The Poway City Council sits as the Poway Planning Commission, the Poway Housing Authority, the Public Financing, Authority, and the Successor Agency to the Poway Redevelopment Agency. Recommended Action: It is recommended that the City Council approve the Minutes of the February 4, 2014, Regular Meeting of the Poway City Council as submitted. Fiscal Impact: None. Environmental Review: Environmental review is not required according to CEQA guidelines. ORDINANCE (Ordinance(s) that do not require a Public Hearing - e.g. First Reading of an Ordinance). 2.1 Fi Reading of an Ordinance entitled, "An Ordinance of the City of Poway, California, amending Sections 8.04.010, 8.04.020, 8.04.030 and 8.04.100 of Chapter 8.04 of the Poway Municipal Code, to Prohibit Electronic Cigarettes (E- Cigarettes) in or upon Public Buildings, Public Grounds, Public Parks and Public Trails." Councilmember Cunningham confirmed with staff that no one from the public had requested a continuance of the item. 9854 3 of 8 February 18, 2014, Item #1.3 City of Poway — Minutes — February 4, 2014 In response to Councilmember Cunningham, Management Assistant Richards explained that staff is proposing that electronic cigarettes be prohibited on city - owned public property where tobacco cigarettes are currently prohibited. Councilmember Vaus expressed his support for the proposed Ordinance. Councilmember Mullin suggested that the proposed Ordinance be amended to remove any references relating to statistics involving tobacco - related deaths. He also commented that the data relating to electronic cigarettes is inconclusive at this time and he would prefer to leave statistics out of the Ordinance. Deputy Mayor Grosch and Mayor Higginson also expressed their support for the proposed Ordinance. Councilmember Cunningham suggested that rather than listing an exact figure in the Ordinance relating to the number of deaths attributed , smoking, the Ordinance be amended to read "an in ?r amount of people die in the United States from tobacco - related diseases'' " "' ry year, making it the nation's leading cause of preventable illness. PUBLIC HEAAG / / / % Councilmember Mullin'' "was disqualified from discussion on item 3.1 due to a flict of interest and left the room at 7 :34 p.m. 3.1 Environmental Assessment and Specific Plan Amendment 13 -006, A City- initiated amendment to the South Poway Specific Plan relating to Outdoor Storage; and first reading of an Ordinance entitled, "An Ordinance of the City of Poway, California, Approving Specific Plan Amendment 13 -006 Amending Section IV.C.8 and Table 1 in Chapter 4 of the South Poway Specific Plan Development Standards, Volume 2 Regarding Outdoor Storage within the South Poway Specific Plan Area." Development Services Director Bob Manis presented the report and reviewed a PowerPoint presentation. Speakers in Support: Ted Tchang and Eric Dye. Speakers in Opposition: Ray Suberlak and Laura Stees. 9855 4 of 8 February 18, 2014, Item #1.3 City of Poway — Minutes — February 4, 2014 Deputy Mayor Grosch announced he had met with a few residents on Gate Drive and that after explaining how the proposed amendment to the Specific Plan would still protect views from the street, the residents were supportive of staff's recommendation. In response to an inquiry from Deputy Mayor Grosch, Director Manis explained that if this amendment is approved, residents and businesses within 500 feet of the South Poway Specific Plan Area would no longer receive notification of the applications for outside storage. The permits would be approved administratively rather than through Council action. 40r, Councilmember Vaus asked staff if there is a limitation on the height of items and equipment in the outside storage areas. jAl Director Manis explained that items in outside storage would not be permitted to exceed the height of the wall or fence (at least eight feet and up to twelve feet) surrounding the storage area. Councilmember Vaus expressed concerns relating to the visual impacts to homeowners adjacent to the perimeter lots of the business park. He spoke in support of amending the proposed ordinance to prohibit outside storage on the perimeter lots unless those lot /re already designated Light Industrial Storage (LI- Councilmember Cunningham spoke in support of the Ordinance if it is amended to provide a perimeter edge restriction relating to outdoor storage activities. He commented that he would lie to know if the businesses would be agreeable to construction of a wall along th,e perimeter to shield the storage activities from those residences adjacent to the business park. Director Mats stait/W/V/We that the developers would prefer the