ABSTRACT
The maintenance of public landscape improvements within Landscape Maintenance District 87-1 requires
funding. The California Landscape and Lighting Act of 1972 [ACT] allows for the collection of
assessments from parcels annexed into the district for this purpose. In order to collect assessments, Chapter
3 of the ACT requires a resolution declaring the intention to levy and collect assessments and an Engineer's
report.
There are currently 65 assessable residential and 275 non-residential (commercial/industrial) parcels in
LMD 87-1. During FY 98/99, assessments are proposed to remain $790.00 per net acre for Parkway
Business Centre and Poway Corporate Center, and $89431 per net acre for Pomerado Business Park,
Phases I and II and Rolling Hills Estates commercial properties. Assessments are proposed to decrease
from $221.71 to $210.67 per parcel for the residential portion of Rolling Hills Estates.

BACKGROUND
Landscape Maintenance District was formed on January 27, 1987 to maintain landscape
improvements installed in conjunction with new subdivisions within the boundaries of the
District (Exhibit A of the Resolution). The following is a list of subdivisions currently

FINDINGS
The Landscape Maintenance District 87-1 currently maintains more than 120 acres of
landscaping under two contracts. The estimated value of improvements maintained by the
District is $48,250,000. The improvements, installed in conjunction with new subdivisions
within the boundaries of the district, have been determined to benefit to all property owners
within the District.
A District Engineer's Report with assessment recommendations, as required under the ACT,
must be presented for City Council consideration and public comment on an annual basis. This
report (Attachment 2) has been found to be technically correct as presented.
Proposition 218, which was passed by the California voters on November 6, 1996, expands the
requirements for public notification and imposes the requirement of District balloting.
Beginning July I, 1997, all existing, new, or increased assessments shall comply with Article
XIII D as added to the California Constitution, Exempt from the procedures and approval
process set forth in Section 4 of this Article are assessments imposed pursuant to a petition
signed by the persons owning all of the parcels subject to the assessment at the time the
assessment is(was) initially imposed. All parcels currently assessed were annexed into the
District by owner consent at the time of development. However, this does not preclude any
assessments which would be increased in future years. Subsequent increase in such
assessments shall be subject to the procedures and approval process set fonh in Section 4 of
Anicle XIII D.
Proposition 218 also requires that the City separate "General Benefit" from "Special Benefit."
General benefit is a service provided to the public-at-large, Special benefit is a service
provided at a level greater than the service provided to the public-at-large. The City may
assess for special benefit conferred upon parcels. Costs associated with general benefit must
be paid from other resources of the local agency. The City's general benefit to the public-at-
large is determined as the average expenditure from the general fund for the maintenance of
landscaped medians and rights-of-way, calculated on a per square foot basis. The City shall
make a general benefit contribution to LMD 87-1 based on the City's average expenditure from
the general fund and the square footage of improvements within the LMD, The City's general
benefit contribution will be made by providing irrigation water to an LMD to be used in the
maintenance of LMD improvements in an amount equal to the City's general benefit
contribution amount. Calculations of the general benefit are on file in the Special Districts
Office.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DECLARING THE INTENTION TO LEVY AND COLLECT
ASSESSMENTS WITHIN POWAY LANDSCAPE MAINTENANCE
DISTRICT 87-1 FOR FISCAL YEAR 1998/99
WHEREAS, the City Council of the City of Poway desires to levy and collect
assessments within Poway Landscape Maintenance District 87-1 for the purpose of
maintaining, servicing, and operating public landscape facilities located within the
territory comprised of said district as shown in Exhibit "A" of the Engineer's Report that
is on file in the City Clerk's Office, pursuant to the Landscape and Lighting Act of 1972
and attached hereto; and
WHEREAS, assessments will not increase from the Fiscal Year 1997/98
assessment rate of $790.00 per unit for Parkway Business Centre and Poway
Corporate Center; $894,31 per net acre for the Pomerado Business Park and the
commercial properties of Rolling Hills Estates; and, $210.67 per parcel for the
residential properties of Rolling Hills Estates; and
WHEREAS, under Article XIII D, Section 5(b) of Proposition 218 (adopted by
general vote on November 5,1996) the collection of Fiscal Year 1998/99 assessments
is exempt from the procedures and approval process set forth in Section 4 of Article XIII
D, in that the assessment was imposed pursuant to a petition signed by the persons
owning all of the parcels subject to the assessment at the time the assessment was
initially imposed; and
WHEREAS, the public interest and convenience require the maintenance,
service, and operation of public landscaping and soundwalls within said territory.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1. The foregoing recitals are true and correct and the City Council so finds
and determines.
2. Proposed assessments are as detailed in the Engineer's Report for
Poway Landscape Maintenance District No. 87-1 for fiscal year 1998/99.
3. Pursuant to the Streets and Highways Code, a public hearing will be held
on June 30, 1998 in the City Council Chambers at City Hall to consider
the levy and collection of the proposed assessments.

