2020 04-16 SpecialCITY OF POWAY CITY COUNCIL SPECIAL MEETING MINUTES April 16, 2020 City Council Chambers 13325 Civic Center Drive, Poway, California (Per Government Code 54953) (Meeting Called to Order as City Council/City of Poway Planning Commission/Poway Housing Authority/Public Financing Authority and Successor Agency to the Poway Redevelopment Agency) CALL TO ORDER Mayor Vaus called the Special Meeting to order at 4:30 p.m. ROLL CALL John Mullin, Barry Leonard, Dave Grosch, Caylin Frank (via teleconference), Steve Vaus STAFF MEMBERS PRESENT City Manager Chris Hazeltine; Assistant City Manager Wendy Kaserman, City Attorney Alan Fenstermacher (via teleconference); City Clerk Faviola Medina; Finance Director Aaron Beanan; Fire Chief Jon Canavan. PLEDGE OF ALLEGIANCE Councilmember Mullin led the Pledge of Allegiance. MOMENT OF SILENCE Mayor Vaus led a moment of silence. CONSENT CALENDAR None. STAFF REPORT 1. Poway Emergency Assistance Recovery Loans (PEARL) Economic Development Administrator Craig Ruiz presented the report along with a slideshow presentation. Mr. Ruiz explained that based upon Council direction given at the April 7, 2020 City Council meeting, staff refined the program and developed all application materials to implement the program with the intent of being able to complement existing state and federal 0776 City of Poway — Minutes — April 16, 2020 loan programs as well as provide a financial bridge to small local businesses to survive the current emergency. Mr. Ruiz gave an overview of the program, explained the application process, funding for the program and the resources available to businesses. Mr. Ruiz explained that the PEARL program will provide loans of up to $50,000 to eligible businesses and that a maximum fund of $2,000,000 is being allocated from the General Fund Extreme Events/Public Safety reserve. He added that repayment of the PEARL loans will replenish the reserve fund per the General Fund Reserve's Policy. Mr. Ruiz outlined that the program will be promoted to businesses via email, on the City's website and through the Poway Chamber of Commerce. Mr. Ruiz concluded that the City anticipates opening applications on the City's website, April 23, 2020, at 12:00 p.m. and that loans will be based on a first-come first-served basis. Lynne ingstad, owner of SoCal Dance in Poway, spoke in support of the program and inquired about the ability to qualify if they currently participate in a federal loan assistance program. Chris Olps spoke regarding the program criteria and inquired about how it was developed. Mike (last name unknown) inquired about the eligibility of his independently owned franchise. Council discussion ensued regarding the PEARL program and reconsidering allowing franchises to apply for Poway's small business loan. In response to Council inquiry, Mr. Ruiz explained that the City has approximately 1,637 active business certificates and of those, 1,500 have approximately 50 or less employees. In response to Council inquiry, Director of Finance Aaron Beanan explained that monthly loan payments and interest accrual would not begin until 90 days after the City rescinds the local emergency declaration, at which time, the three-year payback period would begin. He added that loans repaid within 90 days after the City rescinds the local emergency declaration will pay 0% interest. Council expressed their support for the program and highlighted that all approvals will be made by the City Manager shall be considered final and that there is no appeal process to the City Council. Council concurred to allow local franchises that are independently owned and that meet the program criteria the opportunity to apply for the PEARL program. Additionally, Council concurred to include business chains that can demonstrate that a majority of their business is in Poway. Motioned by Mayor Vaus, seconded by Deputy Mayor Frank to adopt Resolution No. 20-020 entitled "A Resolution of the City Council of the City of Poway, California, establishing the Poway Emergency Assistance Recovery Loans (PEARL) Program" to include the change of allowing local franchises that meet the criteria the opportunity to apply for the PEARL program and appropriate a total amount not to exceed $2,000,000 using the General Fund's Extreme Events/Public Safety reserve to fund the program.
