ABSTRACT
In I9BO the City of Poway sold the fire station property located at 13420 Community
Road. In 1989, after removing two underground fuel tanks, it was noted that there was
soil contamination. The claimant feels the City is responsible. The amount of the
claim is for $75,000.00

BACKGROUND
An June 23, 1994, a cla for damages was received from Mr. Emi1 Murphy for E&E
Transportation, Inc,. of Poway. The amount of the claim is 575,000.00. It is
recommended that this claim be de�ied.

emergency vehicles: The pnopenty was sold by the Gity in 1980.. The tanks were
removed by E&E in T989. The contamination was noted upon cemoval of the tanks.

Recommendation regarding the formation
of an "Equestrian Commission" to manage
Poway's horse issues and ordinance.
The proposed recommendations would amend the Poway Municipal Code
to regulate the keeping of horses and other large animals by means of a
flexible ordinance administered by an "Equestrian Commission" as follows:
An "Equestrian Commission" will be created by the Poway City Council
and will be composed of three (3) representatives from the horse
community, three (3) representatives from civic associations, and one (1)
councilmember. "Commission" members will be paid $25 per noticed
meeting.
Allows, by the determination of the "Commission," the keeping of six (6) to
ten (l0) horses per acre. The keeping of less than 6 horses per acre would
not need approval by the "Commission" unless variances to other areas of
the "Ordinance" are sought.
Allows a riding academy to operate on six (6) or more acres of land with
approval of the "Commission."
The "Commission" has authority to allow up to twenty (20) horses on a
parcel without a minor or conditional use permit.
The "Commission" will determine whether a minor or conditional use
permit will be required when the number of horses per parcel exceeds twenty
(20).
Horses may be kept in side yard setbacks when the affected neighbor gives
permission or when that portion of the property is adjacent to open space,

and in front and street side setbacks when permission is obtained from the
"Commission."
No large animal shall be kept closer than thirty-five (35) feet of any
,structure legally used for human habitation on adjacent property.
On parcels under one (1) acre, the following numbers of animals are the
maximum allowed. The adjacent numbers in parentheses will be allowed
with permission of the "Commission."

In determining the number of animals allowed, the following shall not be
included in acreage:
1. floodways
2. open space and right of way easements
The offspring of any animal will not be counted among the total animals
permitted until such offspring reaches an age of one (1) year.
All decisions made by the "Commission," involving the keeping of more
than 10 horses, may be appealed to the full city council if the appeal is made
by three (3) commission members.
"Ordinance No.432" regarding stables and maintenance is unchanged.
