of 2 million for the program available on a first come first serve basis. The program should include 1) no interest for the first 90 days; 2) a three percent interest rate; 3) three-year repayment plan options; and 4) a promissory note and personal guarantee. The portfolio report includes all investments while the investment report includes only those investments managed by Insight Investment. All City funds, including the General Fund, Water Fund, Wastewater Fund and others -except those identified in Attachment D, are pooled and invested, with earned interest allocated quarterly based on the average daily cash balance in each fund. The funds on deposit at LAIF and CalTRUST earn interest at variable rates. The interest rate for the month ending March 31, 2020, is estimated at 1.79% for LAIF, 1.68% for the CalTRUST short-term fund, and 1.83% for the CalTRUST medium-term fund. The values of fixed income securities, as legal investment tools authorized under California government codes, are closely tied with interest rates. As interest rates go up, the market values of the securities go down, and vice versa. This is known as interest rate risk or market risk. A portfolio's duration is a common measurement of interest rate risk. Due to anticipated actions of the Federal Reserve, the Finance Department, in conjunction with Insight Investment, has been increasing the duration of the externally managed investment portfolio since July 2019 by investing in longer-term investments (e.g. treasuries and corporate notes). This strategy will help preserve the City's interest earning ability in an environment of declining interest rates as well as help increase market value. In response to the COVID-19 pandemic, the Federal Reserve lowered the target federal funds rate by 50 basis points on March 3, 2020 and 100 basis points on March 16, 2020. The target federal funds rate is currently between 0.00% and 0.25%. For fixed income securities, the difference between amortized cost and fair value is considered an unrealized gain or loss. A realized loss is when the principal of the security is redeemed before its maturity date at a fair value lower than its amortized cost value. The amortized cost value of the externally managed investment portfolio is $78,622,902; the fair value is $80,261,054 for an unrealized gain of $1,638,152 or 2.08% of the total amortized cost value. The source of the fair value information for the U.S. Treasury Notes, the U.S. Instrumentalities, Corporate Notes, and Municipal Bonds is Interactive Data Corporation. Also included with this report are recaps of the City's cash and investments held by fiscal agents, non- managed investments, and cash on hand. The total book value of the cash and investments held by our fiscal agent, U.S. Bank, at March 31, 2020, was $468,840. The source of the market value information for these investments was U.S. Bank. The total book value of the non-managed investments was $176,027 at March 31, 2020. The City's cash on hand at March 31, 2020, totaled $1, 172,802. The March 31, 2020 balance of the City's Library Trust Fund was $259,712. Through the Fiscal Year 2019-20 period ending March 31, 2020, no transfer of interest earnings has been made to the General Fund. CITY OF POWAY Economic Indicators and Monetary Policy The coronavirus crisis took hold in March and the US saw more cases than any other country at almost 190,000. A number of states enforced 'lockdown' measures, closing businesses such as bars and restaurants, schools and banning other public gatherings. Global sporting events were cancelled, as was travel between the US and Europe and the US and Canada. US jobless claims surged to an unprecedented 3m (Chart 1) US equities entered the sharpest bear market ever, twice delivering record low daily returns outside Black Tuesday 1929 and Black Monday 1987. Selling to meet margin calls and corporations drawing down revolving credit facilities created a liquidity crisis. The Federal Reserve (Fed) enacted an emergency S0bp rate cut early in the month, and later followed with a 1 00bp cut, bringing the fed funds rate to a range of 0 -.25%. To address the liquidity crisis, the Fed announced $3.Strn of repo market operations in March alone and lowered its discount rate for member banks by S0bp. The Fed also reintroduced quantitative easing (QE), initially at $700bn, but then later amended to an unlimited program. During a single week, the Fed purchased over $600bn of Treasuries and agency MBS, larger than the entire 201 0 'QE2' program. The Fed also brought back the 2008-era Term Asset-Backed Securities Loan Facility (TALF) and announced two new programs for purchasing corporate debt. (Chart 2) This was followed by a $2trn fiscal stimulus package including direct one-time payments to individuals, $500bn of funding to the economy, $350bn of loans to small businesses (forgivable if workers are retained) and $1 S0bn in hospital aid. Interest Rate Summary Yields fell dramatically during the month. At one point the entire yield curve yielded less than 1 %. Longer-dated yields later retraced, particularly when liquidity concerns abated within the longer-dated Treasury market. Recommended Action: It is recommended that the City Council award the