DATE: September 2 , 1986 SUBJECT: Environmental Assessment and Zoning Ordinance Amendment, ZOA 86-05 - A City-initiated amendment to Chapter 17 .12 of Title 17 ( Zoning Development Code) of the Poway Municipal Code to allow motorcycle sales and repair as a conditional use in the Manufacturing Service zone. ABSTRACT The Zoning Development Code, under the commercial zone classifica- tion, allows for the sale and servicing of motorcycles with the approval of a Conditional Use Permit. However , the Code is silent regarding this land use in the manufacturing zones . Staff believes that consideration should be given to allow this land use as a "conditional use" in the Manufacturing Service (MS) zone . ANALYSIS Automobile- and truck-related services are presently restricted in the City of Poway to three zoning districts : the Commercial General (CG) , Commercial Community (CC) , and Manufacturing Service (MS) zones . These land uses are1allowed as a "conditional use" in the commercial zones , and are a "permitted" use in the Manufac- turing Service zone. The motorcycle sales and service land use is very similar to the automobile-related uses in regard to operational characteristics and compatibility with adjoiningizoning districts . This land use is allowed by conditional use permit in the CG and CC zones; however, it is presently not addressed in the manufacturing zone section of the Zoning Development Code. , i ACTION: Held first reading for Ordinance No. 194, and set second reading for September- 16, 1986. Wahlsten, City Clerk 1 OF b Agenda Report September 2 , 1986 Page 2 Staff is of the opinion that motorcycle sales and service, including motorized bicycles , should be allowed in the MS zone only by conditional use permit. The Manufacturing park (MP) zone is primarily intended as an area for modern industrial , research, and administrative facilities that can meet high-performance and development standards . Staff recommends that motorcycle-related uses be prohibited in the MP zone . Automobile-related uses are already expressly prohibited in the Manufacturing Park zone . The City' s MS zoning district iscurrently confined to the lands which front on Poway and Garden Roads in the vicinity of their intersection . These lands are surrounded by residential and com- mercial land uses and several vacant parcels . It is possible that a motorcycle-related land use could have potential adverse impacts on adjacent residential and commercial properties . Staff believes that the conditional use process will provide additional protection for adjacent properties . Based on the above analysis , Staff recommends that Section 17 .12 . 070 of the Zoning Development Code be modified as shown in the attached Ordinance. Environmental Review The proposed code amendment has been reviewed in terms of its environmental impacts . No significant negative impacts are expected as a result of its adoption. Further environmental review will be conducted in conjunction with future use permit and development review applications . Correspondence Notice of the public hearing regarding this amendment was published in the Poway News Chieftain . The Planning Services Department has received no responses regarding the proposed amendment . FINDINGS The proposed modification is consistent with the intent, and purpose of the General Plan and Zoning Development Code. 20F6 SEP2 1986 ITEM 12 • Agenda Report September 2, 1986 Page 3 RECOMMENDATION It is recommended that the City Council adopt the proposed Zoning Development Code amendment, issue a Negative Declaration, and set second reading for September 16 , 1986 . AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA AMENDING CHAPTER 17 .12 OF TITLE 17 ( ZONING DEVELOPMENT CODE) OF THE POWAY MUNICIPAL CODE WHEREAS , the City Council periodically finds it necessary to amend Title 17 ( Zoning Development Code) of its Municipal Code in response to changing conditions within the City; and WHEREAS, the City Council held a duly advertised public hearing to provide interested parties the opportunity to address the pro- posed amendments . Page 3 SECTION 3 : The City Council of the City of Poway hereby finds that this amendment will not cause significant adverse impacts on the environment and issues a Negative Declaration . EFFECTIVE DATE: This ordinance shall take effect and be in force thirty ( 30 ) days after the date of its passage; and before the expiration of fifteen ( 15 ) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspaper of general cir- culation published in the City of Poway.
