Item 5 - Resolution for Solid Waste Recycling Collection Service Rate IncreasesJune 2, 2020, Item #5DATE: TO: FROM: CONTACT: SUBJECT: Summary: AGENDA RE PO RT City of Poway June 2, 2020 Honorable Mayor and Members of the City Cou~I Eric Heidemann, Director of Public Works ~ CITY COUNCIL Will Wiley, Assistant Director of Public Works for Maintenance Operations~ (858) 668-4750 or wwiley@poway.org Resolution for Solid Waste/Recycling Collection Service Rate Increases The solid waste Franchise Agreement (Agreement) between the City and EDCO Waste and Recycling Services (EDCO) allows EDCO to submit a request for a rate review once a year when necessitated by an increase in the Consumer Price Index (CPI), a change in landfill disposal costs or costs due to extraordinary circumstances. In accordance with Section 8.3 of the Agreement, EDCO has submitted a request for a rate adjustment for Fiscal Year 2020-21. The rate adjustment includes a 1.93 percent increase due to changes in the CPI, a 2.59 percent increase to the disposal fee, and an organics recycling fee for residential ($3.68 per month) and commercial (varies) collection service. The City's role is to ensure the calculation methodology has been applied correctly and that the calculations are accurate. Staff has confirmed that the methodology and calculations are correct. EDCO's last rate increase occurred July 1, 2019. The attached Resolution (Attachment A) outlines an adjustment to EDCO's rate schedule effective July 1, 2020, and automatic pass through/inflationary adjustments for a period of five years, through June 30, 2025. The automatic pass-through/inflationary adjustments through June 30, 2025 are calculated with the same methodology and formulas used for the rate increases. Proposition 218 requires that the customer of record be given the right to protest increases in solid waste and recycling collection rate increases prior to approval. The City's public notice was mailed to 14,964 customers of record on April 16, 2020. Under the provisions of Proposition 218, if the City receives written protests from the majority of customers of record (at least 7,483 customer protests), the City Council cannot approve the proposed rate increases. Recommended Action: It is recommended that the City Council take public input, close the public hearing, adopt the Resolution and rescind Resolution 19-026 if a majority protest does not exist. 1 of 31 June 2, 2020, Item #5Discussion: The City contracts for solid waste and recycling collection services through an exclusive Agreement with EDCO. The City's Agreement is structured so that the term of the Agreement is always five years due to the complexities of program establishment and administration, the large capital investment and the capitalization requirements necessary to achieve a successful solid waste collection program within a jurisdiction. Assuming EDCO is meeting all conditions of the Agreement to the satisfaction of the City, a one-year extension to the Agreement is applied every year on EDCO's anniversary date so that the agreement term remains five years. In accordance with the City's Agreement, solid waste rates may only be increased because of cost of living increases (i.e. CPI), landfill disposal fee increases, or because of extraordinary circumstances. On February 29, 2020, in accordance with the Agreement, EDCO submitted a request for an annual rate adjustment (Attachment B) for all services, including residential, commercial, and other special services and fees listed on the rate schedule. The proposed rate adjustments have been calculated in accordance with the provisions of the Agreement. EDCO's last rate increase was approved by City Council in June 2019 and became effective July 1, 2019. The City's residential collection service rates are comprised of four components: 1) service fee; 2) disposal fee; 3) Assembly Bill (AB) 939 fee; and 4) franchise fee. The City's commercial collection service rates are comprised of three components: 1) service fee; 2) disposal fee; and 3) franchise fee. Adjustments to the disposal fee and the service fee as a result of CPI are being proposed at this time. In addition, a special rate adjustment to the single-family residential and commercial collection rates for commingled organics is requested. No change to the AB 939 and franchise fee is proposed. CPI Adjustments to the Service Fee: Adjustments to the service fee are based on changes in the CPI for the San Diego-Carlsbad area for All Urban Consumers (all items), base period of 1982-1984=100, published by the United States Department of Labor, Bureau of Labor Statistics. The formula used to calculate the percentage change for the service fee portion of the rate is calculated by determining the difference between the San Diego-Carlsbad area CPI for the second half of 2018 (295.018) and the second half of 2019 (300.718), then dividing the index change (5.70 points) by the CPI of the