Eckis, General Coun~ c: May 3, 2005 AGENDA REPORT SUMMARY TO: FROM: INITIATED BY: SUBJECT: Real Property Ownership Disclosure Report Health & Safety Code Section 33130.5 ABSTRACT Health & Safety Code Sections 33130 and 33130.5 generally provide that no Redevelopment Agency officer or City employee who participates in the formulation of plans or policies for redevelopment of the project area shall, after assuming office, acquire any real property interest in the project area, except for a personal residence and other specified interests. If a personal residence is acquired, disclosure is required. As of the date of this report, no real property interests subject to Health & Safety Code Sections 33130 or 33130.5 are owned by any officers or employees covered by these sections, except David Narevsky, Redevelopment Manager. His property was disclosed in 1993, in accordance with law. ENVIRONMENTAL REVIEW None required. FISCAL IMPACT None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE None. RECOMMENDATION It is recommended that the Agency Board receive and file this report and that its findings be noted in the minutes of this meeting. Eckis, General Cou~ DATE: May 3,2005 SUBJECT: Real Property Ownership Disclosure Report Health & Safety Code Section 33130.5 BACKGROUND Health & Safety Code Sections 33130 and 33130.5 generally provide that no Redevelopment Agency officer or City employee who participates in the formulation of plans or policies for redevelopment of the project area shall, after assuming office, acquire any real property interest in the project area, except for a personal residence and other specified interests. If a personal residence is acquired, disclosure is required. When Agency Member Boyack recently assumed office, she disclosed that she owned a home in the project area purchased years before her election. Agency Member Emery has also disclosed at various times during his service that he has owned a home in the project area prior to creation of the project area. Technically, compliance with Section 33130.5 did not require these disclosures since both acquisitions occurred before assuming office. Similarly, City Planner, Patti Brindle, a City employee who participates in the formulation of plans and policies for the project area, acquired a home in the project area before she began working for the City. David Narevsky, Redevelopment Manager, acquired a personal residence located in the project area in 1993, after he was employed by the City, and complied with the disclosure laws at that time. General Counsel has requested of staff covered by these sections, that they advise him if they own any real property interests in the project area, and, if so, when they were acquired.