contract for the Water Valve Replacement Project to Piperin Corp., the lowest responsible and responsive bidder, in the amount of $273,000.00. Discussion: This project was first advertised on December 5 and 12, 2019. Nine bids were received and opened on January 12, 2020. All bids received exceeded the available project budget. On February 18, 2020, the City Council adopted Resolution No. 20-007 rejecting all bids and directing staff to re-advertise the project with a revised scope of work. Eight valve locations were eliminated from the project scope leaving a total of twelve locations. Of the remaining valve locations, four were identified as deductive alternates. The contract time for this project is 60 working days with an Engineer's Estimate of $275,000. Bids were opened on April 8, 2020. The lowest bid was determined by starting with the base bid, then subtracting each deductive alternate amount (in order, one by one) from the base bid, until one bid was less than or equal to $275,000. This process was publicly disclosed by the City before the first bid was opened. It is, therefore, agreed that Contractor will pay as liquidated damages to the City the following sum: Five Hundred Dollars ($500) per Calendar Day, for each and every Calendar Days delay in finishing the Work in excess of the number of Working Days prescribed above. If liquidated damages are not paid, as assessed by the City, the City may deduct the amount thereof from any money due or that may become due the Contractor under this Contract in addition to any other remedy available to City. By executing this Contract, Contractor agrees that the amount of liquidated damages is reasonable and shall not constitute a penalty. In accordance with State of California Senate Bill No. 854, Contractor will maintain and will require all subcontractors to maintain valid and current Department of Industrial Relations (DIR) Public Works Contractor registration during the term of this project. Contractor shall notify the City in writing immediately, and in no case more than twenty-four (24) hours, after receiving any information that Contractor's or any of its Subcontractor's DIR registration status has been suspended, revoked, expired, or otherwise changed. Contractor will pay, and will require all subcontractors to pay, all employees on said Contract a salary or wage at least equal to the prevailing salary or wage established for such work as set forth in the wage determinations and wage standards applicable to this work, a copy of which is on file in the office of the City Clerk of the City of Poway. Federal prevailing wage rates apply for federally funded projects. Travel and subsistence pay shall be paid in accordance with Labor Code § 1773.1. Contractor shall be subject to the penalties in accordance with Labor Code of §1775 for each worker paid (either by him or by any subcontractors under him) less than the prevailing rate described above on the work provided for in this Contract. Contractor and subcontractors shall comply with Labor Code§ 1810 and § 1811 which stipulates that eight hours labor constitutes a legal day's work, and § 1812 which stipulates that the Contractor and subcontractors shall keep an accurate record showing the name of and actual hours worked each calendar day and each calendar week by each worker employed by him in connection with the work 2 4 of 11 May 5, 2020, Item #3 performed under the terms of the Contract. Contractor agrees to monitor and review allsuch coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this Section. f.In the event this Agreement is terminated for any reason prior to the completion of all obligations and requirements of this Agreement, Contractor agreesto maintain all coverages required herein until the City provides written authorizationto terminate the coverages following the City's review and determination that all liability posed under this Agreement as to the party providing insurance has been eliminated. g.Contractor agrees and acknowledges that if it fails to obtain all of the insurance required in this Agreement in accordance with the requirements herein, orto obtain and ensure that the coverage required herein is maintained by any subcontractors or others involved in any way with the Project, Contractor shall be responsible for any losses, claims, suits, damages, defense obligations, or liability of any kind or nature attributable to the City, and/or its officers, employees, servants, volunteers, agents and independent contractors, that result from such failure by Contractor. 