Archibald, Director of Public Services DATE:: January, 14, _1,985 SUBJECT': Johnson Annexation to Sewer Improvement District BACKGROUND ; i The boundaries of the City of Poway''s Sewer ImprovementDistrict are no coterminous" with the boundaries of the City of Poway. All properties. receiving sewer service must be included in said District. FINDINGS" 1) The Johnson property is not within the boundaries of the Sewer Improvement District (Attachment 1) 2) The legal description of the proposed annexation is as described in Attachment 2. 3) Project is exempt under, CEQA 15035.5 (Attachment 3). 4) The property owners have consented to the annexation (Attachment 4) and have paid the required fees. RECOMMENDATION It is recommended the City Council adopt the standard resolution, Attachment. 5, ordering the Johnson annexation to the Sewer Improvement District and authorize the City Clerk to make thee necessary filings required by law. RESOLUTION OF' AE: CITY COUNCIL OF THE CITY OF I-voIAY, CALIFORNIA ANNEXING TERRITORY TO THE SEWER IMPROVEMENT DISTRICT OF THE CITY OF PO.WAY ANNEXATION WHEREAS, the property described in Exhibit A requires sewer service; and WHEREAS,. property must be within the Sewer Improvement. District to receive sewer service; and WHEREAS, the City Council of the City of'Poway has reviewed and considered the annexation of the. property to: Sewer Improvement District of the. City of Poway. NOW, THEREFORE,, BE.IT RESOLVED: THAT - E 1. The territory to be annexed is as described in Exhibit A. 2., The conditions of annexation are: a.. The: payment of the sum.of $875.00 to the City of Poway for, the right: and use of all existing property, real and. personal of the Sewer Improvement District. { b. The payment of all costs of said annexation, including f: but not limited to advertising, engineering, and attorney's fees. 3. The inclusion of the territory in the Sewer Improvement District is in the best interest of the land owners and the City of Poway.` 4. The annexation has been reviewed pursuant to the provisions of } the California Environmental Quality Act, as amended, and the annexation is. a project that will not have a significant effect on the environment. The "Notice, of Exemption" supporting the findings is attached hereto as Exhibit. B. 5. No City tax split: shall occur due to this annexation. The property is within the corporate boundary of the City of Poway and the annexation is to an improvement district within the City. 6.. The annexation of the territory described in Exhibit A shall become effective immediately upon passage. of the Resolution.. } i 7. The City Clerk shall make the necessary filings required by law.
