ABSTRACT
This is a request for a Temporary Use Permit to hold the Annual Old Fashioned Fourth of July
Celebration at Old Poway Park, located at 14134 Midland Road, from 10:00 a.m. to 4:00 p.m. on
Monday, July 4, 2005. The free event will include live musical entertainment, vendor displays and a
mock gunfight. Section 17.26.030.A of the Zoning Ordinance, requires that all outdoor entertainment
events be reviewed and approved by the City Council through a Temporary Use Permit.
ENVIRONMENTAL REVIEW
Temporary Use Permit 05-32 is exempt from the provisions of the California Environmental Quality
Act (CEQA), as a Class 4 Categorical Exemption, pursuant to Section 15304(e) of the CEQA
Guidelines.
FISCAL IMPACT
None.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
The Annual Old Fashioned Fourth of July Celebration at Old Poway Park will be publicized through
distribution of flyers and posters.
RECOMMENDATION
It is recommended that the City Council approve Temporary Use Permit 05-32, subject to the
conditions contained in the attached proposed Resolution.

BACKGROUND
This is a request for a Temporary Use Permit to hold the Annual Old Fashioned Fourth of
July Celebration at Old Poway Park, located at 14134 Midland Road, from 10:00 a.m. to
4:00 p.m. on Monday, July 4,2005. The free event will include live musical entertainment,
vendor displays and a mock gunfight. Section 17.26.030.A of the Zoning Ordinance,
requires that all outdoor entertainment events be reviewed and approved by the City
Council through a Temporary Use Permit.
FINDINGS
Approximately 4,000 attendees are expected throughout the day. Notice of the event will
be provided to adjacent residents. As in past events, parking is controlled by parking
attendants who will also assist in directing traffic. Patrons will be directed to park in the
City lot located on Aubrey Street, at the Farmer's Market lot, and a vacant lot located
across the street from Old Poway Park on Midland Road. There will be convenience signs
posted giving directions to other parking sites when the lots are full. Specific conditions

and requirements have been established for the Annual Old Fashioned Fourth of July
Celebration as listed in the proposed Resolution (Attachment A).

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 05-32
WHEREAS, Temporary Use Permit 05-32; City of poway Community Services
Department, Applicant, requests approval to hold the Annual Old Fashioned Fourth of
July Celebration at Old Poway Park, located at 14134 Midland Road, from 10:00 a.m. to
4:00 p.m. on Monday, July 4, 2005; and

WHEREAS, on June 7, 2005, the City Council considered the above-referenced
NOW, THEREFORE, BE IT RESOLVED by the City of Poway as follows:
Section 1: The City Council finds that Temporary Use Permit 05-32 is exempt from
the provisions of the California Environmental Quality Act (CEQA), as a Class 4
Categorical Exemption, pursuant to Section 15304(e) of the CEQA Guidelines.
Section 2: The proposed use is in accordance with the purposes and standards of
Section 17.26.030.A of the Poway Municipal Code.
Section 3: The City Council hereby approves Temporary Use Permit 05-32, The
Annual Old Fashioned Fourth of July Celebration at Old Poway Park, located at 14134
Midland Road, from 10:00 a.m. to 4:00 p.m. on Monday, July 4, 2005, subject to the
following conditions:
A. The event and related off-site parking shall be conducted as shown on the site
plan and application on file in the Development Services Department.
B. This permit is valid for Old Poway Park during the hours of 7:00 a.m. to 5:00 p.m.
on Monday, July 4, 2005, after which time the site shall be restored to its original
condition.
C. Approval of this activity shall not excuse compliance with all other Sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.
D. Prior to the event, the applicant shall comply with the following:
1. The following City of Poway departments shall be contacted for
appropriate permits, coordination, and inspections: Public Works,
Community Services, Development Services (including the Building,
Traffic Engineering, and Planning Divisions), Safety Services, and the

Sheriff's Department. The San Diego County Health Department shall
also be contacted.
2. All proposed signs shall be approved by the Development Services
Department, Planning Division, and shall be in accordance with Section
17.40 of the Poway Municipal Code.
E. The applicant shall comply with the following to the satisfaction of the Fire
Marshal:
1. Prior to and during the event, do not block emergency vehicle access to
any street, building, fire hydrant, or fire sprinkler system connection.
2. Obtain a permit from the Fire Department for any tent that exceeds 200
square feet or for any canopy that is over 400 square feet.
3. Provide at least one fire extinguisher with a minimum rating of 2A10BC at
any booth where food is cooked or warmed.
4. All compressed gas cylinders shall be secured from falling over.
F. At the conclusion of the event, the applicant shall comply with the following:
1. Public streets, off-street parking sites, and areas within and adjoining the
proposed area for the event, shall be cleared of debris, litter, temporary
signs, and all other evidence of the event shall be removed upon its
completion.
Section 4: This approval shall become null and void on July 4,2005, at 10:00 p.m., at
which time the site shall have been restored to its original condition.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 7th day of June 2005.