DISTRICT 87-1 FOR FISCAL YEAR 1998/99

District 87-1 was formed on January 27, 1987 for the purpose of financing the maintenance
and operation of landscape improvements installed in conjunction with new subdivisions and
commercial/industrial developments within the boundaries of the District (Exhibit A). This
report sets forth the findings and engineering analysis for Poway Landscape Maintenance
District 87-1 for fiscal year 1998/99.
F1NDlNGS
The Landscape and Lighting Act of 1972 (Act) allows assessments to be levied for the
maintenance of certain public improvements within a subject district according to benefit rather
than estimated value (Section 22573). The necessary revenue required to maintain the
landscape improvements within Poway Landscape Maintenance District 87-1 has been
calculated according to benefit for fIScal year 1998/99 as provided for by the Act. All
assessments collected within this District will be expended on maintenance, utilities, and
administration of District 87-1 landscape improvements.
Under Article XIII D, added to the California Constitution with the passage of Proposition 218
on November 5, 1996, balloting is not required since there is to be no increase in assessments.
On July 1, 1997, the District added improvements along Scripps Poway Parkway adjacent to
the Poway Corporate Center (Tech Business Center). This is the only area added since the last
Engineer's Report was presented to the City of Poway.
RNGlNRRRlNG And RRNRFIT ANALYSRS
The name of this district is Poway Landscape Maintenance Assessment District 87-1. The
boundary of the District is shown on Exhibit A. Property lines and dimensions of each lot or
parcel of land within the Landscape Maintenance District are shown in detail on the County of
San Diego Assessor's maps. These maps are on file in the County Assessor's Office, 1600
Pacific Highway, Room 103, San Diego, California 92101.
With the annexation of the Rolling Hills Estates residential subdivision, the District has been
divided into two subzones: 87-lA for residential and 87-lB for non-residential
(commercial/industrial). Assessments for the LMD 87-lA are calculated on a per unit per
parcel basis. Assessments for LMD 87-lB are calculated on a net acre

maps with the County of San Diego.

Assessments will be collected from parcels annexed into the district on the yearly property tax
roll. Assessments, however, cannot be collected from public-owned parcels (i.e., all public
streets, public avenues, public lanes, public roads, public drives, public courts, public alleys,
all easements and rights-of-way, all public parks, greenbelts and parkways, and all public
school property being used for public school purposes) that lie within the district boundaries.
Costs associated with general benefit must be paid from other resources of the local agency.
The City's general benefit to the public-at-large is determined as the average expenditure from
the general fund for the maintenance of landscaped medians and rights-of-way, calculated on a
per square foot basis. The City shall make a general contribution to LMD 87-1 based on the
City's average expenditure from the general fund and the square footage of improvement
within the LMD. The City's general benefit contribution will be made by providing irrigation
water to LMD 87-1 to be used in the maintenance of LMD improvements within the District in
an amount equal to the City's general benefit contribution amount.
FACn,ITIRS AND MAINTENANCE
The facilities to be maintained by the District are defined as the landscape and hardscape
improvements within the rights-of-way including roadway medians along portions of
Pomerado Road, Scripps Poway Parkway, Community Road, and portions of Stowe Drive;
detention/retention basins; and staging area.

The estimated value of the existing landscape and hardscape improvements to be maintained
under this Landscaping Maintenance District (LMD 87-1) is approximately $48,250,000,
including the detention/retention basins. The acreage to be maintained by the District was
increased in FY 95/96 from 60 to approximately 120 acres. In FY 97/98, the District added
approximately five more acres of responsibility for improvements associated with Tech
Business Center.
Performance standards and specifications have been developed by the City of Poway for
landscape maintenance improvements to assure a specific maintenance level for landscape
assessment district properties. Although water to the upper portions of the upward slopes and
lower portions of the downward slopes have been turned off, the areas are returning to native
vegetation as planned. A recent inspection of District maintained areas found the present level
of maintenance service to be satisfactory.

ASSRSSMRNTS
Assessments are proposed according to the needs of the District for which a budget amount is
required to maintain and administer the District facilities. Assessments for the Pomerado
Business Park, Phases I and II, and Rolling Hills Estates commercial are proposed to remain at
the current rate of $894.31 per net acre. Parkway Business Centre and Poway Corporate
Center, are proposed to remain at $790.00 per net acre. Rolling Hills Estates residential is
proposed to decrease from the current rate of $221.71to $210.67 per parcel.
A complete parcel listing with respective assessments is shown on Exhibit 'C' which is on file
in the office of the City Clerk, City of Poway, California.
