Nelson, Management Aide ~ DATE: May 14, 1996 SUBJECT: A Public Meetine to Allow Public Testimony for New Assessments to be Collected for Landscape Maintenance District 86-2 Durinlf Fiscal Year 1996/97 ABSTRACT SB 1977, Section 54954.6(a)(1) requires that City Council conduct at least one public meeting to allow public testimony regarding proposed new or increased assessments. This public hearing is required due to a new assessment being levied against one parcel within Sycamore Creek which was missed on the previous assessment roll. Assessments are proposed to remain at the FY 95/96 rate of $186.16 and $240,90 for Zones A and B, respectively. - ENVIRONMENTAL REVIEW This item is not subject to CEQA review. FISCAL IMPACT Sufficient revenues will be generated by assessments to offset the District's maintenance ccsts. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Pursuant to SB 1977, Section 50078.6: 1) Notice of Public Hearing has been posted at three public places within the Agency; 2) A one-eighth page display advertisement has been placed in the Poway News Chieftain (a newspaper of general circulation); and 3) Notice of Public Hearing has been mailed to the one Sycamore Creek property owner within LMD 86-2 [Zone B]. and those interested parties who have filed a written request with the local agency. RECOMMENDATION It is recommended that City Council accept public testimony and continue consideration of the proposed increase in assessments until the June 18, 1996 public hearing. Nelson, Management Aide ~ DATE: May 14, 1996 SUBJECT: A Public Meetinll to Allow Public Testimony for Increased Assessments to be Collected for Land~cape Maintenance District 86-2 Durinll Fiscal Year 1996/97 BACKGROUND On April 23, 1996, City Council approved the Engineer's Report for Landscape Maintenance District 86-2, and adopted Resolution No. 96-028 declaring the intention to levy and collect assessments within Poway Landscape Maintenance District 86-2 for Fiscal Year 1996/97. The Engineer's Report for Landscape Maintenance District 86-2 is on file in the Offices of the City Clerk and the Department of Public Services. As of January 1, 1993, SB 1977 required that the public be properly noticed for any new or increased assessments and for the public to have the right to protest and defeat any assessment increases. FINDINGS Facilities maintained by LMD 86-2, Zone B of the district, are defined as the landscape and hardscape improvements within the rights-of-way within the Sycamore Creek subdivision at the east end of Garden Road. Originally, one hundred sixty-seven parcels. consisting of the same number of units, were annexed into the district by owner/developer consent and City Council adoption of resolution during fmal map process. That parcel is now back on the rolls and can be assessed. Proposed FY 1996/97 revenues for the operation and maintenance of the District landscape improvements will remain at the FY 1995/96 rate of $18,523 and $40,230 for Zones A and B, respectively ($186.16. per unit and $240.90 per unit).