4 6 of 11 May 5, 2020, Item #3 16.a. Contractor shall provide certificates of insurance with original endorsements to the City as evidence of the insurance coverage required herein. Certificates of such insurance shall be filed with the City on or before commencement ofperformance of this Agreement. Current certification of insurance shall be kept on file with the City at all times until completion of performance and acceptance by the City. b.Notwithstanding any inconsistent statement in any required insurance policiesor any subsequent endorsements attached thereto, the commercial general liabilityand commercial vehicle liability policies shall bear endorsements whereby it is provided that the City, and its officers, employees, servants, volunteers, agents and independent contractors are named as additional insureds. Additional insureds shall be entitled to the full benefit of all insurance policies in the same manner and to thesame extent as any other insureds and there shall be no limitation to the benefitsconferred upon them other than policy limits to coverages. c.Contractor shall require the carriers of all required insurance policies to waive all rights of subrogation against the City, and its officers, employees, servants, volunteers, agents and independent contractors. d.Each policy required herein must be endorsed to provide that the policy shallnot be cancelled in coverage or limits (except by paid claims) unless the insurer has provided the City with 30 days prior written notice of cancellation. Contractor agrees to provide the City with 30 days written notice prior to any non-renewal or reductionin coverage or limits. e.All insurance policies required to be provided by Contractor or any other party must be endorsed to provide that the policies shall apply on a primary and noncontributing basis in relation to any insurance or self-insurance, primary orexcess, maintained or available to the City, and its officers, employees, servants, volunteers, agents and independent contractors. 17.a. Contractor shall defend, indemnify and hold harmless the City, its officers, officials, agents, employees and volunteers from and against any and all claims, demands, actions, losses, damage, injuries, and liability, direct or indirect (includingany and all costs and expenses in connection therewith) to the extent actually caused by the negligence of Contractor, Contractor's employees, subcontractors orindependent contractors except for any such claim arising out of the negligence or willful misconduct of the City, or its officers, agents, employees or volunteers. b.The City does not, and shall not, waive any rights that it may have against Contractor under this Section because of the acceptance by the City, or the depositwith the City, of any insurance policy or certificate required pursuant to this Agreement. The hold harmless, indemnification and duty to defend provisions of this Section shall apply regardless of whether or not said insurance policies are determined to be applicable to the claim, demand, action, damage, liability, loss, cost or expense described herein. 5 7 of 11 May 5, 2020, Item #3 18.Any amendments to any of the Contract Documents, including but not limited to Contract Change Orders, must be in writing executed by the Contractor and the City. Any time an approval, time extension, or consent of the City is required under the Contract Documents, such approval, extension, or consent must be in writing inorder to be effective. 19.The Contract Documents contain all of the agreements and understandings of the parties and all previous understandings, negotiations, and contracts are integrated into and superseded by this Contract. 20.In the event that any one or more of the phrases, sentences, clauses, paragraphs,or sections contained in this Contract shall be declared invalid or unenforceable by a valid judgment or decree of a court of competent jurisdiction, such invalidity or unenforceability shall not affect any of the remaining phrases, sentences, clauses, paragraphs, or sections of this Contract which are hereby declared as severable and shall be interpreted to carry out the intent of the parties hereunder. 21.The persons executing this Contract on behalf of the parties hereto warrant that they are duly authorized to execute this Contract on behalf of said parties and that, by so executing this Contract, the parties hereto are formally bound to the provisions of this Contract. 22.This Contract shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, personal representatives, successors, and assigns. 23. 24. 25. 26. In performing its obligations and duties under this Contract, each party shall complywith all applicable local, state, and federal laws, regulations, rules, standards and ordinances. This Contract may be executed by the parties in counterparts, which counterparts shall be construed together and have the same effect as if all of the parties hadexecuted the same instrument. After completion of the work contemplated by this Contract, Contractor shall file with the City Manager an affidavit stating that all workers and persons employed, all firms supplying materials, and all subcontractors upon the project have been paid in full, and that there are no claims outstanding against the project for either labor or materials, except certain items, if any, to be set forth in an affidavit coveringdisputed claims or items in connection with a Stop Notice that has been filed under the provision of the laws of the State of California. All work shall be subject to inspection and testing by City and its authorized representatives during manufacture and construction and all other times and places, including, without limitation, the plans of Contractor and any of its suppliers.Contractor shall provide all reasonable facilities and assistance for the safety andconvenience of inspectors. All inspections and tests shall be performed in such manner as to not unduly delay the work. The Work shall be subject to final inspection and acceptance notwithstanding any payments or other prior inspections. 