ABSTRACf
The 1991 resolutions for Conditional Use Permit/Reclamation Plan 89-05 require an annual
review of the CalMat-Poway aggregate extraction and processing operation. The second
annua 1 monitoring has been conducted by staff and CalMat has demonstrated their
conformance with the conditions of approval. 'It is recommended that the City Counc il
receive and file this annual report on Conditional Use Permit/Reclamation Plan 89-05 for
CalMat-Poway.

Agenda reports were sent to the Creek Road Residents Association and to CalMat. The
letter from CalMat addressing the status of the operation between November 1991 and June
1993 has been received and is attached.
RECOMMENDATION
It is recommended that the City Council receive and file this annual report on
Conditional Use Permit and Reclamation Plan 89-05 for CalMat-Poway.

BACKGROUND
The City approved the revised resolution for the reclamation plan on July 23,
1991. The revised resolution for the conditional use permit was approved on
August 20, 1991. The City Council received and filed the first annual report
on Conditional Use Permit and Reclamation Plan 89-05 for CalMat-Poway on August
25, 1992.
FINDINGS
Jul v 30. 1992
The CalMat-Poway property was inspected by staff members from the Engineering,
Pl anni ng and Safety Servi ces Departments, Severo Chavez, Ca 1 Mat Ass i stant Manager
for Planning and Land Management and Joe Klein, CalMat project manager.
The chain link fence with gate was installed at the Kirkham Way entrance on May
13, 1992. Barbed wi re fenci ng has been placed around the peri phery of the
property on the upper slopes.
The uphill road slopes were stable with no signs of extensive erosion. The
downhill road slopes may need hydroseed if sloughing off occurs and the siltation
basins receive much soil.
A chain link fence was installed to protect the 0.2 acre area of riparian scrub
habitat within the Beeler Creek floodplain.

There had been one operational day since November 1991 to deliver 10 loads of
concrete to a residence along Beeler Canyon Road.
, The water storage tank, fire hydrant and water lines were inspected. A separate
test i ng of the system wi 11 be arranged with the Safety Services Department.
CalMat plans a static high pressure test of the water lines, chlorination and a
bacterial test.
Calmat had been operating the Poway plant at marginal capacity over the prior
year due to the slowdown in construction activities county-wide. They reported
that there had not been efforts to modernize or upgrade the capacity of the plant
and that will probably not occur until the economic situation improves.
The conditions of approval for the reclamation plan and the CUP were reviewed
with the CalMat staff. The letter submitted by CalMat addressed the status of
compliance with a number of the conditions. CalMat was commended for their
efforts over the prior year to address the issues raised by the City Council,
City staff and the public. They had made reasonable progress in fulfilling the
conditions of approval and had fulfilled all of the physical improvements, as
required, by May 1992.
AUQust 26. 1992
During the August 25, 1992 City Council meeting, Betty Rexford, a resident along
Creek Road, expressed concern about keeping the access gate from Beeler Canyon
Road locked at all times. On August 26, 1992, a fire department "Knox" lock was
installed on the gate by Safety Services staff to assure control of the gate
usage for emergency purposes. Use of the Beeler Canyon Road access for short
periods of time (due to planned or unforeseen blockage of the Kirkham Way access
route) may be allowed for 1 i mi ted peri ods in the future. Clearance from the
Planning Services, Engineering Services and Safety Services Departments must be
obtained to justify the temporary opening of the gate on a non-emergency basis.
June 18. 1993
A temporary use permit was processed and filming was conducted for scenes from
"The Renegade", by Stu Segall Productions, during late afternoon and evening
hours on a portion of the CalMat property beyond the paved section of Beeler
Canyon Road.
Julv 1. 1993
CalMat was sent a letter to clarify the status of the conditional use permit
(CUP)/reclamation plan for the CalMat-Poway operation. The physical improvement
conditions were completed, as required, by May 1992. Though there had been little
ope rat i ona 1 activity since the permit was approved in July/August 1991, the
CUP/reclamation plan was confirmed as being vested based on the phys i ca 1
improvements that were completed and future compl iance with the operational

requirements. The conditions pertaining to excavating and process i ng the
aggregate apply during production over the balance of the 40 years remaining from
the date of permit approval.

The CalMat-Poway property was inspected by staff members from the Planning and
Safety Services Departments, Severo Chavez, Ca lmat Assi stant Manager for Pl anni ng
and Land Management, Robert Imler, District Manager for North San Diego County
District and Joe Klein, Calmat project manager. The Engineering Services staff
member was unable to attend on that day. An Engineering and Planning Services
staff visit to the site was held on August 23, 1993 with Joe Klein of CalMat in
attendance.
Overhead loadout bunkers are stored on the site for future use. The bunkers were
salvaged from a former CalMat operation called Tidelands in National City.
Security has been an issue for the plant site. Since there have been few days
of operation over the past year, break-ins at the office building and vandalism
to the outbuildings have occurred.
The heavy rains in January and February 1993 caused erosion and siltation which
had been largely cleaned up. One remaining task is the removal of about two feet
of dirt around the fire hydrant.
Landscape maintenance is done about twice a month with some maintenance outside
the fence along the Beeler Canyon Road frontage and the rest done by accessing
the site from Kirkham Way for landscaping and irrigation within the plant site.
When the plant is activated for concrete batch production, a lead time of about
twohweeks is needed. A similar period is needed for the aggregate production
pla t.
Aggregate base is the only product that has left the plant over the past year.
As stated in Attachment A, the plant operated for a total of five days between
November 1991 and June 1993. There were 62 truck trips generated during that
time from the CalMat-Poway plant.
CalMat will continue to use the balance of the 330,000 cubic yards of stockpiled
material obtained several years ago from Cadillac Fairview before conducting new
excavation. This ope rat i ona 1 procedure conforms with the conditions and
mitigation measures in the resolutions for the reclamation plan and conditional
use permit.
The Engineering Services staff will review the $50,000 reclamation bond to
determine whether an annual adjustment is necessary. This condition is to ensure
the reclamation of the existing excavated area at any given time during the life
of the aggregate operation.

Speeding by General Dynamics employees and vendors is checked periodically by the
Sheriff's Department. A radar unit of the Sheriff's Department is parked along
Creek Road/Beeler Canyon Road on a random basis each month.
ENVIRONMENTAL REVIEW
The annual review is not subject to the California Environmental Quality Act
(CEQA) . A subsequent Environmental Impact Report (EIR) was certified for this
project by City Council Resolution No. 90-163 of August 7, 1990.

Dear Mr. Streeter:
As you are aware, the CalMat-Poway facility has had a limited
operation last year. For the time period between November 30, 1991
to June 30, 1993 the plant has been operated a total of five (5)
days. During that time period a total of 62 trucks trips left the
poway plant.
This limited production is a result of a very slow economy and
CalMat's management decision to reduce all of its operations in the
County in response to the economy.
Thank you for your assistance with this Conditional Use Permit
and Reclamation plan. -
On a related matter, you should have received a copy of the
mining operation annual report for the 1992 reporting period sent
to you and the Department of Conservation, office of mine reporting
and reclamation compliance. If you have not received this report
