SUBJECT: Vacation of Water Easement located Within Parcel 1 of Parcel Map
14969 (APN 321-180-81)
BACKGROUND
Ms. Bonnie Bline, the current property owner, is in the process of developing the
subject property. Ms. Bline would like to have the water easement vacated so that she
may install landscape improvements to the property.
The existing water line easement (see Attachment 2) was granted to the City of Poway
during the parcel map recordation process in 1987 (see Attachment 1 ) .
The 1987 Water Master Plan does not identify any proposed facilities along the subject
easement.
FINDINGS
The properties located off of Paradise Drive are served by a water main located in
Paradise Drive. The properties located to the south of the subject property, which take
access off of Terrilee Drive, are able to be served via a future main extension on
Terrilee Drive. Some of the properties on Terrilee Lane have already obtained
temporary water connections and have agreed to contribute monies toward a water
main extension along Terrilee Drive.
The water lines in Terrilee Drive and Paradise Drive are on two different pressure
zones, and thus are unlikely to ever be linked.
Neither Public Services nor the Engineering Department sees any future need for the
existing easement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
ORDERING THE VACATION OF WATER EASEMENT LOCATED
WITHIN PARCEL 1 OF PARCEL MAP 14969 (APN 321-180-81)
FILED SEPTEMBER 15, 1987, AS FILE NO. 87-521212 OF OFFICIAL RECORDS
IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY
(VACATION NO. 97-04)
WHEREAS, the City Council of the City of Poway desires to summarily vacate a
certain public easement in accordance with the procedures provided in Chapter 4, Part 3,
Division 9 of the Streets and Highways Code of the State of California, commencing at
Section 8330; and
WHEREAS, a water easement within the attached legal description and plat titled
"Exhibit A" was dedicated to the City of Poway on SEPTEMBER 15, 1987, AS FILE NO.
87-521212 in the Office of the County Recorder of San Diego County.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1. This summary vacation is made under the provisions of Chapter 4, Part 3,
Division 9 of the Streets and Highways Code of the State of California.
2. The City Council hereby finds that the herein described water easement is
unnecessary due to development of the area.
3. The City Council hereby declares that the following described water
easement is hereby vacated:
See attached legal description and easement piat titled "Exhibit A"
4. The City Clerk of the City of Poway is hereby directed to cause a certified
copy of this resolution to be recorded in the office of the County Recorder
of San Diego in accordance with the provisions of Section 8336 of the
Streets and Highways Code.
PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting this day of 1998.
