SUBJECT: Wealth Department Permit Fee Revision
In June 1981, the City Council.entered into an agreement with the County of San
Diego to furnish health services. Section 10 of that agreement requires the
City to amend certain portions of the Cade whenever the County amends theirs in
order to be consistent.
We have received notice of the County's annual revision of the health permit
fees. They are suggesting that the cities adopt.an ordinance that will provide
for the immediate application of the health permit fee structure adopted
annually by the Board of Supervisors. This procedure wculd be time- saving to
the County and to the cities and it is:recmmiendedthat the City Council
authorize staff to prepare such an ordinance.
1. The City of 'Poway is "required, by agreement, to keep health permit fees con-
sistent with the County's where they 'are furnishing the health services for.

2. A general ordinance stating that our fees shall be the same;as the County's
would prevent the Council from enacting a new ordinance each year following
the Board of Supervisors' annual adjustment.

It is recommended that the City Council.authorize staff to prepare an ordinance
providing for immediate application of County's health permit fee structure and
bring back for first reading.

RE: HEALTH PERMIT FEE REVISION

Health permit fees for food establishments and land use activities were revised
by the San Diego County Board of Supervisors with the adoption of Ordinance
No. 6599 (attached) on June 7, 1983. These revisions were made to recover
the rising cost of providing required inspection services. We respectfully
request that your city council adopt the fee structure as indicated in the
ordinance within the required 30 -day time frame. Your adoption will eliminate
the need for us to collect the difference from your City as outlined in our
Basic Agreement with you. If you do not adopt the new fee structure within
the 30 -day period, it will increase your City's cost and create an inconsistency
in fees in our County.
Additionally, we would like to urge your City to pass legislation that will
provide for the immediate. application in your City of the health permit fee
structure adopted annually by the County Board of Supervisors. This would
eliminate the necessity for our staff to contact each city to request fee changes
whenever the Board adjusts fees. Such an effort is cumbersome and expensive.
It would also eliminate the need for each city council to hold a public hearing
on the fee changes since that is done by the Board of Supervisors prior to
any adjustments. The cities of San Diego, Coronado,, Del Mar and Vista have
already adopted such legislation. An example of the City of San Diego Ordinance
is attached.
Please note that in contrast to fees for restaurants and land use activities,
the fees for activities regulated totally by State law .become effective through -
out the County, including the incorporated cities, at the time the Board of
Supervisors takes action. These activities include public swimming pool and
retail food market inspections. Countywide application of such fees is in
accordance with Section 510 of California Government Code.