option to construct a wall if this would a)low outside storage along the perimeter of the business park. Councilmember V expressed concerns relating to staffs ability to enforce the height requirement of items being stored behind a wall constructed along the perimeter. Mayor Higginson suggested that the Ordinance be amended to include strict conditions on perimeter wall construction to ensure that any storage activities are shielded from the properties adjacent to the business park. Director Manis commented that staff could return with an amended Ordinance for consideration at the March 4, 2014 Regular City Council Meeting. Councilmember Cunningham confirmed that staff would notify all individuals who e- mailed, commented and sent letters relating to this that the Public Hearing would be continued to March 4, 2014. 9856 5 of 8 February 18, 2014, Item #1.3 City of Poway — Minutes — February 4, 2014 Motion by Councilmember Cunningham seconded by Mayor Higginson to continue the Public Hearing to the March 4, 2014 Regular City Council Meeting. Motion carried unanimously of those present with Councilmember Mullin disqualified. Councilmember Mullin returned to the dais at 8:16 p.m. 4. STAFF REPORTS 4.1 None. 5. WORKSHOP 5.1 Discussion of Public Noticing Requirements for Pubic , ; Development Services Director Bob Manis gave an overvie �e agenda item. He explained that although State law only requires that property b�wners within 300 feet of a project be notified of Public 1 arings, the City of Poway currently notices owners within 500 feet of any proposed project. In addition, staff has recently c at increased awareness of projects b},k osting signage at the proposed project i %% Director Manis stated that two businesses in the business park area provide mailing services for a fee. Staff determined that, to expand the noticing to residential tenants within 500 feet, the most economical solution would be to contract with PostHaste to provide the expanded noticing mailing services. City Attorney Foley recommended t any revised Public Hearing noticing regulations in excess of the state requirement, be enacted by Resolution rather than Ordinance to allow easier revisions to the regulations in the future. Speaker in Support: Dee Fleischman. Councilmember Cunningham spoke in support of adoption of a Resolution expanding the noticing regulations in addition to posting signage on the proposed project sites. He also recommended that the fees charged to project applicants for noticing remain unchanged at this time. Councilmember Vaus spoke in support of expanding noticing by utilizing the PostHaste mailing service in addition to posting signage at the proposed project site. In response to an inquiry from Councilmember Mullin, Director Manis explained that staff would still be responsible for providing the noticing required by Poway's Municipal Code and State law. Councilmember Mullin asked if the preliminary neighborhood meetings would receive the same range of noticing as Public Hearings. 9857 6 of 8 February 18, 2014, Item #1.3 City of Poway — Minutes — February 4, 2014 Director Manis explained that staff generally holds neighborhood meetings for Conditional Use Permits, Tentative Maps and controversial projects. He commented that staff would research if they could utilize the same list provided for the noticing of the Neighborhood Meetings for the Public Hearing notification. Concluding his remarks, Councilmember Mullin questioned whether or not increasing mailing notification would result in additional public involvement and whether it would ultimately be worth the added expense to the City. However, he would be supportive of posting at the proposed project sites. Verbal Report Councilmember Cunningham reviewed the trail segments that were hiked throughout 2013. Councilmember Vaus — No Report. Councilmember Mullin — No Report. Verbal Report Mayor Higginson suggested staff evaluate parking conditions at Lake Poway and Iron Mountain Park and Ride and report findings and recommendations to the Parks and Recreation Committee. Councilmember Cunningham concurred with Mayor Higginson's suggestion. Councilmember Vaus suggested that a sign be placed near the parking lot exit � ��/" /I YNX on Highway 67 directing travelers to Poway for d.ir y1or,shopping. W// Councilmember Mullin spoke in favor of gathering data to qualify the traffic and parking situation at Lake Poway and the Iron Mountain Park and Ride. Mayor Higginson also suggested that when staff reviews the parking conditions, they consider whether it would be feasible to change the timeframe at Lake Poway for charging non-residents parking fees. �' W, Deputy Mayor Grosch com '101.
