ABSTRACT
On July 6, 1993 a public hearing was held pursuant to Chapter 8.72 of the Poway Municipal Code to
determine whether the conditions existing on the above property are a nuisance and whether to order the
abatement thereof porsuant to that chapter. City Council adopted the proposed Resolution declaring the
subject property to be a nuisance and ordered the clean up of the site and ordered the removal of all inoperable
vehicles, parts, tires, waste oil, miscellaneous material and junk.

Environmental review is not required according to CEQA guidelines.
FISCAL IMPACT
All costs for abatement will be assessed to the property owner via 1994 tax rolls.
ADDITIONAL PUBLIC NOTIFICATION
None.
RECOMMENDATION
It is recommended that the City Council direct staff to re-inspect and release the Notice of Intent to Lien with
the County Assessors Office, if the subject property continues to be maintained in a neat and sanitary manner
during the next three to six months.

BACKGROUND
On July 6, 1993, the City Council adopted Resolution #93-098,
requiring the subject property be abated of all violations
itemized in the Resolution within ten (10) days. Staff was
directed to re-inspect and report back to Council on July 27,
1993, A Notice of Intent to Lien was filed with the County
Assessors Office.
FINDINGS
The re-inspection on July 19, 1993 found the majority of junk and
material being stored in the rear yard had been removed. Some
vehicle parts still needed to be removed, staff had a towing
company assist in the removal of the miscellaneous vehicle parts,
Photos will be made available at the meeting,
ENVIRONMENTAL REVIEW
Environmental review is not required according to CEQA guidelines.

The only cost incurred to date has been for the towing charges
which are reimbursed under the County Abatement Vehicle Program.
Any subsequent charges would be assessed via the 1994 tax rolls.

Dear Ms. Killen:
At their regular City Council Meeting of July 6, 1993, the City
Council declared the property at 13415 Acton Avenue to be a public
nuisance and ordered the removal of all junk and material within
ten (10) days.
Staff will be out to inspect the property on Wednesday, July 21,
1993 at 10:00 AM. If no one is able to meet me at this time,
please leave the side yard open for inspection. At this time, we
expect that all material and junk be removed.
If you have any questions, please call me at 679-4340. No
extension will be granted. A notice of intent to lien has been
filed with the County Assessors Office.
Enclosed are copies of the agenda report, resolution and notice of
intent to lien, If the City does not have to take any further
action, the notice of intent to lien will be lifted in 3 to 6
months as long as the property is maintained in a neat and
sanitary manner.