6 8 of 11 May 5, 2020, Item #3 Such final inspection shall be made within a reasonable time after completion of the work. 27.Whenever Contractor has knowledge that any actual or potential labor dispute isdelaying or threatens to delay the timely performance of the Contract, Contractor shall immediately give notice thereof, including all relevant information with respect thereto, to City. 28.Contractor agrees to contact the appropriate regional notification center in accordance with Government Code Section 4216.2. 29.Contractor shall submit its detailed plan for worker protection during the excavation of trenches required by the scope of the work in accordance with Labor Code Section 6705. 30.a. Contractor shall, without disturbing the condition, notify City, in writing, as soon as Contractor, or any of Contractor's subcontractors, agents, or employeeshave knowledge and reporting is possible, of the discovery of any of the following conditions: i.The presence of any material that Contractor believes is hazardous waste, as defined in Section 25117 of the Health andSafety Code; ii.Subsurface or latent physical conditions at the site differing from those indicated in the specifications; or iii.Unknown physical conditions at the site of any unusual nature,different materially for those ordinarily encountered andgenerally recognized as inherent in work of the character provided for in this Contract. b.Pending a determination by City of appropriate action to be taken, Contractorshall provide security measures (e.g., fences) adequate to prevent the hazardous waste or physical conditions from causing bodily injury to any person. c.City shall promptly investigate the reported conditions. This is the first of two allowable extensions. Recommended Action: It is recommended that the City Council extend the Fiscal Year 2018-2019 Street Overlay project contract for the Fiscal Year 2019-2020 Street Overlay project in the amount of $917,788.63. Discussion: SRM Contracting and Paving, Inc. successfully executed and completed the Fiscal Year 2018-2019 Street Overlay project and submitted new unit prices, as required by the contract documents, that have been reviewed and accepted by staff. The cost of most of the work within the project remained the same as last year. Some unit costs increased within expected escalation rates. All provisions of the Fiscal Year 2018-2019 Street Overlay contract will remain except for the description of the Fiscal Year 2019-2020 Street Overlay project scope of work and revised unit pricing. The MOU formalizes the City's and District's responsibilities to provide the City with supplemental sources of fuel for City vehicles and equipment to assist in emergency response, recovery and mitigation activities. Recommended Action: It is recommended that the City Council approve a Memorandum of Understanding with the Poway Unified School District authorizing the City's use of the District's fuel facility in the event of an emergency or disaster. Discussion: In a declared emergency situation, the City may require a backup fuel supply source. Preparing for such an event, staff recommends entering into an MOU with the District for use of its fuel facility. The District operates a fuel facility at its transportation center located at 13626 Twin Peaks Road, Poway, CA 92064. The fuel facility is centrally located in the City and is anywhere from two to four miles in distance away from any of the City's main facilities and fire stations. The District's fuel facility consists of one (1) 10,000-gallon underground unleaded fuel tank and one (1) 10,000-gallon underground diesel tank. The District has expressed mutual interest in establishing a local agreement that facilitates and encourages the sharing of the District's fuel facility during declared emergencies and disasters. The MOU will commence upon its date of execution and remain in effect until terminated by either party. The District may terminate the MOU upon 60 days advance written notice to the City. The District agrees to charge the City the price the District pays based on contracts with third-party 1 of 5 May 5, 2020, Item #5 suppliers with no markup. The District will provide the City with security access to enable fueling. The City's responsibilities include notifying the District through the City Manager or designee when there is a need of access to the fueling facilities, reimbursing the District for fuel costs within 30 days, and utilizing the access and egress routes designated by the District. The City's fuel facility includes a one (1) 6,000-gallon underground unleaded tank and one (1) 4,000- gallon underground diesel tank. While the City's inventory at any given time is sufficient to maintain the City's fleet during an emergency, this MOU will ensure the City has access to fuel resources for vehicles, fire apparatus, and equipment enabling the City to coordinate response, recovery and mitigation activities within the City. RECITALS WHEREAS the City and the District have expressed mutual interest in establishing a joint partnership agreement that facilitates and encourages sharing