The tentative map has progressed toward completion and is close to final map and recordation. ENVIRONMENTAL REVIEW The previously issued Negative Declaration with Mitigation Measures (indicating no significant adverse environmental impacts anticipated due to the addition of special requirements to the project) for biological impacts, adequately addresses the potential environmental impacts of the approved development. FISCAL IMPACT None. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Public notice was published in the Poway News Chieftain and mailed to 76 property owners within 500 feet of the project boundaries. RECOMMENDATION It is recommended that the City Council approve Tentative Tract MaD 89-05TE(2\ subject to the conditions contained in the attached proposed resolution. FAMSTE Investment ComDany. Inc.: A request for a final two-year time extension of a previ ous ly approved tentat i ve tract map. The map proposes the subdivision of a 75.4 acre property into 13 single-family lots located at the northwest corner of Poway Road and Espola Road in the RR-C zone. APN: 321-200-44 and 47 On April 30, 1991, the City Council approved TTM 89-05. Subsequently, on April 27, 1993, the City Council approved a one year time extension of TTM 89-05, and in accordance with Assembly Bill 428 the map was also allowed an additional two year extension. The applicaRt is presently requesting a final two-year extension of the approved tentative map to allow time to complete the project conditions of approval. FINDINGS TTM 89-05 is consistent with the City General Plan and the Zoning Ordinance in terms of land use, design, and improvements. The site is physically suited for the proposed type and density of the development. The design of the project and its proposed improvements will not cause substa~tial environmental damage as mitigation measures have been included as conditions of approval,. The project will not result in serious publiC health problems in that essential public services will be provided. The project will not conflict with any public access easements. ENVIRONMENTAL REVIEW A Negative Declaration with Mitigation Measures was issued for TTM 89-05 on April 30, 1991. The previously issued Negative Declaration with Mitigation Measures, adequately addresses the environmental concerns of this project. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TTM 89-05TE(2) ASSESSOR'S PARCEL NUMBERS 321-200-44 & 47 WHEREAS, a request for a final two-year time extension for Tentative Tract Map 89-05, herei nafter "Map" submi tted by FAMSTE Investment Company, Inc., owners, for the purpose of subdividing real property situated at the northeast corner of Poway Road and Espola Road into 13 single-family lots, came before the City Council for public hearing and action on June 18, 1996; and WHEREAS, the Director of Planning Services has recommended approval of the Map subject to all condi t ions set forth in the Plann i ng Servi ces Department report; and NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Findinos: A Negative Declaration with Mitigation Measures was originally issued on the project on April 30, 1991 which adequately addresses the potential environmental concerns. Section 2: Findinos: 1. The proposed project is consistent with the General Plan because the proposed lots meet the standards of the Rural Residential zone. 2. The design and improvements of the tentative tract maps are consistent with all applicable general and specific plans; in that the proposed lot sizes and configurations adhere to the development standards for the Rural residential zone. 3. The site is physically suitable for the density and the type of deve 1 opment proposed in that the site is a fl at knoll and can accommodate the number of lots proposed. 4. The design of the subdivision is not 1 ikely to create adverse impacts on the envi ronment because mit igat i on measures wi 11 be implemented and because the area of the property designated for home construction has been previously disturbed. 5. The tentat i ve parcel map is not 1 i ke ly to cause seri ous publ i c health problems in that City water and sewer systems will be provided to the new parcels. Low-flow plumbing fixtures will be required throughout future buildings on the site. Landscaping plans wi 11 eventually be prepared with mi ni ma 1 water consumpt i on and incorporating low-volume irrigation techniques for trees and shrubs as well as fire prevention techniques. The design of the tentative tract map will not conflict with any easement by the public at large, now of record, for access through or use of the property within the proposed subdivision. Section 3: City Council Decision: The City Council hereby approves Tentative Tract Map 89-05TE(2) subject to the following conditions: 1. Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood. 2. Approval of TPM 89-05TE(2) is based on its conformance with the conditions contained in City Council Resolutions P-91-27 and P-93- 20. 3. The tentative map approval shall expire on April 30, 1998 if a final map has not been recorded by that date. Also the area has a family of Vultures. The site of said Tract is a refuge for many animals forced out of the surrounding area already built up. I am opposed to any further building in this area because of the adverse environmental impact it would have. Thank you for your consideration.
