A request for approval to construct a single family dwelling unit on a lot within the Ridgeline/Hillside Review Area. The lot is 'located at 16951 Old Coach Road in the RR -A (Rural Residential A) zone. APN: 278-321-01 BACKGROUND A Project Description and -Mrs, Silva are requesting the Council approve MDRA 86-07 and allow the construction of a one-story 3128 square foot single family dwelling unit on a 5.07 gross acre lot that is within the Ridgeline/Hillside Review area. The property is located approximately 1400 feet east of Old Coach Road. The applicants are also requesting the Council waive the requirement to underground J the existing utility lines and poles The architectural style is Spanish with red barrel tile roofing and. cream color stucco/walls. The proposed residence is one story with a maximum height of 21 feet. There are several problems associated with the development of this lot. A 30 foot wide, 1400 foot long private road and utility easement connects the lot to Old Coach Road. However., the existing driveway was not constructed within said easement. In addition, the applicants will need to install a water tank and may need to regrade the existing road, prior to Safety Services release of the building permit. ACTION: 1 Agenda Report June 17, 1986. Page 2 The applicants are living in a trailer on the site without City approval. Approval of this application will allow the applicants to submit a grading plan to Public Services and eventually submit -complete 'building plans to the Building Department. Issuance of a building permit, inspection of the trailer hook-ups and foundation will allow the City to grant a Temporary Use Permit. That permit r will legalize use of the trailer during construction of the dwelling unit. The proposed project complies with the requirements for _a waiver of the undergrounding of the existing utility lines and poles. The lot is in an area of predominantly overhead service. New poles will not be added as a result of the service, and the utilities will be installed underground from an existing pole to the proposed F residence. a Theproposedproject complies with the guidelines of the proposed Ridgeline%Hillside ordinance and the setback, the height limit, and the lot coverage restrictions of the property development standards of the -RR -A zone. The surrounding properties are under the same zoning designation as the subject site and are either developed with single family residences or undeveloped. -_ B. Development Facilities - Approval of the project will require improving the private drive- Approval the payment 'of park land dedication fees, drainage fees, school impact fees, and the constructionofa septic system and well. C. Environmental Review The project is categorically exempt from the provisions of the i California Environmental Quality Act, and an exemption will be filed with the County Clerk. D. Correspondence Notice of Hearing was sent to property owners adjacent to the pro- ! ject prior to the hearing. l 4 _ FINDINGS _ r The .proposed.development is consistent with the General Plan and the Zoning Ordinance. iso adverse impacts'of an aesthetic, safety, or architectural nature _upon private properties will occur because the roofline, theconstruction methods, the materials, building location, and the elevations will be compatible with surrounding properties. The project meets the Zoning Ordinance criteria and the Ridgeline/Hillside Policies of the General Plan. P- _ s A RESOLUTION OF THE CITY 'COUNCIL OF THE CITY OF POWAY CALIFORNIA r APPROVING MINOR DEVELOPMENT REVIEW 86-07 ASSESSOR'S PARCEL NUMBER 273-321-01. rj WHEREAS, Minor Development Review 86-07, submitted by Joseph and Linda Silva, applicants, requests approval to construct a`3,000 i ,a square foot single family residence for the property located at 4. 16951 Old CoachRoadin the Rural Residential A zone; and WHEREAS, it has been determined that the proposed projec.t.is -an area thaty predominantl contains over-headservice, and that new poles will not be added as a result of this development and that undergrounding of service is still required from existing poles to the future residence. WHEREAS, on June 17, 1986, the City Council held a hearing on the above -referenced item. NOW, THEREFORE, the City Council does hereby resolve as 4 ' follows: Section 1: Findings: s 1. That the proposed development is in conformance with the t Poway General Plan. 20 That the: proposed' -development -will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties.+ 3. That the proposed development is in compliance with the Zoning ordinance. 4. That the proposed development encourages the orderly and harmonious appearance of structures and property within F' the City. 5. That the necessary findings for waiving of the undergrounding of existing overhead utilities have been identified. - Section 2: Environmental Findings: This project is categorically exempt (Class 3) from the provi- sions of the California Environmental Quality Act. • { OF �1 OF � � JUN' 7 19u6 t Resolution No. P- Page 2 Section 3: City Council Decision: The City Council hereby approves Minor Development Review 86-07 subject to the following conditions 1. Within 30 days of approval, the applicant shall submit in writing that all ,conditions of approval have been read and understood. 2 This project must meet.any applicable requirements related to Ordinance No. 103 (street improvements, drainage fees, park fees, traffic mitigation fees) to the satisfaction of the Director of Public Services 3. The appropriate Building Department approvals shall be received prior to initiation of construction., 4. School impact fees shall be paid at the time of issuance of building permits in accordance with Ordinance No. 184. Poway Planning Services should be contacted regarding this requirement. 5. All applicable construction standards pertaining to private driveway shall be in compliance with Municipal Code Section 17.08.190P to the satisfaction of the Directors of Public and Planning Services 6.All created slopes over five feet in height shall be planted with ground cover, shrubs, and trees in compliance with Ordinance No. 77. 7. All new utilities shall be undergrounded. 8. The applicant shall record a deed covenant agreeing not to oppose an underground district and to pay a pro rata share of future undergrounding 9. A Class A fire retardant roof and an accessory water storage facility shall be installed to the satisfaction of the Director of Safety Services. 10 The accessory water storage facility and the condition of c the existing driveway shall comply with Safety Services requirements prior to building permit issuance. .'� t - Resolution No. P- Page 3 11. Should the driveway improvements from 'Old Coach Road to the property deviate from within the existing easement, the applicant shall provide the City within 90 days from the date of approval with proof that the necessary access easement has been acquired or, this approval shall become {' null and void. 12. The applicant shall meet all necessary conditions of approval for this permit so that a temporary use permit for use of a trailer- during 'construction of the dwelling F unit, can be issued.within 6 months of the date of approval of MDRA 86-07 or the approval is null and void.. { Extensions may be granted by the Director of Planning Services. _ l 13. In addition to the time limits specified in Conditions No. 10 and No. 11F this approval shall become null and void if building permits are not , issuedby June 17, 1987.'
