SUBJECT: Poway Creek Storm Water Detention Basin (#5402): Benefit Resolution
ABSTRACT
This project was approved for Redevelopment Agency funding at the July 13, 1993 City Council/
Redevelopment Agency meeting. It is necessary to adopt the required benefit resolutions at this
time.
ENVIRONMENTAL REVIEW

FISCAL IMPACT
The project cost of $3,300,000 was appropriated within the approved FY 93-94 Redevelopment
Agency Capital Improvement Budget.

It is recommended that the City Council and Redevelopment Agency adopt the attached Benefit

SUBJECT: Poway Creek Storm Water Detention Basin (#5402): Benefit
Resolution
BACKGROUND
At their July 13, 1993 meeting, the City Council/Redevelopment Agency approved
the Poway Creek Storm Water Detention Basin project (#5402). It is necessary
at this time to determine that the project is of benefit to the Paguay
Redevelopment Project Area, and that no other reasonable means of financing
exists through the adoption benefit resolutions for the project.
FINDINGS
The Poway Creek Storm Water Detention Basin project provides for the creation
of an earthen dam on property currently owned by the City. The project wi 11
result in reduced flooding and storm related damage downstream of the
detention basin on property adjacent to Poway Creek. In addition, the project
will have the result of reducing the cost of other needed drainage
improvements along Poway Creek downstream of the basin within the Project
Area.
The lack of adequate drainage facilities has had a significant blighting
impact on much of the property within the Project Area which is adjacent to
Poway Creek. The Poway Creek Storm Water Detention Basin project is of
benefit to the Redevelopment Project Area and surrounding community as it will
improve the drainage conditions thereby reducing these blighting conditions.
The location of the project is in the immediate neighborhood of the Paguay
Redevelopment Project Area.

Staff has explored all known funding options including Community Development
Block Grant (COBG) funds. There are no known funding sources available for
the construction of this project other than redevelopment funds.
ENVIRONMENTAL REVIEW
Environmental review is not required for this item according to CEQA
guidelines.

RESOLUTION NO. 93-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
DETERMINING THAT THE POWAY CREEK STORM WATER DETENTION BASIN
(#5402) IS OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT
WHEREAS, the poway Redevelopment Agency is authorized to
carry out the redevelopment of the poway Redevelopment Project
Area; and
WHEREAS, the poway Redevelopment Agency has completed a
study to identify the public facility and improvement
deficiencies within the project Area and the immediate
neighborhood which concluded that the poway Creek Storm Water
Detention Basin project is necessary; and
WHEREAS, the location of the poway Creek Storm Water
Detention Basin project is in the immediate neighborhood of the
paguay Redevelopment Project and the project is necessary for the
execution of the Project under the provisions of California
Community Redevelopment Law (Health and Safety Code, section
33000 et. seq. ) and pursuant to the Redevelopment Plan for the
Project which was adopted on December 13, 1983, by Ordinance No.
117 of the city Council and as amended on June 15, 1993, by
Ordinance No. 415 of the City council; and
WHEREAS, Section 33445 of the California Health and Safety
code requires the City Council to determine that the project is
of benefit to the paguay Redevelopment project and that no other
reasonable means of financing are available to the city.
NOW, THEREFORE, IT IS RESOLVED that the city Council of the
city of poway does hereby resolve as follows:
section 1. The city Council hereby determines that the poway
Creek Storm Water Detention Basin project is of benefit to the
paguay Redevelopment Project and the surrounding community, as
the project will reduce the blighting conditions resulting from
inadequate drainage improvements along poway Creek.
section 2. The City Council further determines that no other
reasonable means of financing the improvements are available to
the community.
section 3. The city Clerk shall certify to the adoption of this
resolution.

WHEREAS, the poway Redevelopment Agency is authorized to
