SUBJECT: Temporary Use Permit 94-51, City of Poway, Applicant
ABSTRACT
A request for the approval of a temporary use permit for an Old-Fashioned Poway Fourth
of July at Old Poway Park on July 2 through 4, 1994 along with notice of the fireworks
event at the Poway High School stadium.
ENVIRONMENTAL REVIEW
The project use is categorically exempt from the California Environmental Quality Act
under Classes 4(e) and II (c). The event will be a temporary use of land having
negligible or no permanent effects on the environment.
FISCAL IMPACT

The City will be providing budgeted services such as traffic control, street cleaning,
park set-up and maintenance and other budgeted personnel costs.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
Details about the day's events will be published in the Poway News Chieftain prior to
July 2. Signs have been placed on the Community Event kiosks for notification of the
upcoming event.
RECOMMENDATION
It is recommended that the City Council approve Temporary Use Permit 94-51 subject to
conditions contained in the attached resolution.

SUBJECT: Temoorarv Use Permit 94-51. Citv of Powav. Aoolicant: A
request for the approval of a temporary use permit for an Old-
Fashioned Poway Fourth of July at Old Poway Park on July 2
through 4, 1994 along with notice of the fireworks event at
the Poway High School stadium.
BACKGROUND
This second annual special event is being planned to celebrate the Fourth of July
and dedicate the new improvements at Old Poway Park over a three day period. The
steam locomotive will be activated for the first time on July 2, 1994. Speeder
car train rides and trolley rides are planned. The events each day are scheduled
from 10:00 a.m. to 5:00 p.m. The expected attendance is up to 2,000 on July 2 and
3 and up to 4,000 people on July 4. The events include: steam locomotive and
gazebo dedications on July 2, lunch box auction and ice cream social on July 3
and an old- fashioned picnic sponsored by WalMart on July 4. Concerts will be
conducted daily from 1:00 to 4:00 p.m. Games for children and adults will be
conducted on July 4.
There will also be turn-of-the-century games, displays, demonstration, food, an
art show, crafts, train rides, pony rides, a beer garden, and the museum will be
open for vis itors. The Poway Hi stori ca 1 Soci ety, the Poway-Mi dland Rail road
Volunteers and the Hamburger Factory have provided funds and/or will provide
assistance in implementing the planned dedication events. Many of the vol unteers
and City staff will be dressed in turn-of-the century attire. Shuttle service
will be available from the Boney's Market parking lot and from Midland School,
Invitations for the July 2 dedication have been mailed to 1200 persons or
organizations.

The celebration will be similar to last year's Old Poway Park dedication.
Booths with quilting displays, crafts for sale, and tables with information about
the volunteer ranger program and adopt-a-park program will be set up near the
gazebo. Tours will be offered of the Templars Hall by historical society members
and of the Nelson House by University of California Extension Service personnel.
The Poway Fire Department will be putting on a fireworks display at 9:00 p.m. at
the Poway High School stadium. Gates will open at 5:30 p.m. with musical
entertainment from 6:30 to 9:00 p,m. There are no 4th of July events planned at
Lake Poway this year. The Sheriff's Department and Reserve Deputies will assist
with traffic and parking control at the fireworks event,
FINDINGS
This special event is intended to be the fourth annual commun ity event to
celebrate the Fourth of July. Dedication ceremonies will he held for the recent
improvements at Old Poway Park, e.g. the gazebo and blacksmith's shop. Parking
will be provided at Old Poway Park, the Farmer's Market lot, on the City-owned
property along the east side of Midland Road across from the park, the new
parking lot to the north of the park near the Midland Animal Clinic and shuttle
service provided from Midland School and the Boney's Market parking lot, The
Community Services Department has estimates attendance to be up to 4,000 people
per day over the seven hours of the each day's events,

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 94-51
WHEREAS, Temporary Use Permit 94-51, submitted by the City of Poway,
applicant, requests approval of the Old Poway Park event to be held on July 2
through 4, 1994.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section I: Environmental FindinQs:

Pursuant to the procedures of the City of Poway, implementing the
California Environmental Quality Act, the above-referenced project is
categorically exempt, Class 4e and lie, in that the Old Poway Park
Celebration and Dedication event is temporary in nature and will have
negligible or no permanent effects on the environment.
Section 2: FindinQs:
That the proposed use is in accordance with the purpose and standards of
Section 17.26.020 of the Poway Municipal Code.
Section 3: City Council Decision:
The City Council hereby approves Temporary Use Permit 94-51 subject to
the following conditions:
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF PLANNING SERVICES.
1. All food and drink concessions shall operate under the auspices of the
Hamburger Factory and their County Health Department permit, Volunteer
cooks shall abide by Health Department standards for food and drink
concessions,
2. Site shall be used in accordance with the site and parking plan
submitted by the Community Services Department.
3. Community Services Department personnel shall be responsible for
coordination of the event with other City departments, the Sheriff's
Department and volunteers.
4. The approval shall become null and void on July 5, 1994 at which time
the site shall be restored to its original condition,
5. Portable restrooms are required at the ratio of I to every 50 people up
to 500 people. After 500 people, the ratio is 1 per 500 people, A sign
showing the location of permanent and temporary restrooms must be
posted.
6. Provision for any temporary electrical power will require an electrical
permit and an inspection approval by the Building Safety Inspection
Division.

COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF PUBLIC SERVICES.
The Public Services Department will provide any needed barricades and
signs for traffic control at or near Old Poway Park,
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF SAFETY SERVICES.
L Any barricades used are to have attendants at all times.
2. Midland Road is to remain accessible to emergency vehicle traffic.
3. All booths, canopies and tents are to be tagged with State Fire Marshal
approval.
4. All booths or tents having electrical power, using any kind of flammable
fuel, or doing any cooking will have a fire extinguisher rated not less
than 2AIOBC.
5. The storage and removal of all trash material shall be provided so as
not to constitute a fire hazard.
6. All materials used for decorative purposes shall be non-flammable.
7. All electrical cords and connections shall be utilized only in an
approved manner.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED, COMPLIANCE SHALL BE
APPROVED BY THE SHERIFF'S DEPARTMENT.
L One or more volunteer rangers shall be on-site at all times when the
parking areas are in use to assist with security of parked vehicles, to
aid in the movement of vehicles in and out of the lots, to provide
information to motorists, and to minimize traffic congestion on surface
streets.
2. The event committee shall have personnel designated at all times and at
specific locations to provide liaison with representatives of the City's
Fire and Sheriff's Departments.
3, The event committee shall designate an on-site location for police,
fire, and paramedic units out of the main activity area and maintain
sufficient access for emergency vehicles at all times.
4. All music activities shall be terminated on or before 5:30 p,m, and at
no time shall the noise level exceed the permissible decibel (dB) level
for the area's zoning designation.
5. All beverages shall be dispensed in paper cups or cans. No bottles are