of District fueling facilities during emergency disaster events; WHEREAS the District owns and maintains a diesel fuel and unleaded gasoline fuel facility located at 13626 Twin Peaks Rd., Poway, CA 92064 hereinafter referred to as "Facility"; WHEREAS the City wishes to secure the ability to fuel city vehicles at the Facility in the event of an emergency disaster event; WHEREAS the City and the District have determined that entering into a joint partnership agreement to provide supplemental sources of fuel for city vehicles will enable the City to coordinate response, recovery and mitigation activities within the City of Poway to protect life and property; WHEREAS this Agreement is intended to formalize the City's responsibility to reimburse the District for fuel consumed at the District's Facility during an emergency disaster event; NOW, THEREFORE, in consideration of the terms, covenants, conditions, and agreements set forth herein below, the City and the District agree as follows: AGREEMENT 1.0 DISTRICT OBLIGATIONS District agrees to: 1.1 Provide the City access to the Facility during a City declared emergency disaster event, such as severe weather or catastrophic events. The District is to provide the City with security access codes/cards to enable fueling at the Facility. The number of access codes/cards is to be determined by the Parties. 1.2 Make every effort to offer quality fuel and properly functioning refueling equipment during said emergency disaster event. 1.3 Provide training for the use of the Facility to the City. 1 .4 Send the City an invoice for fuel charges for preceding emergency event(s). 1 3 of 5 ATTACHMENT A May 5, 2020, Item #5 2.0 CITY OBLIGATIONS City agrees to: 2.1 Provide notification to the District, via its City Manager or designee, when the Poway City Council declares an emergency disaster event and the expected duration for the need of access to the Facility. 2.2 Reimburse the District for all fuel costs charged by the District to the City for dispensation of fuel at the Facility, within thirty (30) days of the date of the invoice from the District, unless extraordinary conditions preclude this payment schedule. 2.3 Comply with District security requirements, which may change from time to time. The District will require each city user utilizing the Facility to obtain security access. The City will pay the standard administrative fee for the issuance of any access card or replacement card. 2.4 Use the access and egress routes designated by the District. 2.5 Upon verification that subject damage was caused by a city employee, the City will be responsible for correcting the damage either by paying the District for an agreed upon cost to make the repair( s) or by making repair(s) directly as satisfactory to the District. 2.6 Provide its own materials, time and personnel to clean up or minimize any hazardous fuel spill caused by the action of its employees. If hazardous fuel spill occurs and City is unable or unwilling to perform the cleanup immediately, the District may proceed with any actions it deems necessary to address the hazardous fuel spill and the City shall pay all costs of such action. 2.7 2.8 3.0 Immediately inform the District of any damage caused or seen to Facility equipment. Take the utmost care and proper safety procedures with Facility fueling equipment at all times. COST OF FUEL District agrees to charge City the price the District pays, based on contracts with third-party suppliers, with no mark-up. Price is subject to fluctuation, pursuant the terms of the District's contracts with its suppliers. If requested in writing by either party, within thirty (30) days of such request, the parties will meet to discuss a change in the mark-up to be paid by the City. No increased price will be charged without the agreement of the City. If the City does not agree to such increase, it may terminate this Agreement prior to the effective date of such increase. 4.0 FUEL AVAILABILITY The City shall have access to the District's Facility at all times during a declared emergency disaster event. The City should be prepared to manage unforeseen circumstances that may affect the availability of fuel and the District Facility which may disrupt continuous use, such as a supplier's inability to furnish fuel, fueling station repairs, closures of the District fueling station, the District ceasing operation of the fuel station, and other circumstances. The District will provide at least fourteen (14) days notice to the City for anticipated disruptions in access to the Facility and attempt to provide as much advance notice as possible in the event of unforeseen disruptions. 2 4of5 May 5, 2020, Item #5 5.0 INDEMNIFICATION 5.1 City agrees to defend (with attorneys approved by the District), indemnify and hold harmless the District, its Board of Trustees, employees, and agents from any and all liability or loss arising in any way out of the City's negligence in the performance of this agreement, including but not limited to any claim due to injury and/or damage sustained by City's employees or agents. 