ABSTRACT Pursuant to requirements of the Integrated Waste Management Act (AB939), the County of San Diego has prepared the Countywide Integrated Waste Management Summary Plan and Countywide Siting Element for San Diego County. The majority of cities representing a majority ofthe incorporated population must approve the Plan within 90 days. Staff recommends that the City Council, after considering public comments, adopt the proposed resolution approving the Plan. ENVIRONMENTAL REVIEW A previously issued Negative Declaration by the County of San Diego for the adoption of the Countywide Integrated Waste Management Summary Plan and Countywide Siting Element adequately addressed the potential environmental impacts associated with the adoption of the attached resolution. No additional environmental review is necessary. FISCAL IMPACT None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE None. RECOMMENDATION It is recommended the City Council adopt the proposed resolution. BACKGROUND On December 10, 1996 the Poway City Council adopted Resolution No. 96-123 approving the first Countywide Integrated Waste Management Summary Plan and Siting Element. On June 25, 1997 the California Integrated Waste Management Board (CIWMB) approved San Diego County's Countywide Integrated Waste Management Plan, Siting Element, and Summary Plan. Per Public Resources Code Section 41770, the Countywide Siting Element must be reviewed and revised, if necessary, every five years. The Local Task Force, administered by SANDAG, determined an update of the Countywide Siting Element was warranted due to a number of changes since its adoption, including divestiture of the county landfills to private ownership in 1997. The County began the process of review and revision in 2002. On January 23,2004 SANDAG, in its role as the AB 939 Local Task Force, voted unanimously to recommend that the revised Summary Plan and Siting Element be distributed to the cities and county for formal adoption. FINDINGS The updated Countywide Summary Plan contains goals and policies and a summary of integrated waste management issues facing the County. It summarizes waste management programs developed by the jurisdictions within the county to meet the AB 939 fifty percent (50%) waste reduction mandate. It also suggests steps needed to cooperatively implement and administer specific programs regionally or Countywide. The Countywide Siting Element contains all AB 939 descriptions of existing facilities and strategies for the region to provide fifteen (15) years disposal capacity. The Siting Element demonstrates that there are at least fifteen (15) years of remaining disposal capacity using a combination of several integrated waste management strategies to serve all the jurisdictions within the County. The County of San Diego points out in its cover letter that the Siting Element seryes as a guidance document, rather than a specific development program. Wh ile the Siting Element discusses new 2 of 7 April 26, 2005, Item # \ Resolution Approving and Adopting the Fnal Draft Countywide Summary Plan and Siting Element Page 3 April 26, 2005 landfills and landfill expansion, it does not advocate or guarantee approval of facilities by any agency or jurisdiction. Each proposal for a new or expanded solid waste facility must be reviewed separately through local land use approval and state permitting procedures. Before the County can submit the Summary Plan and Countywide Siting Element to the State, they must be adopted by a majority of the cities representing a majority of the incorporated population within ninety (90) days of receipt. County of San Diego Notice of Determination 30f7 April 26, 2005, Item # I RESOLUTION NO. 05 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING AND ADOPTING THE FINAL DRAFT COUNTYWIDE SUMMARY PLAN AND COUNTYWIDE SITING ELEMENT WHEREAS, the California Integrated Waste Management Act of 1989, hereinafter referred to as "the Act," requires each county and the incorporated cities in the county to develop and implement integrated waste management plans; and WHEREAS, Public Resources Code Sections 41750 through 41770 require each county to prepare a Countywide Integrated Waste Management Plan (CIWMP) that identifies the significant waste management issues; and WHEREAS, the purpose of the Plan is to identify specific actions that must be taken by local jurisdictions to implement programs and activities designed to meet the goals of the Act; and WHEREAS, this Plan consists of a Source Reduction and Recycling Element, a Household Hazardous Waste Element, and a Nondisposal Facilities Element which have previously been prepared and adopted by each jurisdiction in the County of San Diego (County); and WHEREAS, the final two components of the CIWMP, a Countywide Summary Plan and Countywide Siting Element, have been developed by the County in cooperation with all local jurisdictions and in conformance with the Act; and WHEREAS, said Act requires that the Countywide Summary Plan and Countywide Siting Element shall be approved by a majority of the cities within the County which contain a majority of the population of the incorporated area of the County, and by the County; and WHEREAS, the Countywide Summary Plan and Countywide Siting Element were approved by the Integrated Waste Management Task Force/Local Task Force on January 23, 2004; and WHEREAS, Negative Declaration Number SCH 2004041115 was prepared by the Environmental Services Unit of the County of San Diego Department of Public Works in accordance with the California Environmental Quality Act (CEQA) for the purpose of approving and adopting the Countywide Summary Plan and Countywide Siting Element. Find that the above recitations are true and correct; 2. Find that the Negative Declaration Number SCH 2004041115 (on file in the City Clerk's Office) reflects the independent judgment of the City Council of the City of Poway and satisfies the requirements of the CEQA; 3. Adopt Negative Declaration Number SCH 2004041115 for the purpose of adopting the Countywide Summary Plan and Countywide Siting Element; 4. Adopt and approve the Countywide Summary Plan and Countywide Siting Element (on file in the City Clerk's Office); and 5. Approve that the County of San Diego shall submit the Countywide Summary Plan and Countywide Siting Element to the California Integrated Waste Management Board for consideration of final approval on behalf of the City of Poway.
