Bowersox, City Mana~ Niall Fritz, Director of Development services' March 15, 2005 INITIATED BY: DATE: SUBJECT: Temporary Use Permit 05-07, City of Poway Community Services Department, Applicant ABSTRACT This is a request for a Temporary Use Permit to hold the Annual Earth/Arbor Day Celebration at Old Poway Park, located at 14134 Midland Road, on Saturday, April 9, 2005, from 9:00 a.m. to 2:00 p.m. The event will feature the standard flower show, live musical entertainment, children activities, arts and crafts, wildlife displays, food booths, and a mountain bike ride through the Poway trail system. Section 17.26.030.A of the Zoning Ordinance requires that all outdoor entertainment events be reviewed and approved by the City Council through a Temporary Use Permit. ENVIRONMENTAL REVIEW This proposed project is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no permanent effects on the environment. FISCAL IMPACT None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE The Annual Earth/Arbor Day Celebration will be publicized through distribution offlyers and posters. RECOMMENDATION It is recommended that the City Council approve Temporary Use Permit 05-07, subject to the conditions contained in the attached proposed Resolution. The event will include the standard flower show, live musical entertainment, children's activities, arts and crafts, wildlife displays, food booths, and a mountain bike ride through the Poway trail system. Pursuant to Section 17.26.030.A of the Poway Municipal Code, circuses, carnivals, rodeos, parades, or similar outdoor entertainment or enterprises which do not exceed 5 calendar days of operation in any calendar year may be approved with a Temporary Use Permit. FINDINGS The event will be open to the public. Notice of the event has been provided to adjacent residents. As in past events, parking is controlled by parking attendants who will also assist in directing traffic. There will be convenient signs posted giving directions to other parking sites when lots are full. Specific conditions and requirements have been 20f7 March 15, 2005 Item # 0, Agenda Report March 15, 2005 Page 2 established for the annual Earth/Arbor Day Celebration event as listed in the proposed Resolution (Attachment A). P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 05-07 TO HOLD THE ANNUAL EARTH/ARBOR DAY CELEBRATION WHEREAS, Temporary Use Permit 05-07; City of Poway Community Services Department, Applicant, requests approval to hold the Annual Earth/Arbor Day Celebration at Old Poway Park, located at 14134 Midland Road, on Saturday, April 9. 2005, from 9:00 a.m. to 2:00 p.m.; and WHEREAS, on March 15, 2005, the City Council considered the above- referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows: Section 1: The City Council finds that Temporary Use Permit 05-07 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no effects on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 05-07, the Annual Earth/Arbor Day Celebration at Old Poway Park, located at 14134 Midland Road, on Saturday, April 9, 2005, from 9:00 a.m. to 2:00 p.m., subject to the following conditions: A. The event and related off-site parking shall be conducted as shown on the site plan and application on file in the Development Services Department. B. This permit is valid during the hours of 9:00 a.m. to 2:00 p.m. on Saturday, April 9, 2005. after which time the site shall be restored to its original condition. C. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. D. The site shall be developed in accordance with the approved site plan on file in the Development Services Department, Planning Division, except as otherwise provided herein. E. Prior to the event, the applicant shall comply with the following: 40f7 ATTACHMENT A March 15,2005 Item # ~ Resolution No. P- Page 2 1. The following City of Poway Departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Community Services, Customer Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Sheriff's Department. 2. Obtain a permit from the San Diego County Health Department if food will be sold. 3. Obtain a permit from the Fire Department for any canopy that exceeds 400 square feet. 4. All proposed signs shall be approved by the Development Services Department, Planning Division, and shall be in accordance with Section 17.40 of the Poway Municipal Code. F. During the event, the applicant shall comply with following: 1. Do not block emergency vehicle access to any street, building, fire hydrant or fire sprinkler connection. 2. Provide at least one (1) fire extinguisher with a minimum rating of 2A 10 BC at any booth where food is prepared. 3. All compressed gas cylinders must be secured from falling over. G. At the conclusion of the event, the applicant shall comply with the following: 1. Public streets, off-street parking sites, and areas within and adjoining the proposed area for the event shall be cleared of debris. litter, temporary signs and all other evidence of the event. Section 4: 5:00 p.m., condition.
