Tech Business Center has requested a conditional use permit to allow Orkin to operate from this location. ENVIRONMENTAL REVIEW - The potent i a 1 impacts of the proposed use were addressed by the previously Certified Final EIR and Final Subsequent EIR for the South Poway Planned Community. FISCAL IMPACI' Based on preliminary estimates provided by the applicant, the subject industrial building including tenant improvements and land cost will have a total value of approximately $330,000. One percent of that total less the base valuation of the land, will go to the City's Redevelopment Agency to be distributed in accordance with the terms of Poway Corporate Center's Development Agreement. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Notice of the public hearing has been sent to two property owners within 500 feet of the project boundary. APN: 317-271-51 BACKGROUND On August 6, 1991 the City Council approved Tentative Parcel Map 91-07 which created the subject .34 acre parcel. Rough grading of the site was completed 1 ast year. The project requires a conditional use permit because the primary use involves distribution, application, and storage of pesticides. FINDINGS The subject parcel is located on the east side of Flint Place in Tech Business Center. Surrounding parcels are all undeveloped. When the City Council approved one-third acre lots for this portion of Tech Business Center they also adopted criteria which stated that "Parcels less than 1/2 acre in size should include the following provisions: l. Zero lot 1 i ne on common wall construction for buildings on adjacent properties. 2. Reciprocal access agreements for common driveways where series of one- third acre lots are created. These provisions were adopted with the thought that it would be necessary to share access in order to be able to meet all applicable development standards on lots less than 1/2 acre in size. In the case of Orkin, however, the proposed building is so small, at 2775 square feet, that there is no difficulty in meeting the necessary parking, setback and landscape requirements. Orkin also needs a secured lot in which to park their trucks, which carry toxic substances. For these reasons staff believes that the shared access and common wall construction gUidelines can be waived for this property. The following table illustrates that the project is consistent with the basic development standards of the LI land use designation. Staff recommends that there be additional architectural treatment to enhance the essentially blank, off-white walls along the southern and northern elevation. Some additional color or texture would probably be adequate to accomplish this goal. Proposed conditions also require that the prefab aluminum awning at the back of the building be replaced with an alternative material which will not be as vulnerable to weathering and that the tilt-up concrete wall extend across the property frontage so that chain link fencing will not be visible from Flint Place. Parking, on-site circulation and storage areas are all consistent with current guidelines. The building will house Orkins Commercial Pest Control division for the area. Approximately 21 people will be employed at the site although no more than 13 will be working on any given shift. It is anticipated that about ten trucks will be dispatched from this facility. The chemicals which Orkin uses arrive in a prepackaged form and are loaded on the trucks as packaged when received. More than 20 different chemicals are used in the operation of thi s business. 3 of 17 .L\PR 2 7 1993 ITEM 6 Agenda Report Apri 1 27, 1993 Page 3 Conditions of approval for this project require full 'disclosure of hazardous materials which will be stored in the building. All findings necessary for the approval of this project can be made and are listed in the attached proposed resolution. ENVIRONMENTAL REVIEW The cumulative environmental impacts of constructing industrial buildings on the subject property were reviewed at the time the underlying Tentative Tract Map 89- 08 was approved. The Environmental Impact Report for the Business Park as a whole was certified on July 30, 1985. A subsequent EIR providing additional information concerning traffic and a number of amendments to the development plan was certified on July 26, 1988. The impacts of this project were adequately discussed in these documents. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Public notice was published in the Poway News Chieftain and mailed to two owners of property within 500 feet of the project boundary. