The previously certified Final EIR and Final Subsequent EIR for the South Poway Specific Plan
adequately addresses the potential environmental impacts of the proposed development.
FISCAL IMPACT
None.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
Public notice was published in the Poway News Chieftain and mailed to 11 property owners in
the project area.
RECOMMENDATION
It is recommended that the City Council approve Conditional Use Permit 96-15M(2) subject to the
conditions in the attached proposed resolution.

BACKGROUND
On October 15,1996, the City Council approved Conditional Use Permit 96-15 allowing
the City to establish a materials handling yard on the property located at 12325
Crosthwaite Circle. The Materials Handling Yard has been in operation on the site since
late Summer 1997. Perry Falk ofthe Perry Ford auto dealership is requesting approval
to store 126- 200 new vehicles on the subject property. The South Poway Development
standards require the approval of a conditional use permit for automobile fleet storage.
FINDINGS
There is adequate space to accommodate the proposed new car vehicle storage lot within
the Materials Handling Yard. A new car vehicle storage area was considered in the site
design during the planning stages for the yard. The site is screened from view by an
eight foot high masonry wall along the Crosthwaite Circle frontage and a six foot high wall
along the westerly property line. Existing slopes screen the site from the north and east.
The area proposed for the storage of the vehicles is already paved with asphalt concrete.
The applicant proposes to secure the storage area through the installation of an 8' high
chain link fence. A condition of approval for the project requires that the segment of the
chain link fence that will extend from the Materials Yard entry gate to the storage area entry
gate be dark vinyl coated chain link to match the existing fencing.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING A MODIFICATION TO CONDITIONAL USE PERMIT 96-15M(2)
ASSESSOR'S PARCEL NUMBER 317-280-50
WHEREAS, Conditional Use Permit 96-15M(2) submitted by Perry Falk, Applicant,
the City of Poway, Owner for the purpose of allowing the storage of 126-200 new vehicles
at the City of Poway Materials Handling Yard located at 12325 Crosthwaite Circle within
the South Planned Community zone. The land use designation of the property is Light
Industrial.
WHEREAS, on January 27,1998, the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Environmental Findincs:
The potential impacts of the project were addressed by the previously Certified Final
EIR and Final Subsequent EIR for the South Poway Planned Community.
Section 2: Findincs:
Conditional Use Permit 96-15M(2)
1. The project is consistent with the General Plan and the South Poway
Specific Plan which designates this site for industrial use and outdoor
storage.
2. That the location, size, design, and operating characteristics of the use are
in accord with the title and purpose of this resolution, the purpose of the land
use designation in which the site is located, the Poway General Plan and the
South Poway Specific Plan, in that the subject property is identified as a site
where outdoor storage is allowed was anticipated within the South Poway
Specific Plan area.
3. That the location, size, design, and operating characteristics of the use will
be compatible with and will not adversely affect or be materially detrimental
to adjacent uses, residents, buildings, structures, or natural resources, in that
the use will be located on an industrial site which is not near any residential
or semi-public uses.

4. That the harmony in scale, bulk, coverage, and density is consistent with
adjacent uses, because the site has been developed with facilities and
buildings which have been designed to be compatible with surrounding
structures.
5. That there are available public facilities, services, and utilities, because the
use will be located on a site where all necessary facilities are already in
place.
6. That there will not be a harmful effect upon desirable neighborhood
characteristics, in that the use will be located in an existing planned industrial
area.
7. That the generation of traffic will not adversely impact the surrounding streets
and/or the City's Transportation Element, in that the use will operate out of
a business park where existing street improvements and off-street parking
are adequate and the scale of the proposed activity does not exceed
assumptions made when traffic impacts for the business park as a whole
were reviewed.
8. That the site is suitable for the type and intensity of the use, in that it is an
area designated for light industrial use and vehicle fleet storage is permitted
with the approval of a conditional use permit.
9. That there will not be significant harmful effects upon environmental quality
and natural resources, in that the site is developed.
10. That there are no other relevant negative impacts of the development that
cannot be mitigated, in that an 8 foot high masonry wall has been
constructed to effectively screen the site.
Section 3: Citv Council Decision:
The City Council hereby approves Conditional Use Permit 96-15M(2) subject to the
following conditions:
1. Within 30 days of approval the applicant shall submit in writing that all
conditions of approval have been read and understood.
2. The use conditionally granted by this permit shall not be conducted in such
a manner as to interfere with the reasonable use and enjoyment of the
surrounding industrial and open space uses.
3. This conditional use permit shall be subject to annual review by the Director
of Planning Services for compliance with the conditions of approval and to

address concems that may have occurred during the past year. If the permit
is not in compliance with the conditions of approval, or the Planning Services
Department has received complaints, the required annual review shall be set
for a public hearing before the City Council, to consider modification or
revocation of the use permit.
SITE DEVELOPMENT
1. Site shall be developed in accordance with the approved site plans on file in the
Planning Services Department and the conditions contained herein.
2. Revised site plans and building elevations incorporating all conditions of approval
shall be submitted to the Planning Services Department prior to issuance of building
permits.
3. Approval of this request shall not waive compliance with all sections of the South
Poway Development Standards the Zoning Ordinance and all other applicable City
Ordinances in effect at the time of building permit issuance.
4. The applicant is responsible for the installation of any security fencing around the
vehicle storage area. The segment of the chain link fence that will extend from the
Materials Handling Yard entry gate to the vehicle storage area entry gate shall be
dark vinyl coated chain link anc match the existing fencing.
5. A building permit is required for the installation of fencing over six feet in height.
6. The applicant shall comply with the latest adopted Uniform Building Code, Uniform
Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire
Code, and all other applicable codes and ordinances in effect at the time of building
permit issuance.
7. The entry gate to the vehicle storage area shall be constructed in compliance with
SDRSD N-5 standards.
8. This approval shall become null and void if building permits are not issued for this
project within two years from the date of project approval.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE
SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES.
1. Provide a 20' wide entrance gate to the vehicle storage area.
2. Provide a 20' wide access way around the interior of the storage area. The
applicant shall paint markings on the ground to identify the access roadway.
