Schuler, Senior Civil Engineer DATE: May 20, 1986 SUBJECT: Formation of Poway Landscape Maintenance Assessment District No. 86-2, Engineer's Report, and Resolution of Intention for the 1986.87 Budget BACKGROUND The Sunrise Ranch subdivision, which includes 35 residential lots (Tract 4185R), will have, when fully developed, landscaped areas adjacent to and within view of Poway Road. It is the desire of both the City and the developer to have a high quality appearance maintained after the installation is completed. The implementation of the LMD will insure City control of the level of maintenance at an appropriate level without additional burden on the City's General Fund. The boundaries of the LMD (Attachment 1) will encompass all of Tract 4185R. The Engineer's Report delineates the anticipated costs to the LMD for the 1986-87 budget. I04011116VOM 1. Because of the landscaping improvements required as part of the approval for the subject subdivision, the City will be required.to maintain them in the future. In addition, several trails are proposed within the Sunrise Ranch development, which will be developed and turned over to the City for maintenance. The proposed landscape maintenance assessment district will generate sufficient revenue to offset the City's maintenance costs within the District. 3. The City has received the consent of all the property owners within the proposed District (Attachment 5). 4. Based upon Section 22624 of the Streets and Highways Code, the City Council must approve an Engineer's Report and adopt a Resolution of Intention prior to establishing a budget each year. The 1986-87 Engineer's Report, Exhibit B to resolution, outlines the proposed 1986-87 budget and resulting assessments. RECOMMENDATION It is recommended that the City Council: 1. Adopt the attached resolution (Attachment 2) establishing Poway Landscape Maintenanc District No. 86-2. 2. Approve the Engineer's Report (Attachment 3) establishing the 1986-87 District budget. 3. Adopt the attached resolution (Attachment 4) calling for a public hearing at the June 3, 1986 regular meeting and declaring an intention to levy and collect assessments within Poway Landscape Maintenance Assessment District No. 86-2. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, SAN DIEGO COUNTY, CALIFORNIA, ORDERING THE FORMATION OF POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 86-2 WITH WRITTEN CONSENT OF ALL PROPERTY OWNERS WHEREAS, the City Council of the City of Poway, California, desires to form Poway Landscape Maintenance Assessment District No. 86-2, for the purposes of maintaining, servicing, and operating public landscape facilities located within the territory comprising said District as shown in Exhibit "A", pursuant to the Landscape and Lighting Act of 1972; and WHEREAS, the record owner of all of the real property within said territory has given written consent to the proposed formation pursuant to California Streets & Highways Code Section 22608.1; and WHEREAS, the public interest and convenience require the maintenance, service and operaiton of public landscape facilities within said territory. NOW, THEREFORE, the City Council of the City of Poway does hereby resolve as follows: 1. The foregoing recitals are true and correct and the City Council so finds and determines. 2. All of that certain territory described in Exhibit "A" attached hereto is hereby formed into Poway Landscape Maintenance Assessment District No. 86-2. 3. Wahlsten, City Clerk - ,- -- -- 4TTACHMENT 2 MAY 20 1986 Mai ftp A 4 of 1 FXNTRTT R ENGINEER'S REPORT FOR POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 86-2 FOR 1986-87 FISCAL YEAR PURPOSE The purpose of this report is to set forth findings and enginering analysis for the Poway Landscape Maintenance Assessment District No. 86-2,for 1986-87 fiscal year. The Assessment District was formed "May 20, 1986. as a means of financing the maintenance of landscape improvements installed in conjunction with new sub- divisions in Poway, the boundary being as shown in Exhibit A. FINDINGS The Landscaping and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvements which includes the facilities existing within the subject assessment district. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: - "The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." Based upon the foregoing, it is proposed the City of Poway generate the necessary revenue required to maintain the aforementioned land- scaping improvements with Landscape Maintenance Assessment District No. 86-2 for the 1986-87 fiscal year using the method provided for in the Landscape and Lighting Act of 1972. ENGINEERING ANALYSIS Boundary The boundary of the proposed assessment district is as shown in Exhibit A with Sunrise Ranch Tract 4185R being the present full extent of the district with 35 lots. The district boundaries are included in the district, excepting from the assbssment of said costs and expenses within the area described, the area of all public streets, public avenues, public 'lanes, public roads, public drives, public courts, public alleys, all easements and rights of way, all public parks,-•-greenbelts-and parkways, and all public school property being used for public school purposes. None of the facilities are presently in place. BENEFIT ANALYSIS The District is made up of 35 residential lots in Sunrise Ranch, Tract 4185R.
