This resolution will establish a new administrative fee of $60.00. ENVIRONMENTAL REVIEW Environmental review is not required according to CEQA guidelines. Due to the present economic conditions, a sixty to sixty-five percent recovery is more practical at this time. DATE: April 5, 1994 SUBJECT: Resolution Establishing an Administrative Fee for Abandoned Vehicle Abatement, Nuisance Abatement and Weed Abatement BACKGROUND This Resolution proposes increasing the administrative fee on four (4) long standing nuisance abatement ordinances. The first, Ordinance 25 (P.M.C. 10.52), adopted in 1981, established procedures for the removal and disposal of abandoned vehicles not on highways. Second, Ordinance 29 and 41, also adopted in 1981, includes procedures for the removal of weeds, shrubs, waste and junk. Poway Municipal Code, Section 8.76 and Section 8.80 have been amended slightly since there adoption, however the administrative fees have never changed. The last, Ordinance 57 (P.M.C. Section 8.72), was adopted in 1982 and sets up a complete nuisance abatement ordinance. FINDINGS The administrative fees for nuisance abatement issues has remained at $20.00 since 1981/82. The Management Services Institute's (M.S.I.) cost study was approved by the City Council in April, 1993. The study recommended an increase in the administrative fee for vehicle abatement to $85.00 (Attachment 1) and $95.00 for weed abatement (Attachment #3). There was no fee recommended for nuisance abatement (Attachment 2). However, there was also no consideration for staff time and expenses related to the various nuisance complaints and issues handled by the Code Compliance Officer. We are recommending an administrative fee be established for nuisance abatement issues, when a clean-up fee is necessary. Even though M.S.!. recommended different administrative fees, we are recommending establishing a uniform administrative fee of $60.00 for each incident related to vehicle abatement, nuisance abatement and weed abatement. The $60.00 fee is not total cost recovery, but does cover salary, wages, fringe benefits and minimal department overhead costs. It is our intent to move toward full cost recovery with incremental increases over time. ACTION: APR 5 1994 7r'. NOW, THEREFORE, the City Council does hereby resolve as follows: 1. An administrative fee of $60.00 be established for each incident related to abandoned vehicle abatement, nuisance abatement and weed abatement.
