The property is. Located in an area covered by the "Mayor Topographical Features"map as identified.in-the Comprehensive Plan. ° On April 22, 1.985 the Council adopted Resolution No. P-85-019, the resolution required Council review for the construction of single- family residences located on parcels lying within the "Major Topographical, Features" area. The policies in the Comprehensive Plan and the: proposed policies and standards in the. Ridgeline/ Hillside Study report assist Staff with the evaluation of minor - development review applications." The proposed residence is a two-story house with an -attached three - car garage. The architectural style is California Ranch with pastel. stucco exterior finish and mission the roof. A more detailed set of architectural plans will be required prior to the plan check submittal. B. Discussion Mr. Wier has applied for a Minor Development Review and has pro- posed a change in the street alignment requirements of the original subdivision map. This change is requested in order to preserve a mature grove of Canyon Live Oaks. The grove is situated within.the right-of-way for the cul -du -sac which serves as access for Parcel 3. The suggested change would allow access from Parcel 3.°s southerly boundary. In addition, the portion of Oak Trail Court along the southern boundary of Parcel 2 is requested to be deleted. Access to Parcel 1 is proposed to be provided by a separate road along the western boundary of Parcel 4 (See attachment 6 ). FINDINGS The proposed development is consistent with the General Plan and the Zoning ordinance. There will beano adverse impacts of an aesthetic, safety, or architectural nature on adjoining public and private properties. Proposed changes in road access and driveway" positioning are more sensitive to the surrounding terrain (see Attachment 4). The project meets the Zoning ordinancecriteria and encourages the orderly development:of the City because it is s'imi® lar.to and complements adjacent development. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING MINOR DEVELOPMENT REVIEW 86-48 ASSESSOR'S PARCEL NUMBER 277-020-23 WHEREAS, Minor Development Review 86-48, subrnitted by Jerome Wier, applicant, requests approval to construct a 5,200 square foot single-family residence at 14960 Oak Trail Court, within an area identified on the "Major Topographical Features" Map, in the RR -A (Rural Residential A) zone; and WHEREAS, on September 2, 1986, the. City Council held the above -referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Findings: That the proposed development is in conformance Poway General Plan. That the proposeddevelopment will not have an adverse aesthetic, health,safety, or architecturally related impact upon adjoining properties. That the proposed development is in compliance with the Zoning Ordinance. That the proposed development encourages the orderly and. monious appearance of structures and property within the City: Section 2: Environmental Findings: The City Council finds that this project is categorically exempt from the California Environmental Quality Act, designated a minor structure. Section 3: City Council Decision: The City Council hereby approves Minor Development Review 86-48 subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. This project must meet any,'applicable requirements related to ordinance No*. 103 (street improvements, drainage fees, park fees, traffic mitigation fees) to the satisfaction of the,Director o'f'Public Services. 3. A landscape plan, to the satisfaction of. the Director of Planning Services and Director of Public Services, shall: be approved prior to building permit issuance. 4. All new utilities shall.be undergrounded. 5. The appropriate Building- Department approval's shall be received prior to initiation of construction. 6 All_ slopes over five feet in height shall be, planted with ground cover, shrubs, and trees to the satisfaction of the Directors of Planning and Public Services, 7. School impact fees shall be paid at the: time of seance of building permits in accordance with Ordinance No. 154., Poway Planning Services should be contacted regarding this requirement.. & All applicable construction.standards pertaining to pri— vate driveways shall be in compliance with Municipal Code . Section: 17.06.1,90P to the satisfactionof the Directors of ,, Public and Planning Services, 9.
