Wahlsten, City Clerk "al DATE: October 7, 1986 SUBJECT: Ordinance No. 198 - Second Reading BACK ND On September 30, 1986, the City Council introduced and had the first reading on Ordinance No. 198 - "An Ordinance of the City of Poway, California, Changing the Zoning Classification of Certain Property (ZC 86-02A) ." Changes made at the first reading were as follows: 1) property owners names and parcel numbers have been added; 2) an adjacent 0.29 acre parcel awned by George McRae, redesignated from Residential Single-Family 2 to Residential Apartment, has been included. FINDINGS It is in order to have the second reading and adopt this Ordinance. RECCM WATICN If the City Council desires to adopt, read title and waive further reading of Ordinance by unanimous vote. Wahlsten, City Clerk ` 1 of 3 OCT 7 1986 ITEM 8 ORDINANCE NO. 198 AN ORDINANCE OF THE CITY OF POWAY , CALIFORNIA CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY ( ZC 86-02A) WHEREAS , the City Council of the City of Poway has approved a General Plan Amendment (GPA 86-02A) amending the land use designa- tion for approximately 3 . 50 acred of property owned by Anthony J. Aviano and C. F. Poway, Ltd . (APN: 317-232-06 , 7, 8, 9 , and a por- tion of 5 ) , located at the northeast and northwest corners of the future intersection of Pomerado and North Loop Roads, from Residential Single-Family 2 ( 1-2idu/net acre) to Residential Apartment ( 12-20 du/net acre) and Open Space, and said amendment included an adjacent 0 . 29-acre parcel owned by George McRae (APN: 317-232-10 ) redesignated from Residential Single-Family 2 to Residential Apartment; and WHEREAS, the City Council finds that the zoning classification of that property should also be changed to maintain consistency with the General Plan as required by Section 65860 of the California Government Code; and WHEREAS, a properly noticed public hearing was conducted on September 16 , 1986 in accordance with Section 65853 , et seq. , of the California Government Code and the California Environmental Quality Act to consider this zone reclassification, and said hearing was continued to September 30 , 1986; and WHEREAS, the City Council finds that proposed Zone Change 86-02A will not result in any significant adverse impacts on the environment and hereby issues a Negative Declaration in accordance with the Law and Guidelines of the California Environmental Quality Act. NOW, THEREFORE, BE IT ORDAINED that the City Council does hereby amend the City of Poway Zoning Plan Map for the above described properties from Residential Single-Family 2 (RS-2 ) to Residential Apartment (RA) and Open Space (OS) . EFFECTIVE DATE: This ordinance shall take effect and be in force thirty ( 30 ) days after the date of its passage; and before the expiration of fifteen ( 15 ) days after its passage, it shall be published once with the names of members voting for and against the same in the Poway News Chieftain, a newspaper of general cir- culation published in the City of Poway.
