SUBJECT: Ordinance Amending Weed Abatement Regulations
Section 35.404 of the Weed Abatement Regulations, entitled, "Notice to Clean
premises, " currently states that, "...lots of two acres or more to have main-
tained a thirty -foot fire break." There are situations where a wider break is
necessary based. on the height, type and density of available fuel. The City
Attorney has prepared an amendment which gives the Director of Safety Seravices
the discretion to require breaks up to 100 feet wide (see attached).
FINDINGS
1. Thirty feet is considered ,a minimum fire 'break width.
2 When the vegetation is tall, the intensity of a burn is greater, • requiring a
wider break for safety,
3. The Director of Safety Services needs the discretion to require a break
wider than the minimum.

It is recannended that if.Council desires to adopt ordinance, read title and
waive further reading (unanimous vote.) Introduce ordinance for further Council
consideration on April 26; 1983. Issue Categorical exemption.

AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING SECTION 35.404 OF THE
CODE OF REGULATORY ORDINANCES
THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS:
Section 1. Section 35.404 is hereby amended to read:
Section 35.404 Notice to clean premises.
If it is determined that a. public nuisance, as herein defined, exists on
any lot or premise, or upon any sidewalk, parking lot or street adjacent to
such lot or premise, the Director of Safety Services shall cause a notice to
be issued to abate such nuisance. Such notice shall be headed: "NOTICE TO
CLEAN PREMISES" in letters not less than one inch (1 ") in length and which
shall, in legible characters, direct the abatement of the nuisance and refer
to this article and section for particulars._ Notices served by means of
other than posting as provided by this article. _shall contain a description
of the property in general terms reasonably sufficient to identify the loca-
tion of the nuisance.
If notice herein described, in addition to orders relative to other waste
material, shall require lots of two (2) gross acres or less to be cleared in
accordance with Section 35.401 or as otherwise directed by the Director of
Safety Services, and lots of two ( 2 ) acres or mre to have maintained at
least a thirty (30) foot fire break. Fire breaks of up to 100 feet may be
m- i-hP r9;ccretion of the Director of Safety Services.
Section 2.
This ordinance shall take effect and be in force thirty (30) days after the date
of its passage; and before the expiration of fifteen (15) days after its
passage, it shall be published once with the names and members voting for and
against the same in the Poway News Chieftain, a newspaper of general circulation
published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 19th day of April, 1983, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held the day of
, 1983, by the following roll call vote:
