Proposition 68 provides funds for local park rehabilitation, creation, and improvement grants to local governments on a per capita basis. Should the City Council approve the attached resolution, the City of Poway will be applying for Proposition 68 funds to use towards the full replacement and enhancement of the Upper Lake Poway Playground Structures. The first step in the application process is to pass a resolution authorizing the City of Poway to apply for said funds. These funds will be combined with General Fund dollars and possibly other funding sources to complete the project. Recommended Action: It is recommended that the City Council adopt the Resolution (Attachment A) approving the submittal of an application for Proposition 68 Per Capita Grant Funds with the California State Department of Parks and Recreation and upon approval of the grant application and authorize the City Manager to appropriate the necessary Grant funds to the Lake Poway Upper Playground Renovation project (PK020). Discussion: Proposition 68 (Prop 68) was approved by California voters on June 5, 2018. Prop 68 created the Per Capita Grant Program (Program) which provides local park rehabilitation, creation, and improvement grants to local governments on a per capita basis. The Program has two funding sources, the Per Capita Fund and the Urban County Fund. All California cities are eligible for the Per Capita Fund, and cities with populations under 200,000 are also eligible for the Urban County Fund. With funding from both sources, Poway is eligible to receive $208,707. This is a non-competitive grant application, and all eligible projects with complete applications will receive funding under the Program. 1 of 11 December 7, 2021, Item #4The first step in the application process requires the City to approve the Resolution in Attachment A (Resolution) prior to applying for funding. The Resolution affirms the City will comply with all Program requirements, has adequate funding to build and operate the new facility, that the Project is consistent with the City's General Plan, and that the City will comply with state and federal laws and contract provisions. In submitting the application, the City also agrees to provide regular status updates to the State on construction progress, funding expenditures, and to submit project completion audits. If the City Council votes to approve the Resolution, staff will have until December 31, 2021 to apply for the funds. The next step in the process will be to enter into a contract with the State by June 30, 2022. The City will then have until December 31, 2023 to complete the Lake Poway Upper Playground Renovation project. The City has an annual playground replacement program to update playground structures citywide. Updates address safety issues, aesthetics, and incorporate more up to date features. Typically, based upon available funding, the City is able to replace one playground structure per fiscal year. During the pandemic, as part of the retrenchment strategy to save money and preserve funding due to the unknown future fiscal impacts of COVID-19, no playground replacement project was budgeted in Fiscal Year 2020-21. Playground replacement projects are funded by the General Fund, which in recent years has had minimal excess funding available for capital projects. As part of the adopted Fiscal Year 2021-22 Capital Improvement Program, funds were budgeted for a partial replacement/restoration of the Lake Poway Upper Playground Replacement project. See Attachment B for a location map and Attachment C for pictures of the current play structures. Funding was not budgeted for a full replacement. Upon further internal discussion between the City Manager's Office, the Development Services Department, the Public Works Department, and the Community Services Department, it was recognized that what is really needed for this playground is to fully replace the play structures and in doing so also take the opportunity to enhance what we are offering to park visitors and expand the number of people the play structures can serve. The intent is now to fully replace the existing structures with expanded features including: all abilities features for visitors with special needs, features to serve a larger age range from tots to middle school, adding interactive interpretive elements with information about local flora and fauna, and the addition of shade sails to provide more shade for those using the facility. This will hopefully expand the length of time people are able to enjoy the facility because they will be cooler and more comfortable. The approved project budget was funded with $350,000 of General Fund dollars but will not completely fund the re-imagined project, which could range between $600,000 and $1,000,000 depending upon the features recommended for the project. To help offset the revised project costs, the City plans to apply for the Prop 68 grant funds. Based upon the new structures and features, the City is looking at additional funding sources including potentially utilizing Park Development Impact Fees to help fund the remaining gap between the approved budget and the revised project costs. Since the City is funding a significant amount of the project through the General Fund, the City more than satisfies the grant match requirements. As with most grants, this would be a reimbursable grant. Therefore, if the City's grant application is approved, the City would need to appropriate funds to cover the full cost of the project and submit for reimbursement when the project is completed. Environmental Review: This action is not subject to review under the California Environmental Quality Act (CEQA). 2 of 11 December 7, 2021, Item #4Fiscal Impact: As noted previously, the Fiscal Year 2021-2022 Capital Improvement Program includes $350,000 to fund the Upper Lake Poway Playground Restoration Project (CIP #PK020). The re-imagined project with expanded features is estimated to cost between $600,000 and $1,000,000. To fund the expanded project, the City intends to use the currently appropriated $350,000 in General Fund dollars and $208,707 in Proposition 68 grant funds (2420), should the City's application be approved. Additional funding sources to cover the remaining estimated gap are being evaluated by staff and will be presented to Council for their consideration in the near future. Once the application has been approved by the State, the City Manager or designee will appropriate the Prop 68 funds to the project. Should the Proposition 68 grant funds not be approved for any reason or additional funding sources not be identified to cover the remaining estimated gap, the City will need to evaluate funding options and scope to complete the project. SECTION 2: Certifies that said grantee has or will have available, prior to commencement of project work utilizing Per Capita funding, sufficient funds to complete the project(s). SECTION 3: Certifies that the grantee has or will have sufficient funds to operate and maintain the project(s). SECTION 4: Certifies that all projects proposed will be consistent with the park and recreation element of the City of Poway general or recreation plan (PRC §80063(a)). SECTION 5: Certifies that these funds will be used to supplement, not supplant, local revenues in existence as of June 5, 2018 (PRC §80062(d)). SECTION 6: Certifies that it will comply with the provisions of §1771.5 of the State Labor Code; SECTION 7: (PRC §80001 (b)(8)(A-G) To the extent practicable, as identified in the "Presidential Memorandum--Promoting Diversity and Inclusion in Our National Parks, National Forests, and Other Public Lands and Waters," dated January 12, 2017, the City of Poway will consider a range of actions that include, but are not limited to, the following: 4 of 11 (A) Conducting active outreach to diverse populations, particularly minority, low-income, and disabled populations and tribal communities, to increase awareness within those communities and the public generally about specific programs and opportunities. (E) Expanding the use of multilingual and culturally appropriate materials in public communications and educational strategies, including through social media strategies, as appropriate, that target diverse populations. (F) Developing or expanding coordinated efforts to promote youth engagement and empowerment, including fostering new partnerships with diversity-serving and youth-serving organizations, urban areas, and programs. (G) Identifying possible staff liaisons to diverse populations. SECTION 8: Agrees that to the extent practicable, the project(s) will provide workforce education and training, contractor and job opportunities for disadvantaged communities (PRC §80001 (b)(5)). SECTION 9: Certifies that the grantee shall not reduce the amount of funding otherwise available to be spent on parks or other projects eligible for funds under this division in its jurisdiction. A one-time allocation of other funding that has been expended for parks or other projects, but which is not available on an ongoing basis, shall not be considered when calculating a recipient's annual expenditures. (PRC §80062(d)). SECTION 10: Certifies that the grantee has reviewed, understands, and agrees to the General Provisions contained in the contract shown in the Procedural Guide. SECTION 11: Delegates the authority to the City Manager, or designee to conduct all negotiations, sign and submit all documents, including, but not limited to applications, agreements, amendments, and payment requests, which may be necessary for the completion of the grant scope(s). SECTION 12: Agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines.