previous period (295.018) and multiplying that by 100, which results in an increase of 1.93 percent. This is the multiplier used for the service fee portion of the service rate. Disposal Fee: The disposal fee increase is calculated separately from the CPI adjustment. A disposal or tipping fee is the charge levied upon a given quantity (e.g. ton) of waste received at a processing facility, such as a landfill. This increase is determined following provisions contained in the Regional Solid Waste Association (RSWA) Disposal Agreement, of which the City is a member agency. The disposal fee for solid waste originating in the City of Poway and hauled by EDCO is currently $44.39 per ton. The disposal fee, effective July 1, 2020, will be $45.54 per ton, an increase of $1.15 per ton or 2.59 percent. This percentage change was adjusted downward from 2.96 percent by applying a calculation that includes, in part, a modifier of the percentage increase of the previous year's increase in waste tonnage. For residential rates, the landfill disposal fee represents an $0.11 increase to the disposal portion of the rate. For commercial and multi-family rates, the landfill disposal fee increase varies depending on the level and frequency of service, but the increase to current disposal fees ranges from $0.25 (one-yard bin picked up once per week) to $8.92 (six-yard bin picked up six times per week). Commingled Organic Recycling Fee: The State has enacted legislation focused on reducing the current levels of organic waste going to landfills. In 2014, California adopted AB 1826, requiring all businesses to recycle their organic waste on and after April 1, 2016. This mandate seeks to reduce overall waste diversion by 75 percent by 2020. As of January 1, 2019, businesses generating four (4) 2 of 31 June 2, 2020, Item #5cubic yards or more of solid waste per week must recycle their organic waste, which includes green waste and food waste. Furthermore, in 2016, California adopted Senate Bill (SB) 1383, mandating statewide adoption of regulations and requirements to achieve a 50 percent reduction in organic waste disposal by 2020 and a 75 percent reduction by 2025. This bill requires everyone, businesses and residences alike, to participate in an organics recycling program by January 1, 2022. In order to comply with state law, the proposed residential rate adjustment will consist of converting the existing manual green waste collection service to a fully automatic commingled organic/green waste collection program. Poway residents will be provided with up to three organic/green waste carts to dispose of green and food waste. If needed, residents may obtain additional organic/green waste carts for an additional monthly fee. Residents will also be provided with a kitchen caddie for the convenient collection of food scraps in the kitchen of one's home, which will be dishwasher safe as well as odor and bug resistant. The organic waste (yard and food) collected will be taken to EDCO's Anaerobic Digestion Facility in Escondido, CA to be converted into renewable natural gas and anaerobic compost and diverted away from landfills. The City is dedicated to keeping its solid waste collection rates as low as possible while also complying with state mandates. The implementation of the organic/green waste cart is the most efficient and cost-effective methodology to achieve state compliance. The implementation of an organic waste recycling program, specifically the collection of food waste, will cost an additional $3.68 per month for single-family residential customers. Residential customers will not be billed for the $3.68/month organic recycling fee until food scrap collection services are in place, expected early 2021. Overview of Residential and Commercial Rates: The following tables show the current and proposed FY 2020-21 monthly solid waste collection service rates for the three most common levels of service. If approved, the solid waste and recycling collection rates will be effective July 1, 2020, and thereafter may be increased for a period of five years through June 30, 2025, by a factor equal to the respective applicable increase in CPI and disposal increase without conducting another noticed public hearing and without further action on the part of the City Council, in accordance with Government Code Sections 53739 and 53756. 