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAV, CALIFORNIA APPROVING CONDITIONAL USE PERMIT 93-01 AND DEVELOPMENT REVIEW 93-01 ASSESSOR'S PARCEL NUMBER 317-271-51 WHEREAS, Conditional Use Permit 93-01 and Development Revi ew 93-01, submitted by Tech Business and Orkin Exterminating Company, Inc., applicants, request approval to construct a 2775 square foot building which will be occupied by Orkin Exterminating Company on Lot 5B in Tech Business Center which is located on the east side of Flint Place within the Light Industrial land use designation of the South Poway Planned Community; and WHEREAS, on April 27, 1993, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Findinas: The potential impacts of the proposed use were addressed by the previously Certified Final EIR and Final Subsequent EIR for the South Poway Planned Community. These documents assumed that limited amounts of hazardous materials would be stored in the bus i ness park in conjunct i on wi th manufacturi ng and research uses. Potential impacts of such uses were again reviewed when the spec i fi c plan was amended in 1989. A Negative Declaration with mitigation measures was issued at that time. The potential impacts of the proposed commercial pest control service were adequately addressed by the referenced documents. Section 2: Findinas: Conditional Use Permit 93-01 1. The proposed project is consistent with the general plan and specific plan which designates this site for industrial uses. 2. The proposed location, size, design, and operating characteristics of the proposed use are in accord with the title and purpose of this resolution, the purpose of and land use designation in which the site is located, and the Poway General Pl an and the South Poway Specific Plan; in that distribution and contracting service activities were anticipated uses within the South Poway Specific Plan area. 3. That the location, size, design, and operating characteristics of the proposed use wi 11 be compat i b 1 e wi th and wi 11 not adversely affect or be materially detrimental to adjacent uses, residents, 5 of 17 APR 2 7 1993 llEM 6 Resolution No. P- Page 2 buildings, structures, or natural resources, in that the use will be located within an i ndustri al buil di ng which is not near any residential uses or semi-public uses. 4. That the harmony in scale, bulk, coverage, and density is consistent with adjacent uses, because the use wi 11 be located wi thi n a building which has been designed to be compatible with surrounding structures. 5. That there are available public facilities, services, and utilities, because the use will be located in a development where all necessary facilities are already in place. 6. That there will not be a harmful effect upon desirable neighborhood characteristics, in that the use will be located in the interior of an existing planned industrial development. 7. That the generation of traffic will not adversely impact the surrounding streets and lor the City's Traffic Master Element, in that the use will operate out of a business park where existing street improvements and off-street parki ng are adequate and the scale of the proposed activity does not exceed assumptions made when traffic impacts for the business park as a whole were reviewed. 8. That the site is suitable for the type and intensity of designated use which is proposed, in that it is in an area designated for light industrial use. 9. That there will not be significant harmful effects upon environmental quality and natural resources in that the use will be contained within a building on a fully developed site and conditions of approval contain provisions to ensure safe handling of the hazardous materials. 9. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. Develooment Review 93-01 1. The proposed project will be consistent with the existing specific plan and general plan in that it is an industrial building located on a site designed for Light Industrial (LI) use. 2. The proposed development will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties, because the building has been designed in accordance with the area- wi de development plan and because the project wi 11 incorporate adequate landscaping, parking, and appropriate screening for truck parking areas. 6 of 17 .o.PR 2 7 1993 lTEM b .- ... The proposed development is in comp 1 i ance wi th the South Poway Development Standards and the South Poway Planned Community Development Plan and all amendments thereto. 4. The proposed development encourages the orderly and harmonious appearance of structures and property within the City through its consistency with the SPPC plan which provides high standards for development throughout the 2500 acre planned community. Section 3: Citv Council Decision: The City Counci 1 hereby approves Conditional Use Permit 93-01 and Development Review 93-01 subject to the following conditions: 1. Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. 2. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere wi th the reasonable use and enjoyment of surrounding light industrial uses. 3. This conditional use permit shall be subject to annual review by the Director of Planning Services for compliance with the conditions of approval and to address concerns that may have occurred during the past year. If the permit is not in compliance with the conditions of approval, or the Planning Services Department has received complaints, the required annual review shall be set for a public hearing before the City Council , to consider modification or revocation of the use permit. 