(Environmental. Status: Categorically exempt: from the environmental review process.) 13126 Quate Court. Staff Findings: Subject property is presently the site of a. fenced storage area. The parcel is at the southerly terminus of Quate Court, witha paved unnamed alley along the north property line and an unimproved flood control channel areaalong the south property line. Uses in the nearby vicinity include a rental storage. ,business on the 1.83 acre lot to the west, general commercial buildings to the north and east with open space (mostly drainage - creek) to the south. No other buildings in the area exceed two stories or approach the 35 foot height limitation.. The applicant is proposing a. structure with parking on the ground floor and two stories of building, above with a total height of- .38. feet.. - Staff feels theremay be some justification' for three stories, however, the requested 38 feet of height does not appear to be justified. The Zoning Administratorhas actedfavorably on a nuraber of requests which aIl-owed, a total of three stories but did not .exceed the 35 foot height Limitation.. Therefore, alternative designs and configurations should be carefully explored before rendering any final.- decision on this application. Staff addedthe variancerequest relatedto elimination of loading spaces since` the plot 'plan did not indicate said spaces. If -the Zoning Administrator can find ` justification, ' a conditionshould be included which would limit, onsite uses to those which do not normally require loading spaces. Effect: The effect of granting this. variance beforeaddressing concerns raised by staff would be to' render a. premature decision, and may establish. an undesirable precedent for similar future requests. Discussion: As granted, this will allow a structure not exceeding the per- mittedheight in the zone in which it is located. It will allow full utilization of a property that has been impacted by easements for flood control purposes and because of the various increased setbacks that must be maintainedfrom three sides of the property. The small car parking spaces are warrantedin that this is consistent with the growingtrend towards small cars in this country. Because of these exceptional circumstances and that this is necessary to allow reasonable development of this property, and further more due to the fact that this property is depressed below Poway Road andsubstantially removed from Poway, Road, it is determined that Goal 13, Policy 23 of the Poway Community Plan does not apply to this specific property. This would be an asset to the the. community and would' not be detrimental to any properties located in vicinity.
