APN: 32`3-092-51 (Portion) BACKGROUND j A. Project Description `1 On April 29, 1986 the City Council returned to Staff the proposed Rdgeline/Hillside Ordinance for further study. During the interim period, Staff was also directed to continue to bring all Minor Development Review Applications for properties within the study area to the Council for review`. Mrs.. Mohling is requesting that the Council approve Minor Development Review Application 86-39 for the construction of an approximately 3,00 square foot single family residence with 19 attached three -car garage. The subject property is known as Lot of Rancho Las Lomas Estates. The proposed project complies with the setbacks, the height limit, and the lot coverage restrictions of the property development stan- dards of the PC and underlying RR -C zones. The surrounding groper - ties are under the same zoning designation as thesubject lot and are to be developed as single family residences similar to the pro- posed project. t ACTION: MAY 2 1986 1 T E M P 10F 7 1 Agenda Report May 27, 1986 Page 2. The proposed project complies with the spirit and guidelines of the proposed Ridgeline/Hillside Ordinance. The house design is a single story, California ranch style, and is situated on a graded level site created under an approved grading plan. B. Development Facilities Approval of the project will require improving the private dri- veway, the extension of public utilities, the payment of parkland ; dedication fees, drainage fees, traffic fees, and school impact C. Environmental Review The environmental impacts associated with the development of this _lot and others within Rancho Las Lomas were analyzed in the environmental impact report for TTM 4278 certified on July 27, 1982. No further environmental review is required. D. Correspondence Notice of •the public hearing has been sent to property owners adja- cent to the project prion to the hearing. FINDINGS The proposed development is consistent with the General Plan and the'-Zoning ordinance. No adverse impacts of an. aesthetic, safety, or architectural nature upon private properties will occur because rooflines, construction methods, materials, building locations, and elevations will be compatible with surrounding properties. The project meets the Zoning Ordinance criteria and encourages the orderly development of the City because itis similar to and will complement adjacent development, RECOMMENDATION It is recommended: that the City ;Council approve Minor Development Review Application 86-39 subject to conditions contained in the attached resolution. P- Y A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY CALIFORNIA APPROVING MINOR DEVELOPMENT REVIEW X36-39 ASSESSOR'S PARCEL NUMBER 323-092-51 (PORTION) WHEREAS, Minor Development Review 86-39,submitted by Faith Mohling` applicant, requests approval to construct a 3,400 square foot single family residence for the property located at 13775 Paseo Bonito in the Planned Community zone; and WHEREAS, on May 27, 1986, the City Council held, a hearing on . the above -referenced item. NOW, THEREFORE„ the City Council does hereby resolve as follows: Section 1: Findings: _ 1. That the proposed development is in conformance with the Poway General Plan 2) That the proposed development will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties. 3.` That the proposed _.development is in compliance with the Zoning ordinance, 4 That the proposed development encourages the orderly and harmonious appearance of structures and property_ within' the City. Section 2: Environmental Findings This project was included within the environmental impact report for Rancho Las Lomas (TTM 4278) certified on July 27, 1982. Section 3: City Council Decision: The City Council hereby approves Minor Development Review 86-39 subject to the following conditions: F 1. Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. a 2. This project must meet any applicable requirements related - to Ordinance No. 103 (street improvements, drainage fees, park fees, traffic mitigation fees) to the satisfaction of the Director of Public Services. t 3 of � 2 -- P i a MAY 2 7 1986 1 T E M s Resolution No. P- Page 2 3. The appropriate Building -Department approvals shall be received prior to initiation of construction. 4. School impact fees shall be paid at the time of issuance of building permits in accordance with Ordinance No. 184. Poway Planning Services should be contacted regarding this requirement. 5. All applicable construction standards pertaining to private driveway shall be in 'compliance with Municipal Code Section 17.0.8.19OP to the satisfaction of the Directors of Public and Planning Services. b. All created slopes over 5 feet in height shall be planted , _t with -ground cover, shrubs and trees in compliance with ! Ordinance Noe 77. 7. All newandexisting utilities shall be undergrounded.{ } 8. The applicant shall record a waiver agreeing not to oppose. the formation of landscape maintenance district and to pay a pro rata share of future landscaping maintenance costs for that portion'of Midland Road which falls within the boundaries of Rancho Las Lomas Estates subdivision. 9.
