Schuler, Senior Civil Engineer 7}Q �l\ DATE: May 20 , 1986 Engineer* SUBJECT: Engineer' s Report and Resolution of Intention for the 1986-87 Budget for Landscape Maintenance District No. 83-1 BACKGROUND • At the June 14 , 1983 ,meeting, the City Council approved the • • formation of Poway Landscape Maintenance District No. 83-1 by resolution. The 1983-84 budget was also approved based upon the 1983-84 Engineer's Report. Subsequent budgets and Engineers Reports were approved for 1984-85 and 1985-86 . FINDINGS Based upon Section 22624 of the Streets and Highways Code, the City Council must approve an engineering report and adopt a resolution of intention prior to establishing a budget each year. The 1986-87 Engineer's Report, Exhibit B to Resolution, outlines the proposed 1986-87 budget and resulting assessments. The budget . shows a cash carryover of $77 , 000 for 1986-87 because none of the landscaping or sound wall facilities were accepted for maintenance in 1985-86. • • RECOMMENDATION • It is recoMmended that the City Council : • 1 . Resolution of Intention 2 of 7 MAY 2 0 1986 ITEM 12 •. • EXHIBIT B ENGINEER' S REPORT FOR POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 83-1 FOR 1986-87 FISCAL YEAR PURPOSE The purpose of this report is to set forth findings and enginering analysis for the Poway Landscape Maintenance Assessment District No. 83-1 for 1986-87 fiscal year. The Assessment District was formed June 14, 1983 as a means of financing the maintenance of landscape improvements installed in conjunction with new sub- divisions in Poway, the boundary being as shown in Exhibit A. FINDINGS The Landscaping and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvements which includes the • facilities existing within the subject assessment district. The ' 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: "The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements. " Based upon the foregoing, it is proposed the City of Poway generate the necessary revenue required to maintain the aforementioned land- scaping improvements with Landscape Maintenance Assessment District • No. 83-1 for the 1986-87 fiscal year using the method provided for in the Landscape and Lighting Act of 1972. ENGINEERING ANALYSIS Boundary The boundary of the proposed assessment district is as shown on Exhibit A with Rancho Arbolitos subdivision being the major portion of the District with 975 lots. The other component subdivisions • presently making up the District are Adobe Ridge I and II (formerly Poway Woods 1 and 2) , the Colonies (formerly Poway Hills) , and Casa Real Unit 7 . A small number of parcels that are zoned • commercial are subject to inclusion within the District when they are developed. The prospective commercial areas are shown on Exhibit A. • • ATTACHMENT 1 I S of 7. MAY 2 0 1986 ITEM 12 The District boundaries are included in the District, excepting from the assessment of said costs and expenses within the area , described, the area of all public streets , public avenues, public lanes , public roads, public drives, public courts , public alleys, all easements and rights of way, all public parks , greenbelts and parkways , and all public school property being used for public school purposes. NAME The District is entitled the "Poway Landscape Maintenance Assessment District No. 83-1 . " FACILITIES The facilities to be maintained are defined as the landscaping and soundwalls within the right of way and adjacent to Camino del Norte, Twin Peaks Road, Pomerado Road, and future Route 56; the recreational trails , sidewalks , and greenbelts within the District boundaries and 25% of the maintenance costs of all future parks within the District. EXISTING CONDITIONS OF LANDSCAPE MAINTENANCE WITH DEVELOPED SUBDIVISIONS OF DISTRICT • A general assessment of the present level and quality of landscape maintenance within subdivisions of the District having improved ' landscape development within public right of way has been recently conducted. Numerous deficiencies in plant care, weed control, and irrigation systems were found. Each of the respective subdivisions subdivisions will again be inventoried and evaluated to insure compliance with requested improvements to landscape maintenance prior to City acceptance of said developed areas into the Assessment District. Landscape maintenance and performance standards and specifications are currently being developed to assure a level of consistency and quality to landscape care of assessment district properties upon City acceptance. COMMERCIAL PROPERTIES PROPOSED FOR INCLUSION INTO DISTRICT In the immediate future , certain properties proposed for commercial development (see Exhibit A) will require portions of these properties within the public right of way to be included within the Assessment District. Currently, there is no landscape development on the properties . A concern of the City is how these properties will develop the public portion of their respective landscape areas and to what intensity. Typically, commercial properties will be larger lot sizes and consequently have a higher degree of landscape • improvements along the street edges bounding the commercial centers. Both market image and overall concern for attractiveness of the developed commercial site contribute to a greater level of land- _ scape enhancements in some cases. • - 2 - • 4 of 7 MAY 20 1986 ITEM 12 A potential does 410st for the need to provide differential assess- ment to commercial properties than residentia properties within the District. To provide some measure of uniformity in determination of future assessments to commercial properties within the District, the City should consider working with the respective owners of such pro- perties to establish master land-scape development criteria. An effort such as this could result in a general landscape development plan, specific to the commercial core, that would yield a consistent level of landscape development for said properties, provide a measure of visible unity to the overall landscape image of the District, and most importantly allow for the establishment of an equitable assessment. BENEFIT ANALYSIS The District is made up of five subdivisions: Adobe .Ridge Unit 1, 55 lots and Adobe Ridge Unit 2, 57 lots (formerly Poway Woods ) ; Casa Real Unit 7 , 68 lots; The Colonies of Poway, 30 lots (formerly Poway Hills) ; and Rancho Arbolitos, 975 potential lots; for a total of 1,185 lots . A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DECLARING THE INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN THE POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 83-1 FOR FISCAL YEAR 1986-87 WHEREAS, the City Council of the City of Poway, California desires to levy and collect assessments within Poway Landscape Maintenance Assessment District No. 83-1 for the purposes of maintaining, servicing and operating public landscape facilities located within the territory comprising said district as shown in Exhibit "A" , pursuant to the Landscaping and Lighting Act of 1972 ; and WHEREAS, the public interest and convenience requires the maintenance, service and operation of the public landscaping, soundwalls, recreational trails, and future parks within said territory. NOW THEREFORE, the City Council of the City of Poway does hereby resolve as follows: 1 . The foregoing recitals are true and correct and the City Council so finds and determines. 2. Proposed assessments for 1986-87 are as detailed in the "Engineer ' s Report" for Poway Landscape • Maintenance Assessment District No. 83-1 for 1986-87 fiscal year, Exhibit "B" . 3. Pursuant to the Streets and Highways Code, a public hearing will be held on June 3, 1986 in the City Council Chambers at City Hall to consider the levy and collection of the proposed assessments .