4. The app 1 i cant shall obta i n a bus i ness 1 i cense from the Customer Services Department prior to commencement of business activity. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. SITE DEVELOPMENT 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Approval of this request shall not waive compliance with all sections of the South Poway Development Standards, the Zoning Ordinance, and all other applicable City Ordinances in effect at the time of building permit issuance. 3. The tilt-up concrete fence shall be continued around the northeast corner of the parking lot as shown on Attachment F of the staff report dated April 27, 1993. 5. The prefab aluminum awning shown on the back of the building shall be replaced with a more substantial shade structure which will be resistant to weathering. 6. All rooftop equipment must be screened from view, either by parapet walls or by roof screens. Prior to issuance of building permits, plans must be prepared which clearly show all proposed rooftop equipment and screening elements. 7. Additional color, texture, or architectural details shall be proposed for the building exterior prior to approval of building permits. 8. Design construction and location of the trash enclosures shall satisfy the requirements of the Planning Services Department. Trash enclosure walls may be tilt-up panels to match the building or spl it face block. Enclosure shall have solid gates. 9. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. 10. Thi s approval shall become nu 11 and void if building permits are not issued for this project by April 27, 1995. PARKING AND VEHICULAR ACCESS 1. All parking lot landscaping shall include a minimum of one 15 gallon size tree for every three spaces. For parking lot islands, a minimum 12 inch wide walk adjacent to parking stalls shall be provided and be separated from vehicular areas by a six inch high, six inch wide portland concrete cement curb. 2. Parking lot lights shall be low pressure sodium and have a maximum height of 25 feet from the finished grade of the parking surface and be directed away from all property lines, adjacent streets and buildings on adjacent lots. 3. All two-way traffic aisles shall be a minimum of 25 feet wide. A minimum of 24 feet wide emergency access shall be provided, maintained free and clear at all times during construction in accordance with Safety Services Department requirements. 4. All parking spaces shall be double striped. 8 of 17 APR 2 7 1993 ITEM 6 Resolution No. P- Page 5 LANDSCAPING 1. A detai 1 ed 1 andscape and irrigation plan shall be submitted to and approved by the Planning Services Department prior to the issuance of building permits. The landscape plan shall include trees and shrubs to screen the truck parking and loading areas at the back of the lot. 2. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. GRADING 1. Grading of the subject property shall be in accordance with the Uniform Buil di ng Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading practices. 2. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work at first submittal of a gradinglprivate improvement plan. 3. The grading/private improvement plan, prepared on a standard size sheet, at 20 scale by a registered civil engineer shall be subject to review and approval by the Planning Services and Engineering Services Departments and shall be completed prior to issuance of a grading permit. 4. A pre-blast survey of surrounding property shall be conducted to the satisfaction of the City Engineer prior to any rock blasting. Seismic recordings shall be taken for all blasting and blasting shall occur only at locations and levels approved by the City Engineer. 5. All new slopes shall be a minimum of 2:1 (horizontal to vertical). 6. A final compaction report shall be submitted and approved pri or to issuance of building permits. 7. Site grading shall be certified by the project civil engineer prior to issuance of building permits. STREETS AND SIDEWALKS 1. All parking lot structural sections shall be submitted to and approved by the Director of Engineering Services. Pavement sections shall conform to the minimum required by the Poway Municipal Code Section 12.20.080. 9 of 17 APR 2 7 1993 ITEM 6 ~_.._-~_.._.- Resolution No. P- Page 6 2. All damaged off-site publ ic works facil ities, including parkway trees, sha 11 be repaired or replaced prior to exoneration of bonds and improvements, to the satisfaction of the Department of Engineering Services. 4. Prior to any work being performed in the public right-of-way, an encroachment permit shall be obtained from the Engineering Services Department and appropri ate fees pa i d, in addition to any other permits required. 