Item 3 - Review of City’s Local Conflict of Interest CodeJune 2, 2020, Item #3DATE: TO: FROM: SUBJECT: Summary: AG EN DA REPORT City of Poway June 2, 2020 Honorable Mayor and Members of the City Council Faviola Medina, City Clerk ~ (858) 668-4535 or fmedina@poway.org Review of the City's Local Conflict of Interest Code CITY COUNCIL The Political Reform Act requires every local government agency to adopt and maintain a Local Conflict of Interest Code. In accordance with Government Code section 87306.5, no later than July 1 of each even-numbered year, the City Council shall direct staff to review the City's Conflict of Interest Code for possible amendments to reflect any added, changed or deleted positions since the last Local Conflict of Interest Code adoption. Recommended Action: It is recommended that the City Council direct staff to review the City's Local Conflict of Interest Code in accordance with Government Code section 87306.5. Discussion: The Local Conflict of Interest Code designates positions required to file a Statement of Economic Interests, also known as the Fair Political Practices Commission's (FPPC) Form 700, and assigns disclosure categories specifying the types of interests to be reported to help determine if any disqualifications exists in making or participating in making decisions on behalf of the City or any other agencies which may have an influence on their financial interests. The Political Reform Act requires every local government agency to review its Local Conflict of Interest Code every even-numbered year to ensure that it is accurate and current. Specifically, Government Code section 87306.5 requires that the City Council, no later than July 1 of even-numbered years, direct staff to review the City's Local Conflict of Interest Code to determine if amendments are required or that no amendments are necessary. Once the determination has been made, a notice, referred to as the "biennial report", must be submitted by the City Clerk to the California Fair Political Practices Commission no later than October 1, 2020. If amendments to the Local Conflict of Interest Code are indeed necessary, the code must be forwarded to the City Council for approval within 90 days of that determination. Any amendments made would reflect changes in position titles, positions that may no longer exist, and the creation of new positions that meet the definition of a "designated employee" since the adoption of the last Local Conflict of Interest Code. 1 of 2 June 2, 2020, Item #3Environmental Review: This action is not subject to review under the California Environmental Quality Act (CEQA).
