The Williams Ranch area initially consisted of 4 parcels that were then subdivided into 10 lots. As part of the unanimous council vote at the Nov 20, 1990 council meeting Item 7, (Linda Brannon, Bob Emery, Jan Goldsmith, Carl Kruse, and Don Higginson), p 9 of 32 states "6. The developer shall record individual covenants on Lots 5, 7, 9 and 10 restricting development of those lots to the construction of one story homes. The covenant shall be specific that future second story additions to the home will be prohibited." The agenda item stated it was to reduce the view of the project, or as this agenda item says "protect significant natural hillside landforms, make development blend in with natural landforms and preserve scenic views". The November 14, 2000 council meeting, Item 17, approved the Williams Ranch Final Map TTM 89-09 with no mention of the 1 story covenant changing. (Council: Bob Emery, Jay Gold by, Don Higginson, Betty Rexford, Mickey Cafagna). This agenda item states a couple of things. First that a one-story house can be up to 35 ft tall and the proposed building will be "only" 24 feet tall. It's true that a one-story house can be up to 35 ft tall, and this is permitted by the covenant on Lot 10 since the restriction is on how many stories a house can be, NOT on how tall a one-story house could be. The agenda item states that the applicant feels a two-story house is ok because two stories won't look worse than one story (no adverse aesthetic impact). That concerns me. Lot 10 is situated in a "saddle" and will be very visible to the west and south west of the project site as indicated by the viewscapes later on in the agenda item. This two story project does NOT preserve scenic views for much of Poway. This house, even at one story, will be as visible as the two-story house to the south. The restriction in the covenant limiting the house to one story should have been in the papers when the parcel was purchased. As far as I can tell, here's the story on the two story house to the south where the 2nd story extends above a ridgeline and really really stands out in the view of Twin Peaks Mountain from the west and southwest. 2 of 3 1 May 19, 2020, Item #2 The council on Feb 17, 2009, approved an MDRA and house for Lot 9. No mention of a one story covenant was made in the agenda item. On April 21, 2009, an MRDA and house was approved for Lot 8. The MDRAs expired and on June 5, 2012, a proposal to build a 35 ft house on Lot 8 was approved by the council. In this case, Lots 8 and 9 were sold and combined into one lot for consideration. Because there was no restriction on Lot 8 construction limiting the house to one-story, the 35 ft house was eventually built on the site, extending over the ridge line. As a side note, p 2 of 27 of Item 4.3 states "The stucco house will be painted a dark tan color." The house on Lot 8 visually stands out above the hillside because it appears to be "light" tan instead of "dark tan", although I have no qualitative way to measure "light" vs "dark". Having a nearby two-story house on Lot 8, therefore, does not set a precedence for building a two-story house on Lot 10 because of the existence of the covenant on Lot 10 that doesn't exist on Lot 8. When I bought my current house in late 2012, I had the expectation that the Williams Ranch subdivision would be constrained to one or two story houses depending on which lot was being developed. Since my house is directly west of Twin Peaks Mountain, west of Pomerado Rd, and is just below 700 ft elevation, I have a view to the west side of the Williams Ranch subdivision. The existing two story house on Lot 8 really stands out. Even a one story house in the saddle will be noticeable but Lot 10 is allowed a one story house. If the applicant wishes to build a one-story house on Lot 10, that is his right. However, building a two-story house on Lot 10 should not be allowed.
