The May 24, 2005, Regular Meeting of the City Council of the City of Poway, was
called to order at 7:03 p.m. by Mayor Cafagna at the City Council Chambers, 13325 Civic
Center Drive, Poway, California.

(SDCWA) gave a PowerPoint presentation regarding the development of a Regional

Mayor Cafagna explained the procedures for Public Oral Communications.
Jim Dakis, 1227 Wellesley Avenue, Los Angeles, representing his mother Sophia Dakis,
expressed concerns with the process of obtaining a clearing permit to remove the weeds on

Mayor Cafagna opened the public hearing and read the title of Ordinance No. 619, entitled:
"An Ordinance of the City of Poway, California, Approving Zone Change (ZC) 05-01 to
Change the Zoning Designation on an Approximate 0.2-Acre Portion of the Site Located at
the Southwest Corner of Community Road and Hilleary Place from Commercial Office to
Residential Apartment. Assessor's Parcel Numbers 317-101-25 and 26;" and the title of
Ordinance No. 620, entitled: "An Ordinance of the City of Poway, California, Approving
Specific Plan (SP) 05-01 for an Affordable Housing Project located at the Southwest Corner
of Community Road and Hilleary Place from Commercial Office to Residential Apartment,
Assessor's Parcel Numbers: 317-101-24 and 25." This continued hearing is also for the
approval of General Plan Amendment (GPA) 05-01, Development Review (DR) 05-05,
Development Review (DR) 05-06 and Variance (VAR) 05-01. This item was continued from
May 17, 2005, Item #2.

Mayor Cafagna opened the public hearing. City Manager Bowersox gave the staff report.
This is an update to the conditions of approval for the existing telecommunications facility for
Verizon on the Pomerado water tank located at 12700 Sagecrest Drive, east of Pomerado
Road and north of Twin Peaks Road. No changes are proposed for the use. The conditions
to be updated include provisions for annual review, MPE Reports, interference liabilities and
requirement to remove equipment upon ceasing operation. Since the facility already exists
and no complaints have been received, there are no issues with the existing use. Staff
recommends approval.
There was no one present wishing to speak on this item.
Motion by Deputy Mayor Emery, seconded by Councilmember Rexford, to close the public
hearing and adopt Planning Resolution No. P-05-39, entitled: "A Resolution of the City
Council of the City of Poway, California Approving Conditional use Permit 96-09M Assessor's

Mayor Cafagna opened the public hearing. City Manager Bowersox gave the staff report.
This is a request for a Conditional Use Permit to install a telecommunications facility on a
developed residential property. The facility consists of nine 11-foot-high poles that will hold
panel antennas. The subject property is located in the Rural Residential A (RR-A) zone at
12601 Cobblestone Creek Road. The antennas will not be readily visible to the public. There
are currently two other approved telecommunications facilities at this location for Sprint and
Nextel. Staff recommends approval of the project.
The following people were present wishing to speak:
Marcie Brown, 2362 McGaw Avenue, Irvine, representing Delta Groups Engineering for
Verizon Wireless, provided an overview of the project.
Tom Farley, 12601 Cobblestone Creek Road, stated he had met with his neighbors and
everyone is in agreement with the proposed telecommunications facility.
Motion by Deputy Mayor Emery, seconded by Council member Higginson to close the public
hearing and adopt Planning Resolution No. P-05-40, entitled: "A Resolution of the City
Council of the City of Poway, California Approving Conditional Use Permit 05-02 Assessor's
Parcel Numbers 316-063-02" as conditioned. Motion carried unanimously.

This item was scheduled as a public hearing, however with Millennium Housing withdrawing
from the purchase of Poway Royal Estates on May 18, 2005, staff is recommending that
Council receive public testimony, close the public hearing and remove the item from the
Agenda.

Mayor Cafagna opened the public hearing. City Manager Bowersox gave the staff report.
This is a request to modify a condition of approval for the existing Country Montessori School
located at 12642 Monte Vista Road, within the Commercial Office (CO) zone. On June 4,
2002, the City Council approved the addition of a new modular classroom and increased the
enrollment capacity by 30 students. The approval included a condition that the school
develop a business plan to replace all of the temporary structures on the site with permanent
building. This plan was to be in place by June 4, 2005. The school has made significant
progress, but is requesting an additional year to identify funding sources to complete the
construction. Staff is recommending approval of a one-year time extension to June 6,2006.

Motion by Councilmember Boyack, seconded by Councilmember Rexford to close the public

QUARTERLY ENCAMPMENT REPORT
FIRST QUARTER 2005
City Manager Bowersox presented a status report on illegal encampment activities for the first
quarter of January through March 2005. Councilmember Boyack requested staff watch the
area west of Meadowbrook School for possible encampments.
Council concurred to receive and file the report.

MOSQUITO, VECTOR & DISEASE
CONTROL ASSESSMENT
COUNTY OF SAN DIEGO
City Manager Bowersox presented the staff report. The San Diego County Vector Control
Program has been providing mosquito and vector control services and public health protection
services in San Diego County for over 30 years. San Diego County is proposing a benefit
assessment that would add $8.80 per year to the existing service charge for a total of $11.08
per single-family residential parcel, per year. Proposition 218 requires all parcels receiving
benefit must pay the assessment, including public properties. Staff is recommending
authorization for the City Manager to complete the official ballots on behalf of the City of
Poway for the parcels it owns in favor of the proposed assessment.
Motion by Deputy Mayor Emery, seconded by Councilmember Higginson, authorizing the City
Manager to complete the ballots. Motion carried 3-2 with Councilmember Rexford and Mayor
Cafagna voting "no".
MAYOR AND CITY COUNCil-INITIATED ITEMS
15. Councilmember Rexford requested that a right-turn lane be considered at some time in
the future at the intersection of Community Road and Metate Lane; gave a brief review
of the ICS Conference and Contract Cities Conference she recently attended.

17 A. Deputy Mayor Emery provided a restaurant review on Daphne's Restaurant.
17B. Deputy Mayor Emery announced that the Green Line of the Trolley would be opening
on July 8, 2005 with free rides all day on July 9th. This line will make a loop from
Santee to downtown San Diego making this a complete system.
