Item 8 - Revisions to the Classification Plan, Salary Schedule and Personnel RulesDATE: TO: FROM: CONTACT: SUBJECT: Summary: AGENDA RE PO RT City of Poway December 7, 2021 Honorable Mayor and Members of the City Council Chris Hazeltine, City Manager~ Chris Hazeltine, City Manager (858) 668-4504 ·or chazeltine@poway.org CITY COUNCIL Revisions to the City of Poway Classification Plan, Salary Schedules and Personnel Rules based on a Review of Minimum Wage Requirements, Market Competitiveness and Recruitment and Retention Strategies The California minimum wage is increasing from $14 per hour to $15 per hour on January 1, 2022 for employers in California with 26 or more employees. There are currently four classifications on the City of Poway's Part-Time Temporary/Seasonal Wage Schedule that will fall below the state minimum wage requirement at the entry level steps of their position salary grades. In addition, recruiting part-time temporary/seasonal employees to support the City's recreational programs and services and parks maintenance has become increasingly difficult. Revisions to the City's Part-Time Temporary/Seasonal Wage Schedule are being proposed for City Council consideration to comply with the state's minimum wage requirements and address recruitment challenges in an effort to avoid program and service reductions. A related revision to the Non-Safety Salary Schedule is also proposed, which increases the hourly wage for Park Rangers and ensures their wages are in line with the proposed revisions to other part-time, temporary/seasonal positions. The Park Ranger classification has both part-time temporary/seasonal and regular positions. Recruitment and retention strategies have never been more important in the public sector than they are now due to the impacts from the global COVID-19 pandemic and persistent worker shortages. Included in this staff report are recommendations for creative strategies to ensure Poway attracts and retains the most qualified, dedicated and talented employees at all levels of the organization to serve the Poway community. The proposed City of Poway Position Classification Plan and Salary Schedule for Management/Confidential Employees reflect such strategies through the establishment of a Deputy Fire Marshal classification and salary as well as revisions to the outdated compensation structure and below market pay grades for Group 1 employees. Lastly, to help attract qualified and experienced employees from other public agencies, it is recommended that there be an amendment to the City's Personnel Rules adding a new benefit that will provide credit to a newly hired regular employee through a higher biweekly vacation accrual rate based on the number of prior years of verifiable service with other public agencies. 1 of 15 December 7, 2021, Item #8 Recommended Action: It is recommended that the City Council: 1) adopt a Resolution approving changes to the Temporary/Seasonal Wage Schedule and Non-Safety Salary Schedule effective January 1, 2022; 2) adopt a Resolution approving changes to the City of Poway Position Classification Plan and Management/Confidential Salary Schedule effective December 7, 2021; and 3) adopt a Resolution amending the City of Poway Personnel Rules to add a new benefit for new regular employees providing credit for years of service at prior public sector employers through initial vacation accrual rates. Discussion: Temporary/Seasonal Wage Schedule Effective January 1, 2022, California State Labor Code 1182.12(b)(1 )(F) requires the minimum wage for all industries employing 26 or more employees to increase to $15 per hour. The City has reviewed the salary grades for four classifications that will not meet the state's minimum hourly wage requirement at the entry level steps. In addition, recruiting for all part-time temporary/seasonal positions has become increasingly difficult. To comply with state law, address recruitment challenges and maintain appropriate internal alignment, the City of Poway's Part-Time Temporary/Seasonal Wage Schedule has been revised to reflect one-time, special wage grade adjustments. The adjustments to the Part-Time Temporary/Seasonal Salary Schedule range from $0.46 per hour (Stage Technician) to $2.68 per hour (Lifeguard) at the entry level steps. The grade and hourly rates for the Park Ranger position listed on the Non-Safety Salary Schedule (because there are both temporary/seasonal Park Ranger and Regular Park Ranger positions) will be adjusted by $0.87 at the entry level step. City of Poway Classification Plan and Management/Confidential Salary Schedule Proposed revisions to the City's Position Classification Plan and Salary Schedule for Management/Confidential Employees include a proposed new classification of Deputy Fire Marshal with a proposed salary based on market research and a structural change from a step-based pay structure to bands for Group 1 employees. Deputy Fire Marshal The City is currently recruiting for a Fire Chief after the most recent Fire Chief retired. The Deputy Fire Chief, who also acts as the City's Fire Marshal, has been serving as the Interim Fire Chief. With two full-time key roles to fill on a temporary basis until a permanent Fire Chief is hired, some of the Fire Marshal duties typically performed by the Deputy Fire Chief have been supported by two staff members from the Fire Prevention division: the Senior Fire Safety Inspector and the Fire Safety Inspector. The Senior Fire Safety Inspector has been performing higher-level duties that include conducting business certificate and discretionary project reviews as well as meeting with project applicants on