Schuler, Senior Civil Engineer x DATE January 28, 1986 SUBJECT: Acceptance of Existing Irrevocable Offer to Dedicate Real Pro erty for Public Highway Purposes on Allah. Lane, South of Poway Road ABSTRACT On March 12, 1985, Hsu Lai Enterprises obtained CUP 84-18 for the construction of a 10,000 square foot automotive center on, .88 acres fronting Poway Road and Adah Lane. The conditions of this development require improvements to Adah Lane and the undergr.ounding of overhead utilities. In 1576, --an, Irrevocable Offer to Dedicate Public Right of Way was. executed by the owner on the east side of Adah Lane. It is necessary now to accept that offer of dedication to allow the safe, orderly improvement of Adah Lane and the undergrounding of the overhead utilities._ Staff recommends the acceptance of this irrevocable offer of dedication. BACKGROUND On November 17, 1977, Final Parcel Map 6561 was: recorded south of Poway, Road and east of Adah Lane.. An irrevocable offer of dedication of 30 feet of public right-of-way on Adah Lane was executed as a condition of that map. This offer was rejected by the County, but Section 7050 of the State Government Code provides that an offer of dedication shall remain open and may be accepted a, any time by the governing authority. ACTION. k SAN 2; 8 1986 1 T E 1 of r r AGENDA REPORT'- January 28, 1986 = Acceptance of Existing irrevocable Offer to Dedicate Real Property' for Public Highway Purposes on Adah Lane., South of Poway Road' Page,2 The property owned by Hsu Lai Enterprises is west of and- adjacent to PM 6561., The Conditional Use Permit granted to them requires that the west half of Adah: Lane be dedicated and improved to urban street standards: for a 401 road in a 60' right-of-way. In addition, the overhead utility lines along the future centerline of Adah Lane must be relocated and placed underground. If Hsu Lai's improvements are constructed entirely within. their 30' dedication, it will leave the easterly easement road separated from, Adah Lane by'six feet. The resin ing parallel roadways and adjacent- driveways on Poway Road would result in an unsafe and confusing A situation". In order to allow Hsu Lai to construct Adah Lane prQperly', creating 26 feet of new paved section and a single intersection with Poway Road, and to properly underground the overhead utilities, the City' must accept the outstanding-offer offer of dedication P g RECOMMENDATION I It is recommended that the City Council 'adopt the resolution accepting j the, offer to dedicate: a. portion of Adah Lane and direct its recordationlif .' Irrevocable Offer was not formerly accepted for public highway purposes by the County of San_Diego, and WHEREAS, the State of California Government Code Section 705G provides that an. offer of dedication shall remain open. and may be accepted at any time by the City Council of the City within which the real property is located at the time of acceptance, and WHEREAS, it is in the best-public interest of the City of Poway that said irrevocable offer of dedication. now be accepted for public highway purposes to coincide with the construction and improvement of Adah Lane. NOW THEREFORE, the City Council of the City of Poway does resolve, determine, and.order as; follows: 1.
