called to order at 7:05 p.m. by Mayor Cafagna at the City Council Chambers, 13325 Civic

PRESENTATIONS
Mayor Cafagna presented a plaque to Jim Benson, founding Chairman and Chief
Executive Officer, and Richard Slansky, President and CFO of SpaceDev, a local Poway
business, commemorating the historic flights of SpaceShipOne on September 29 and
October 4, 2004.

Mayor Cafagna explained the procedures for Public Oral Communications. The following
people were present wishing to speak.

Lynne Floto, 14448 Range Park Road, Poway, spoke about the quantity of trees that had
been removed from Rattlesnake Creek and the lack of authorization by the property owner
to have the work done.
Ellwood Floto, 14448 Range Park Road, Poway, concerned about the Public Works crews
that came onto his property in order to remove trees and silt from the creek bed.
Gail Garland, 14933 Golden Sunset Court, Poway, submitted a portfolio of photos showing
engineering concerns with the Wagenbach project.
Dee Fleischman, 14428 Midland Road, Poway, stated she was concerned with the amount
of fill that is being brought in on the Creek Road site along with the affects it will have on
the wildlife and drainage. She requested that the property be closely monitored.

Motion by Deputy Mayor Emery and seconded by Councilmember Rexford to approve the
Consent Calendar Items 2 through 7.

Mayor Cafagna opened the public hearing and read the title of Ordinance No. 618, entitled
"An Ordinance of the City of Poway, California, to set Speed Limits on Twin Peaks Road
between Pomerado Road and Community Road as set forth in Section 10.32.010 of the
Poway Municipal Code." This item was continued from January 25, 2005, Item #1.

No one was present wishing to speak on this public hearing.
Motion by Councilmember Rexford, seconded by Deputy Mayor Emery to close the public
hearing and adopt Ordinance No. 618, entitled: "An Ordinance of the City of Poway,
California, to Set Speed Limits on Twin Peaks Road between Pomerado Road and
Community Road as set forth in Section 10.32.010 of the Poway Municipal Code." Motion
carried unanimously.

Council member Rexford disqualified herself due to a potential conflict of interest.
Assistant City Manager Riley provided the staff report. This is a request to modify a
Development Review Permit and a Lighting Exemption Permit to replace existing low-
pressure sodium light fixtures at the SYSCO business located at 12180 Kirkham Road with
high-pressure sodium light fixtures. The request is to promote pedestrian and vehicle
safety in the truck loading/staging area during nighttime operations. Staff is recommending
that Council deny the high-pressure sodium light fixtures and to install additional low-
pressure sodium lights at strategic locations in the truck staging area on the main building
and the fuel/maintenance building, as well as new low pressure sodium pole lights along
the periphery of the lot to increase illumination and visibility.

The following member of the public spoke in opposition to the recommendation:
Rich Friedlen, President and CEO of SYSCO, 12180 Kirkham Road, proposed a 90-day
trial for the high-pressure sodium lights. Mr. Friedlen stated that the current lighting is a
safety hazard for the employees that work nights in the truck loading/staging area.

Council discussed the proposed lighting and the impacts it may have on the Palomar
Observatory
Motion by Mayor Cafagna, seconded by Councilmember Boyack, to continue the item to
March 1, 2005, to allow staff time to research what affects high-pressure sodium lights may
have on the Palomar Observatory. Motion carried 4/0 with Councilmember Rexford
disqualified.

QUARTERLY ENCAMPMENT REPORT
FOURTH QUARTER 2004
Assistant City Manager Riley presented a status report concerning illegal encampment
activities for October through December 2004.
Council concurred to receive and file the report.
MAYOR AND CITY COUNCIL-INITIATED ITEMS
12A. Councilmember Boyack requested that the City develop a Historical Marker
Program to help preserve the history of the City with the assistance of the Historical
Society.
13. Councilmember Rexford announced that the JPA Riverpark is looking for volunteers
to work the trails in Poway and Rancho Bernardo.
15. Deputy Mayor Emery provided a review of the Sidewalk Sundae & Soda Shop
located in Old Poway Park.
Deputy Mayor Emery also presented a sample of the Historic 395 signs to be
installed on portions of Pomerado Road.
16A. Mayor Cafagna requested and received Council concurrence to appoint Roger
Covalt to the Parks and Recreation Committee, Carrie Faye and June Baugh to the
Community Fine Arts Advisory Committee, and Lois Fong-Sakai and Steve Storr to
the Redevelopment & Housing Advisory Committee as nominated by