defensible space, fuel modification and performing site inspections. The Fire Safety Inspector has taken on Senior Inspector level duties including conducting plan reviews and inspections for tents and special events, Temporary Use Permits, residential fire sprinkler systems, and new businesses. To compensate the Inspectors for performing duties outside of their current classifications even on a temporary basis, the City Council must approve a new classification on the City's Position Classification Plan with a corresponding salary on the Management/Confidential Salary 2 of 15 December 7, 2021, Item #8 Schedule. Based on an internal and external analysis, the classification of Deputy Fire Marshal is being proposed at a salary grade of 620. This will allow the City to appropriately compensate the Senior Fire Safety Inspector on a temporary Out of Class Assignment (OCA) basis as a Deputy Fire Marshal and compensate the Fire Safety Inspector on a temporary OCA basis as the Senior Fire Inspector while the Deputy Fire Chief is performing the role of Interim Fire Chief. Once the Fire Chief is hired, the Fire Chief will be tasked with assessing the needs of the Fire Prevention division and determining the appropriate level of positions to ensure the fire prevention needs of the Poway community are met with the highest level of quality customer service. Management/Confidential Employees -Group 1 Salaries and Range Structure The current salary range for the Fire Chief position is 7.87% below the median when compared to other cities with Fire Chiefs in San Diego County. This could significantly impact the City's current recruitment for a Fire Chief. Furthermore, current salaries for all the employees in Group 1, which includes the Assistant City Manager, Fire Chief and the City's five Directors, are on average 6.58% below the median for the San Diego market. To address the potential impacts of salaries for Group 1 employees being below median, and to get ahead of potential retention issues, a new range structure is being proposed for Group 1 employees. The new structure eliminates the 5-step structure (with each step separated by 5% for a total range of approximately 21.5% due to compounding) and instead establishes a band with a minimum and maximum salary range of 40%. The proposed structure is similar to how the majority of cities in San Diego County structure their pay ranges for management employees, and the 40% range is in line with the median ranges of management salaries established by cities in the San Diego market. The proposed changes to the range structure will move all Directors into the same band, creating organizational equity within Group 1 while also creating more flexibility and accountability for the City Manager to address the performance of Group 1 employees. The top of the proposed Assistant City Manager band is proposed to be 5% higher than the top of the Directors' bands. The current Group 1 pay structure is outdated, rigid and in need of change to be competitive at the top leadership levels. The current salaries of all but one Group 1 employee (Community Services Director) fall within the new proposed bands, therefore no automatic increases are required except for the Community Services Director. Any increases for Group 1 employees after this change will be based on performance, typically given on an employee's anniversary date and at the discretion of the City Manager. Exceptional performance merit increases may be given on a date different from the employee's anniversary date. The revised Management/Confidential Salary Schedule reflects the proposed structural change for Group 1 employees. Personnel Rule Revision Another creative tool for recruiting qualified, experienced and exceptional employees to Poway from other public entities would be to allow new regular full and part-time employees hired with prior public sector experience to receive credit through vacation accrual rates for their years of service with other public agencies. New employees would accrue vacation hours within the City of Poway approved vacation accrual schedules based on their years of verifiable service with other public entities. For example, if a Firefighter/Paramedic has ten years of experience with another public sector fire agency, they would immediately accrue vacation hours on a biweekly basis at the 10-year accrual level for City of Poway Fire Safety employees per the Memorandum of Understanding. This benefit would apply to all new, regular employees with the City of Poway. 3 of 15 December 7, 2021, Item #8 Environmental Review: This action is not subject to review under the California Environmental Quality Act (CEQA). Fiscal Impact: Sufficient funds due to salary savings from vacancies are budgeted in the Fiscal Year 2021-22 budget to cover the minimum wage and other increases in part-time temporary/seasonal wage rates, the structural change to the Group 1 employee salary ranges and the temporary out of class pay for the Senior Fire Safety Inspector to act as the Deputy Fire Marshal and the Fire Safety Inspector to act as the Senior Fire Safety Inspector. The estimated cost impact for the remainder of Fiscal Year 2021-22 for the increase in part-time seasonal/temporary employee wages is estimated at approximately $52,61 O and the immediate cost impact for the structural change to Group 1 employee ranges in Fiscal Year 2021-22 is $8,684. Future performance based/merit increases for Group 1 employees will be estimated as part of the regular budget process for all employees of the City. The estimated cost in Fiscal Year 2021-22 for the temporary Out of Class Assignments (OCAs) of both Fire Safety Inspectors is approximately $5,521. If the temporary OCAs extend beyond three months from approval, the estimated cost impact will increase. Public Notification: None. Attachments: A. WHEREAS, the City's Fire Department oversees building fire codes and inspections and there is an immediate need for a Deputy Fire Marshal classification; WHEREAS, the Deputy Fire Marshal is a new classification added to the City's Position Classification Plan, attached hereto as Exhibit A, setting the salary range for the new classification at grade 620 as an Exempt At-Will position in Group 2A on the Management/Confidential Salary Schedule, attached hereto as Exhibit B; WHEREAS, the salary range structure for the Assistant City Manager and the Department Director classifications in the Management/Confidential Group 1 is outdated, rigid and in need of change to be competitive at the top leadership levels within the City of Poway organization; WHEREAS, the salary range schedule with steps for Management/Confidential Group 1 will be eliminated and changed to bands, with movement along the bands based on performance and at the discretion of the City Manager; WHEREAS, the salary band for the Assistant City Manager will range from $160,155 to $224,217 annually, and the salary band for the Department Directors will range from $152,529 to $213,540 annually; and WHEREAS, the City Council must approve new classifications added to the City's Position Classification Plan, Salary Range Adjustments, and changes to the Salary Schedule. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway that the following changes to the City's Position Classification Plan and Management/Confidential Salary Schedule are authorized effective upon approval by the City Council: SECTION 1: Establish the classification of Deputy Fire Marshal on the City's Position Classification Plan; SECTION 2: Establish the salary of Deputy Fire Marshal on the Management/Confidential Salary Schedule at Grade 620 in Group 2A Exempt At-Will of the Management/Confidential Salary Schedule with a monthly salary range of $7,503.91 to $9,121.00, effective December 7, 2021; SECTION 3: Change the Salary Schedule for the Assistant City Manager and the Department Directors in the Management/Confidential Group 1 from salary grades with five steps to bands with a minimum and maximum salary, effective December 7, 2021; SECTION 4: The proposed classification specification for Deputy Fire Marshal is on file 9 of 15 ATTACHMENT B December 7, 2021, Item #8 Resolution No. 21-Page 2 in the Human Resources and Risk Management Department and available on the City's website. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: SECTION 1: The above recitals are true and correct. SECTION 2: City of Poway Personnel Rule 6.2 (VACATION LEAVE) is amended as follows, adding a new benefit for all new regular employees of the City of Poway, effective the first day of the pay period (December 6, 2021) in which the City Council approves the amendment to the City of Poway Personnel Rules: 6.2 VACATION LEA VE 6.2.1 Application The following sections of Rule 6. 2 shall apply to all those positions specified in Section 1.3 of these Rules except elected officials, members of boards, commissions and committees, contractual employees and volunteer and temporary personnel (See also Rule 1.4). 6. 2. 2 Vacation Accumulation Regular full-time and part-time employees earn and accumulate vacation with pay in accordance with the schedules specified in the salary and benefits plan or the appropriate memorandum of understanding. 13 of 15 ATTACHMENT C December 7, 2021, Item #8 14 of 15 Resolution No. 21-Page 2 6.2.3 Vacation Accrual Rates -Prior Public Sector Service Credit Vacation accruals for new employees hired on or after the first day of the pay period in which the City Council approved this benefit will be based on the full-time equivalent years of public sector service with prior local. state. federal or special district public agencies. For example. a new employee hired with ten years of verifiable experience with other public agencies will start at the vacation accrual rate for their specific position based on the schedule in their memorandum of understanding. The experience must be verifiable by the City of Poway to receive credit. The specific vacation accrual rates are specified in the salary and benefits plan or the appropriate memorandum of understanding. 6.2.4 Scheduling Of Vacations The time at which an employee takes vacation leave is determined by the prior approval of the supervisor with due regard to the wishes of the employee and particular regard for the needs of the City. 6. 2.4Q Leave Of Absence An employee continues to accrue vacation during any authorized and compensated leave. The employee does not accrue vacation during any leave without pay. 6.2 . .&§. Illness During Vacation If an employee becomes ill while on vacation, the time ill is charged to accumulated sick leave of the employee provided that the employee can satisfactorily demonstrate that he/she was under the direct care of a medical doctor such as in a hospital. 6.2.eZ Holiday During Vacation If a City holiday occurs while an employee is on vacation, such holiday time is not deducted from the amount of vacation to which the employee is entitled. 6.2.+~ Accounting For Vacation Used Each employee has one (1) hour deducted from his/her accrued vacation for each hour of vacation taken. 6. 2.8~ Separation Vacation Pay Upon separation, an employee receives compensation at his/her current salary rate for all unused earned vacation up to and including the date of separation.