5.2 District agrees to defend (with attorneys approved by the City), indemnify and hold harmless the City, its City Council, employees, volunteers, and agents from any and all liability or loss arising in any way out of District's negligence in the performance of this agreement, including but not limited to any claim due to injury and/or damage sustained by District's employees or agents. 6.0 INSURANCE The Parties agree to secure and maintain insurance coverage for any and all risks that may arise out of the terms, obligations, operations, and actions as set forth in this Agreement, including but not limited to public entity liability insurance. The acquisition of excess insurance or the maintenance and operation of a self insurance program may fulfill the insurance requirement. 7.0 TERM OF AGREEMENT This Agreement will commence upon its date of execution and shall remain in effect until terminated by either party. The City may terminate this Agreement at any time, provided that it pays all outstanding invoices at the time of termination. The District may terminate this Agreement upon sixty (60) days advance written notice to the City. This Agreement may be modified upon the mutual agreement of the Parties. Prior to the expiration, the applicant requested the first one-year time extension to allow for additional time to complete the processing requirements for a Final Map. This project will be deemed expired unless the requested time extension is approved. Recommended Action: It is recommended that the City Council take public input, close the public hearing and adopt the Resolution. Discussion: The project site is an approximately 80-acre property located at the easterly terminus of Larchmont Street, which is just east of Pomerado Road and north of Twin Peaks Road. An approximate nine-acre area in the westerly most portion of the site, is in the Rural Residential C (RR-C) zone and the balance of the site is in the Rural Residential A (RR-A) zone. The project location and zoning map is included as Attachment B. The project site currently is comprised of two separate but contiguous legal lots. On March 20, 2018, the City Council approved TTM 16-005, which subdivides the project site into ten residential lots ranging in size from one to seven acres that are clustered in the westerly portion of the site, and includes approximately 59-acres of open space on the balance of the site as shown on Attachment C. No changes are proposed to the approved lot configuration. The TTM was approved by the City Council for two years pursuant to the Poway Municipal Code (PMC), and within that time the applicant is required to process and receive approval of a Final Map from the City Council. Section 16.10.080 of the PMC allows for a total of five one-year extensions. This is the 1 of 9 May 5, 2020, Item #6 first extension request for this approved subdivision. The application for this time extension was submitted prior to the expiration date of the application and therefore the time extension can be granted. The applicant needs additional time to complete the Final Map process. The applicant is requesting City Council approval of a one-year time extension. All the findings and Conditions of Approval from City Council Resolution P-18-08 will remain in full force and effect. The project will be required to comply with all current regulations for landscaping and stormwater requirements. No new Conditions of Approval are recommended as this is only a time extension request. With approval of this extension request, the TTM approval will be extended to March 20, 2021. Environmental Review: This time extension is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061 (b)(3) of the CEQA Guidelines in that this action has no possibility of an effect on the environment. The RTIP is a five-year program of proposed major highway, arterial, transit, pedestrian and bikeway projects that are funded by revenues from the TransNet half-cent sales tax. Pursuant to the TransNet Extension Ordinance, all local agencies are required to submit a list of proposed capital projects to be included in the proposed RTIP. The 2020 RTIP includes the list of projects proposed for full or partial funding by TransNet revenues for Fiscal Years 2020-21 through 2024-25. Recommended Action: It is recommended that the City Council take public input, close the public hearing and adopt the Resolution. Discussion: The goal and purpose of the RTIP is to enhance the regional transportation system and improve regional air quality. In order for local agencies to receive their allocated portion of annual TransNet half-cent sales tax funds, projects must be included in the RTIP, and must comply with the requirements as outlined in the SANDAG memorandum dated February 28, 2020. The SANDAG Board is scheduled to adopt the 2020 RTIP at its meeting of September 11, 2020. The TransNet Extension Ordinance requires local agencies every two years to adopt a five-year list of projects to be included in the RTIP and funded with TransNet revenues. In developing the list of projects, local agencies shall give a high priority to the use of these funds for improving regional 1 of 6 May 5, 2020, Item #7 2 of 6May 5, 2020, Item #7arterials and related facilities contributing to congestion relief. Attachment B is the 2020 RTIP five-year list of projects for the City of Poway. The City of Poway's total share of the TransNet