5. Driveways shall have a minimum width of 30 feet and shall be designed as an alley apron with ten foot minimum radius. Where driveways are adjacent to sidewalks, pedestrian ramps shall be required. DRAINAGE AND FLOOD CONTROL 1. A drainage system capable of handling and disposing of all surface water originating within the property, and all surface waters that may flow onto the property from adjacent lands, shall be required. This drainage system shall include any easements and structures as required by the Director of Engineering Services to properly handle the drainage and it shall conform to the previous studies done for the business park. 2. Concentrated flows across driveways and/or sidewalks shall not be permitted. 3. On-site drainage shall connect to the exi sti ng stubs unless otherwi se approved by the City Engineer. UTILITIES 1. All proposed utilities within the project shall be installed underground. 2. Utility easements shall be provided to the specification of the serving utility companies and the Director of Engineering Services. 3. Water, sewer, and fi re protect i on systems plans shall be des i gned and constructed to meet requirements of the City of Poway and the County of San Diego Department of Health. 5. The applicant shall pay for a water system analysis to establish the proper size and location for the public water system. The amount will be determined by the cost of the analysis and shall be paid upon demand by the City. 6. Existing telephone, gas, electric, and all other public utilities and appurtenances shall be shown on the grading/private improvement plans. 7. All on-site water mains shall be public. A 20 foot easement shall be dedicated to the City over public water mains prior to occupancy. 8. Prior to occupancy, the sewer and water systems serving the project shall be installed to the satisfaction of the City Engineer. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. 1. Roof covering shall be fire retardant as per UBC Section 3203(e) and City of Poway Ordinance No. 64. - 2. The building shall display their numeric address in a manner visible from the access street. Minimum size of the building numbers shall be 18 inches on the front facade of the building, street facing side. Buil di ng address shall also be displayed on the roof in a manner satisfactory to the Director of Safety Services. 3. Every building hereafter constructed sha 11 be accessible to Fire Department apparatus by way of access roadways with all-weather driving surface of not 1 ess than 20 feet of unobstructed wi dth, with adequate roadway turning radius capable of supporting the imposed loads of fire apparatus having a minimum of 13'6" of vertical clearance. The road surface type shall be approved by the City Engineer, pursuant to the City of Poway Municipal Code. 4. The building will be required to install an approved fi re spri nkl er system. The building sprinkler system shall be des i gned to meet a .33/3000 design density at the roof. The entire system is to be monitored by a central monitoring company. System post indicator valve, with tamper switch, also monitored, shall be located by the City Fire Marshal prior to install ation. Approximate locations will be at the driveway entrance from Fl i nt Place. 5. Two new fire hydrants are required, to meet a minimum design criteria of 2500 gallons per mi nute (GPM). The location of the hydrants shall be determined by the City Fire Marshal. A 'Knox' Hazardous Material Data Storage and Key Cabinet, with weather housing, shall be required for the building at a location determined by the City Fire Marshal. A "Knox" padlock sha 11 be requi red for the fi re sprinkler system Post Indicator Valve. 7. Fire Department access for use of fi re fi ght i ng equipment shall be provided to the immediate job construction site at the start of construction and maintained at all times until construction is completed. 8. Permanent access roadways for fire apparatus shall be designated as 'Fire Lanes' with appropriate signs and curb markings. 9. The applicant shall provide a detailed plan for all storage areas and a complete inventory of all hazardous and toxic substances to be stored on the site. 10. A hazardous materials business plan stall be filed with the County Health Department and a copy provided to the Fire Department. GENERAL REOUIREMENTS AND APPROVALS 1. Should this subdivision be further divided, each fi na 1 map shall be submitted for approval by the Director of Engineering Services. 2. All provisions of the Subdivision Ordinance of the Poway Municipal Code shall be met as they relate to the division of land. 3. Prior to occupancy, all dedications shall be made and easements granted as required. 4. This approval is based on the existing site conditions represented on the proposed site plan and grading/private improvement plan. I f the actual conditions vary from those representations, the site plan must be changed to refl ect the actual conditions. Any substantial changes to the site plan must be approved by the Directors of Pl anni ng Services and Engineering Services and may require approval of the City Council.