4 of 31 June 2, 2020, Item #5Proposition 218: Property related services charges, such as water, sewer, or solid waste service fees are subject to the procedural and substantive requirements of voter approved Proposition 218. Proposition 218 requires that a written notice be mailed to the owner or account holder of each parcel upon which the fee will be imposed and that a public hearing be conducted not less than 45 days after mailing the notice. If a majority of owners or customers do not present written protests against the proposed increase, the City Council may consider approving the fee increase. If a majority of owners or customers present written protests against the proposed fee, the City may not impose the fee increase. The Notice of Public Hearing was mailed to 14,964 customers of record on April 16, 2020. A total of 7,483 protests must be received to constitute a majority. Next Steps: If the proposed rate adjustments are approved, the adjustments, except for the organic recycling fee will be effective July 1, 2020. Shortly thereafter, EDCO will begin ordering residential organic/green carts. It is estimated that in October/November 2020, EDCO will begin delivering the organic/green waste carts to each single-family residential customer (each customer may be able to receive up to three carts; additional carts available for a fee). After delivery of the organic/green waste carts to residential customer is complete, residents will be required to begin using the organic/green waste carts for yard waste collection only, expected November/December 2020. At this time, EDCO will no longer service green waste in individual 32-or 35-gallon trash containers or pick up yard waste in trash bags. As early as January 1, 2021, the organics recycling program will be in effect, and residential customers can begin disposing food waste in addition to their green waste in their organic/green waste cart. When these collection services are in place, EDCO will begin assessing the $3.68/month organic recycling fee. Prior to the implementation of the commingled organic collection program, EDCO in close coordination with the City, will conduct robust educational outreach to educate residents and businesses on the service changes. Sometime during the summer of 2020, staff will return to the City Council with proposed ordinance changes to the Municipal Code to reflect the changes in service collection as a result of organic waste recycling. Environmental Review: This action is not subject to review under the California Environmental Quality Act (CEQA). Fiscal Impact: This action will increase the City's General Fund Solid Waste Franchise Fee account (1000-77730) by approximately $85,000 -$88,000 per fiscal year. Under the provisions of the franchise, EDCO Waste & Recycling Services is requesting a rate adjustment effective July 1, 2020. The last rate adjustment occurred on.July 1, 2019. Please note that separate and aside from any proposed rate adjustments, EDCO is also offering to convert the current single family manual green waste collection program to an automated collection program. Consistent with inf01mation provided to the City of Poway previously, under this p·rogram each customer would receive a single 95 gallon cart for weekly collection, with up to two additional carts available at no additional charge (the equivalent of up to nine 32 gallon cans). Benefits would include a uniform appearance on collection day, ease of container movement, vector detenent and improved storm water containment as well as being supported by a comprehensive public education program, similar to what occurred at the implementation of automated recycling and trash collection. CPI Adjustment To calculate the CPI portion of the adjustment, the second half of the 2018 index (295.018) was compared to the second half of 2019 index (300.718) which produced a 5. 70 point change or 1. 93 % increase. The CPI indexes are attached for your reference. The new rates are attached for your review. Anaerobic Digestion Facility Anticipated completion of the Anaerobic Digestion (AD) facility is projected for beginning of 2021 and once operational, will enable the City to comply with AB 1826 by diverting commercial organics and the future application of SB 13 83 by diverting residential organics from being landfilled. This exciting new facility will as·sist in achieving the Climate Action Plan through the conversion of source separated commingled organics into Renewable Natural Gas that can be directly injected into the pipeline. As such, also reflected are the proposed residential and commercial organic service rates that would be effoctive if the AD was completed and accepting organic material. These include commercial rates for a 65 gallon, 95 gallon and two cubic yard bins services at various intervals per week. In addition, conve11ing the existing residential green waste collection to a fully commingled organic program will adjust the cunent single family residential rate by $3.68 per month. These rates will be implemented once the facility has opened and organic collection services are provided. Prior to the implementation of the commingled organic collection program, EDCO will provide an extensive and robust direct educational outreach for commercial and residential customers. In addition, a food scrap container for kitchens will be offered to each single family residential household for the interior collection of food waste to assist in facilitating the material to the current green waste carts.