revenues for local street and road program improvements is estimated at $8,345,000 over the five-year period covered in the proposed 2020 RTIP (Attachment C). The TransNet Ordinance requires that no more than 30 percent of revenues be spent on local street and road maintenance related projects. Funds that are not used during each Fiscal Year are rolled over to next year as part of the total revenues available to the City. Several projects which were identified in the City's 2018 RTIP have been completed including the 17/18 and the 18/19 Overlay Project, 17 /18 Neighborhood Sidewalk Project and the Poway Road/Pomerado Road Southbound Left-Turn Pocket Extension Project. Other projects, including the 19/20 Overlay Project and the 19/20 Neighborhood Sidewalk Project are currently under construction. Environmental Review: Establishment of a list of anticipated future capital improvement projects is not subject to the California Environmental Quality Act. Subsequent environmental assessment of each of the future projects will occur at a future date. Fiscal Impact: None. Based on SAN DAG projections, the estimated TransNet revenue to be received by the City of Poway for Fiscal Years 2020-21 through 2024-25, as shown in Attachment C, is $8,345,000. Should SAN DAG revise their TransNet revenue estimates staff will return to City Council with an amended Program List of Projects if the revised estimates impact project funding. Canavan, Fire Chief (858) 668-4461 or jcanavan@poway.org Resolution to Continue the Existence of a Local Emergency Within the City of Poway Due to the Novel Coronavirus (COVID-19) Global Pandemic The Novel Coronavirus (COVID-19) global pandemic continues to cause unprecedented impacts on all economic and social segments of the United States. Federal, state, and county directives, mandates and orders to prevent, control and manage the spread of COVID-19 have, and continue to, impact Poway residents, businesses and visitors. On March 18, 2020, the City Council approved a resolution proclaiming a local emergency. The adopted resolution requires the City Council to either continue the emergency action or declare the emergency ended at each regular meeting. Recommended Action: It is recommended that the City Council approve a resolution continuing the Proclamation of Local Emergency authorizing the City Manager to take necessary actions to protect the public and welfare of the City from the serious and imminent threat of COVI D-19. This action requires a four-fifths (4/5) vote of the City Council. Discussion: The COVID-19 global pandemic continues to impact business, education, healthcare, military, and social segments of the United States. COVI D-19 has resulted in a swift economic slowdown and escalating unemployment rates. Federal, state, and county directives, mandates, orders and guidelines have been issued to prevent, control and manage the spread of COVID-19. These efforts continue to impact Poway residents, businesses and visitors. In response to the COVID-19 global pandemic, and its impact on Poway, the City Manager, serving as Director of Emergency Services for the City of Poway, proclaimed a local emergency on March 13, 2020. On March 18, 2020, the City Council approved Resolution No. 20-013 ratifying the City Manager's Proclamation of Local Emergency. On April 7, 2020 and April 21, 2020, the City Council approved to continue the emergency action. The adopted resolution requires the City Council to either continue the emergency action or declare the emergency ended at each regular meeting. 1 of 5 May 5, 2020, Item #8 Environmental Review: This action is not subject to CEQA review. Fiscal Impact: Based on expenditure receipts to date, City costs to respond to COVID-19 are estimated at $75,000. The total fiscal impact is unknown at this time. Per the City Council adopted General Fund Reserve policy, the City maintains a General Fund Reserve of 45% of the annual operating budget, or $20,961,853 as of June 30, 2019. Within that 45%, $13,974,863 is set aside for Extreme Events/Public Safety. Based upon the City's reserve policy, there are adequate reserves to cover the costs to respond to this health emergency. Further, staff believes some of the costs are recoverable under State and Federal Disaster programs. Amounts recovered under these programs will be used to replenish the General Fund reserve. Pursuant to the reserve policy, staff will return with a plan to replenish any General Fund reserves not replenished under a State or Federal Disaster program. Proclamation of Local Emergency Reviewed/ Approved By: Wfildy serman Assistant City Manager 2 of 5 Reviewed By: Alan Fenstermacher City Attorney Approved By: Ch~ City Manager May 5, 2020, Item #8 RESOLUTION NO. 20- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, FINDING AND DECLARING THE CONTINUED EXISTENCE OF AN EMERGENCY WITHIN THE CITY DUE TO THE NOVEL CORONAVIRUS (COVID-19) GLOBAL PANDEMIC WHEREAS, the Novel Coronavirus (COVID-19) global pandemic in the City of Poway, commencing on or about January 24, 2020 that creates a threat to public health and safety; WHEREAS, Government Code section 8630 and Poway Municipal Code (PMC) Section 2.12.060 empower the City Manager, acting as the Director of Emergency Services, to proclaim the existence of a local emergency when the City is affected by a public calamity, and the City Council is not in session; WHEREAS, on March 13, 2020, the City Manager, acting pursuant to Government Code section 8630 and PMC section 2.12.060, proclaimed the existence of a local emergency based on conditions of extreme peril to the health and safety of persons caused by the Novel Coronavirus (COVID-19) global pandemic; WHEREAS, on March 18, 2020, the City Council, acting pursuant to Government Code section 8630 and PMC section 2.12.065, ratified the existence of a local emergency within seven (7) days of a Proclamation of Local Emergency by the City Manager; WHEREAS, the City Council, acting pursuant to PMC section 2.12.065, shall review the need for a continuing emergency declaration at regularly scheduled meetings at least every 21 days until the emergency is terminated; WHEREAS, the City Council, acting pursuant to PMC section 2.12.065, approved extending the emergency declaration during regularly scheduled meetings on April 7, 2020 and April 21, 2020; WHEREAS, Public Contract Code Section 20168 provides that the City Council may pass by four-fifths (4/5) vote, a resolution declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health, or property; WHEREAS, upon adoption of such resolution, the City Manager may expend any sum required in the emergency and report the same to the City Council in accordance with Public Contract Code Section 22050; WHEREAS, if such expenditure is ordered, the City Council shall review the emergency action at each regular meeting, to determine if there is a need to continue the action or if the Proclamation of Local Emergency may be terminated; and WHEREAS, such the Novel Coronavirus (COVID-19) global pandemic constitute an emergency within the terms of Public Contract Code Sections 20168 and 22050 which requires that the City Manager be able to act quickly and without complying with the notice and bidding procedures of the Public Contract Code to safeguard life, health, or property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway hereby 3 of 5 May 5, 2020, Item #8 Resolution No. 20- Page 2 finds and declares: SECTION 1: An emergency continues to exist within the City as the result of the Novel Coronavirus (COVID-19) global pandemic; and (a) The continuing threat of the Novel Coronavirus (COVID-19) global pandemic requires that the City be able to expend public money in order to safeguard life, health, or property; (b) The City Manager, as the City's Personnel Officer, is authorized to take actions necessary to alter employee leave policies and ensure a safe and healthy workforce; (c) The City Manager is authorized to safeguard life, health, or property without complying with notice or bidding procedures; and (d) Once such expenditure is made, the City Manager shall report the conditions to the City Council at each regular meeting, at which time the City Council shall either continue the emergency action or declare the emergency ended. SECTION 2: This Proclamation of Local Emergency and all subsequent resolutions in connection herewith shall require a four-fifths (4/5) vote of the City Council. PASSED, ADOPTED AND APPROVED at a Regular Meeting of the City Council of the City of Poway, California on the 5th day of May, 2020 by the following vote, to wit: AYES: NOES: ABSENT: DISQUALIFIED: Steve Vaus, Mayor ATTEST: Faviola Medina, CMC, City Clerk 4 of 5 May 5, 2020, Item #8 PROCLAMATION OF LOCAL EMERGENCY WHEREAS, section 2.12.060 of the Poway Municipal Code empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when the City is affected or likely to be affected by a public calamity and the City Council is not in session; WHEREAS, the City Manager, as Director of Emergency Services of the City of Poway, does hereby find that conditions of extreme peril to the safety of persons and property have arisen within the City of Poway, caused by the Novel Coronavirus (COVID-19) commencing on January 24, 2020; WHEREAS, that the City Council of the City of Poway is not in session and cannot immediately be called into session; and WHEREAS, this Proclamation of Local Emergency will be ratified by the City Council within seven days of being issued. NOW, THEREFORE, IT IS HEREBY PROCLAIMED by the Director of Emergency Services for the City of Poway, that a local emergency now exists throughout the City and that said local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council; IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions, and duties of the emergency organization of this City shall be those prescribed by state law, ordinances, and resolutions of this City, and by the City of Poway Emergency Plan; and IT IS FURTHER PROCLAIMED AND ORDERED that a copy of this Proclamation of Local Emergency be forwarded to the State Director of the Governor's Office of Emergency Services with a request that; 1. The State Director find the Proclamation of Local Emergency acceptable in accordance with provisions of the Natural Disaster Assistance Act; and 2. The State Director forward this Proclamation, and request for a State Proclamation and Presidential Declaration of Emergency, to the Governor of California for consideration and action.
